5920 Eminent Domain(Published in the Salina Journal -fa,,,, r- ,195_) ORDINANCE NUMBER 5920 AN ORDINANCE providing for the acquisition of certain land within the City of Salina, Kansas, and for the improvement of the same for off-street parking facilities. WHEREAS, the Board of Commissioners of the City of Salina, Kansas, heretofore duly adopted and caused to be duly published that certain resolution number 1504, which was a resolu- tion "determining (1) it t6 be advisable, and for and of benefit to the city, to acquire certain lands hereinafter described and to improve the same for off-street parking facilities; (2) the aggregate amount of money to be expended for such acquisition and improvement; and (3) that it is necessary to issue revenue bonds of said city in the manner and form provided by law for the purpose of paying a part of such aggregate cost; and WHEREAS,, it is deemed advisable for the City of Salina to proceed to carry out the acquisition of such land and the improvement thereof for the purpose aforesaid; and i SO NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF SALINA, KANSAS: Section 1. That the City acquire by contract for the use of the City of Salina, Kansas, as an off-street parking facility the following described land, to -wit: Lots 99,122,124,126, and 128; the South Forty (40) feet of Lot 97 and the North One -Half (2) of Lot 101, all on the Seventh Street in the Original Tiwn (now City) of Salina, Saline County, Kansas; j and that the contracts of acquisition relating thereto shall be contingent upon the sale of revenue bonds to be hereafter issued and sold for the purpose of paying the cost of such acquisition and the improvement of said lands; for said purpose and the purchase price shall be within the estimate of the cost thereof as hereinafter provided for. Section 2. That the City Engineer of the City of Salina, Kansas, be and he is hereby directed to file a detailed estimate, under oath, of the cost of acquiring the lands aforesaid and of the improvement thereof as off-street parking facilities with the City Clerk of said City by the giq ,d*y of December , 1954; that the City Engineer is hereby directed to prepare detailed plans and specifications for the improvement of the lands aforesaid as off-street parking facilitiesand is directed to file the same with the City Clerk of said city on or before the 2nd day of December ,1954; that the general nature of the improvements to be placed on the lands aforesaid shall be surfacing of the same with six-inch (87 reinforced concrete, the installation of curbs,lighting, markings, driveways, and other necessary improvements to properly adapt the said lands to use as off-street parking facilities. Section 3. That after such plans and specifications have been made and filed as aforesaid, and the acquisition of said lands as herein provided, the Board of Commiss- ioners shall advertise by advertisement published in the official city paper for three consecutive days for the receipt of sealed bids for the completion of said work as provided for in Section 2 hereof; and after the receipt of bids and proposals, the said Boe1M is hereby authorized to let a contract for the completion of said improvement. The Board of Commissioners hereby reserves the right to reject any and all bids and to install said improvements by force account as by law made and provided and within the detailed estimate of cost, aforesaid. ISection 4. For the payment of the cost thereof, the Board of Commissioners of the City of Salina, Kansas, shall make available the sum of $10,000 now on hand in the treasury of said city to apply on the payment of said cost; and that the Board of Com- a m missioners of said city shall make lawful provision for the issuance of revenue bonds I for such purpose for a sufficient sum to complete the acquisition of said land and the improvement thereof as aforesaid, all in the manner and form as made and provided by law for the issuance of such bonds. Section 5. That the total of the $10,000 on hand as aforesaid and the proceeds of the issuance of revenue bonds as aforesaid shall not exceed the estimated cost, adore- . said. Section 6.
