ORDINANCE NUMBER 02-10072
AN ORDINANCE PROVIDING FOR THE VACATION OF RESERVE "A" IN
THE RIFFEL ADDITION TO THE CITY OF SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on January 28, 2002, the governing body conducted a public hearing on
the petition of Walter Lewis on behalf of Kumazuki Fudosan LC of Sedgwick County, Kansas
("Petitioner") requesting vacation of Reserve "A" in the Riffel Addition to the City of Salina, Saline
County, Kansas. This reservation of right-of-way abuts Lot 7, Block 1 of the Riffel Addition on the
east and contains twelve thousand six hundred and seventy-seven (12,677) square feet, more or less.
hearing that:
Section 2. That the governing body finds from the evidence presented at the public
(a) Due and legal notice has been given by publication as required by law.
(b) No private rights will be injured or endangered by vacation of the right-
of-way.
(c) In justice to the Petitioner vacation of the right-of-way should be
granted.
(d) Reserve "A" is no longer needed to provide public street access to the
adjoining property to the south because the owner of the property has
agreed to seek alternate access.
Section 3. That the right-of-way is hereby vacated and shall revert to the owner of Lot 7,
Block 1 of the Riffel Addition to the City of Salina, Saline County, Kansas, in accordance with the
recorded plat of the Riffel Addition.
Section 4. That this ordinance shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.
