ORDINANCE NUMBER 00-9968
AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF AN
ALLEY FROM CHICAGO STREET EAST TO THE PREVIIOUSLY VACATED ALLEY IN
SURVEYOR'S PLAT NO. 31 OF THE CITY OF SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on January 24, 2000, the governing body conducted a public hearing
on the petition of Salina Concrete Products, Inc., and Sharilyn Shook ("Petitioners") requesting
vacation of a part of an alley, located at 1100 West Ash Street from Chicago Street East One
Hundred Sixty (160) feet, more or less, to the previously vacated alley in Surveyor's Plat No. Thirty-
one (3 1) in the City of Salina, Saline County, Kansas, more particularly described as follows:
The east -west alley in Surveyor's Plat Thirty-one (3 1) (originally platted as
Lot Fourteen (14), except the east One Hundred Fifty-eight (158) feet
thereof, which was previously vacated, and lying adjacent to the south line
of Lots One (1) through Six (6) and the north line of Lots Seven (7)
through Twelve (12) in Surveyor's Plat Thirty-one (31), in the City of
Salina, Saline County, Kansas.
The above-described alley to be vacated contains Seven Thousand Two Hundred (7,200)
square feet, more or less.
Section 2. That the governing body finds from the evidence presented at the public
hearing that:
(a) Due and legal notice has been given by publication as required by
law.
(b) No private rights will be injured or endangered by vacation of the
right-of-way.
(c) In justice to the Petitioner vacation of the right-of-way should be
granted.
Section 3. That the above described portion of the public alley, which is
vacated by this ordinance, shall revert to the adjacent property owners in accordance
with K.S.A. 13-443.
Section 4. That this ordinance shall be in full force and effect from and after its
adoption and publication once in the official city newspaper.
