ORDINANCE NUMBERX.

AN ORDINANCE creating and defining certain lateral sanitary sewer districts in the City of
Salina, Kansas, designated as Lateral Sanitary Sewer Districts Numbered 307, 308, 309, and
310, and provideing for the construction of lateral sanitary sewer in each of said Lateral
Sanitary Sewer Districts Numbered 307, 308, 309, and 310, so cretted, and providing for the
payment of the cost thereof and for the levying of special assessments against the property
in said districts for the payment of .the cost of such constructions and for the issuing of
bonds to pay the cost thereof.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. Lateral Sanitary Sewer District Number 307. That there be and there
is hereby created lateral sanitary sewer district in the City of Salina, Kansas, which shall
be and it is hereby designated as Lateral Sanitary sewer District Number 307 and which dis-
trict shall include all the following described property in the City of Salina, Kansas, to -
wit:
Benefit District. Lots 4 to 12 inclusive of Block 4, Stack Place, and
Lots 1 to 12 inclusive, Block 8, Stack place, all in the City of Salina,
Saline County, Kansas.,
Section 2. It is necessary and it is hereby ordered that an eight inch V.C.P.
lateral sanitary sewer with all necessary connections, manholes,flushing tanks and other
appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District
Number 307 as created by Section 1 of this ordinance along the following course, to -wit:
An 8 inch clay pipe sewer beginning at an existing manhole which is
14 feet north of the south line of Stack Avenue and on center line of
alley first east of Delaware extended north, thence east in Stack
Avenue 171 feet where a manhole will be constructed, at which man-
hole a branch will extend north and a branch will extend south. The
north branch will begin at said manhole, thence north along the center
line of Missouri Avenue 85 feet where a manhole will be constructed;
thence east along a line 4 feet north of the north line of Lot 12,
Block 14, Stack Addition, 92 feet where a manhole will be constructed;
thence north 316 feet where a manhole will be constructed which terminates
the north branch of Lateral 311; the south branch will begin at the man-
hole in the center line of Missouri Avenue and 14 feet north of the south
line of Stack Avenue; thence south along the center line of Missouri
Avenue 514 feet, there a manhole will be constructed which will be the
terminus of Lateral 307.
Section 3. Lateral Sanitary Sewer District Number 308.; That there be and there
is hereby created Lateral Sanitary Sewer district in the City of Salina, Kansas, which shall
be and it is hereby designated as Lateral Sanitary Sewer District Number 308 and which dis-
trict shall include all the following described property in the City of Salina, Kansas, to -
wit:
Benefit District. Lots 1 to 18 inclusive, all in Harper Addition
to the City of Salina, Kansas.
Section 4. It is necessary and it is hereby ordered that an eight inch V.C.P.
lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other
appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District
Number 308 as created by Section 3 of this ordinance along the following course, to -wit:
an 8 inch clay pipe sewer beginning at an existing manhole in
the center line of Lewis Street and the center line of easement
in Wymore Addition; thence south along the center line of Lewis
Street and 345.13 feet to the center line of easement in Harper
Addition extended east; thence west along center line of said
easement in Harper Addition 565 feet where a manhole will be
constructed which will be terminus of lateral 308.

Section 5. Lateral Sanitary Sewer District Number 309. That there be and there
s hereby created Lateral sanitary sewer district in the City of Salina, Kansas, which shall
and it is hereby designated as Lateral Sanitary Sewer District Number 309 and which dis--

shall include all the following described property in the City of Salina, Kansas, to -
Benefit District All of Block 3, Hoffman Replat of Part of Blocks
1 and 2 and all of Blocks 7 and 8, Hageman Park Addition, City of
Salina, Saline County, Kansas.
Section 6. It is necessary and it is hereby ordered that an eight inch V.C.P.
sanitary sewer with all necessary connections, manholes, flushing tanks and other
s be constructed and built in and to serve said Lateral Sanitary Sewer District
309 as created by Section 5 of this ordinance along the following course, to -wit:
An 8 inch clay pipe sewer beginning at a manhole in the center
line of McAdams Road and center line of utility easement ex-
tended north in Block 3, Hoffman Replat of Part of Blocks 1
and 2 and all of Blocks 7 and 8, Hageman Park Addition; thence
south along center line of said utility easement 510 feet where
a manhole will be constructed which will be terminus of Lateral

Section 7. Lateral Sanitary Sewer District Number 310. That there be and there
s hereby created Lateral sanitary sewer district in the City of Salina, Kansas, which shall
and it is hereby designated as Lateral Sanitary Sewer District Number 310 and which dis-

shall include all the following described property in the City of Salina, Kansas, to -
Benefit District. All of Block 1, Hoffman Replat of Parts of Blocks
1 and 2 and all of Blocks 7 and 8 of Hageman Park Addition, City of
Salina, Saline County, Kansas.
Section 8. It is necessary and it is hereby ordered that an eight inch V.C.P.
sanitary sewer with all necessary connections, manholes, flushing tanks and other
be constructed and built in and to serve said Lateral Sanitary Sewer District
310 as created by Section 7 of this ordinance along the following course, to -wit:
An 8 inch clay pipe sewer beginning at a manhole in the center
line of McAdams Road and the center line of utility easement
extended north in Block 1, Hoffman Replat of Part of Blocks
1 and 2 and all of Blocks 7 and 8 Hageman Park Addition; thence
south along center line of said easement 510 feet where a man -
will be constructed which will be terminus of Lateral 310.
Section 9. That the City Engineer shall on or before November 29 195+
and file in the office of the City Clerk, plans and specifications for the construe -
on of the lateral sanitary sewer provided for in the preceeding sections of this ordinance
ch shall be of the proper character to serve the rpoperty lying within the district which
sewer is to be constructed and shall on or before the same date prepare and submi# to the
of Commissioners a detailed estimate under oath of the cost thereof. That thereafter
the City Clerk shall advertise for these consectutive days in the official city paper for

sealed proposals for the building and construction of such sewer according to such plans and
specification, which proposals shall be filed with the City Clerk on or before the time fixed
in such notice, at which time the Board of Commissioners may let a contract for the building

and construction of such sewer to the lowest and best responsible bidder or bidders thereforg,
said Board shall reserve the right to reject any or all such proposals, and if no bids
shall be received within such estimate, the Board of Commissioners shall have the power to do
such work and make such improvements within the estimated cost thereof as provided by law.
Section 10. That for the cost of building and construction of such sewer,

special assessments shall be made for the full cost thereof on all lots and pieces of land
within and for which such sewer shall be built, according to the appraised value thereof,
without regard to the building or improvements thereon.

Sectionll. After the passage and publication of this ordinance, the Board of
Commissioners shall appoint three disinterest appraisers, ppraisers, who after having taken an oath to
i make a true and impartial appraisement of all lots and pieces of land liable to taxation for

the cost of such improvements, shall within five days after having been notified of their
f appointments proceed to appraise all of the lots and pieces of land within the district
liable to assessment and taxation as aforesaid, without regard to the building or improve-
ments thereon, and after making such appraisements, Thal return to the Board of Commission-
ers of said city and said Board shall designate a time for a special meeting of said Board
for the iurpose of hearing any complaints that may be made as to the value of any lot or

piece of land, if, in their opinion, the same hasabeen appraised too high of too low.
Section 12. The special assessment herein provided for my be paid by the per-
son liable therefore in four approximately equal annual installments but the owner of any

s property liable to such assessment may within thirty days from the date of determining the

amount assessed against the property, a the same in full and his

liable for any assessments for the cost of such improvements, and bonds as hereinafter

provided for shall be issued in the amount of the cost of such improvements remaining unpaid
i
y at the end of the thirty days from the time such assessment is fixed.
Swction/ 13. For the purpose of paying for the work and improvements in this
i
ordinance provided for, the Board of Commissioners may and are hereby authorized and directed
to issue improvement bonds of the City of Salina, Kansas, in an amount not to exceed the tota7I
cost of such improvement, and to run for a period of four years and be payable in four
ff
i
approximately equal annual installments, together with interest not to exceed the total cost
I
of such improvements, and to run for a period of four years, and be payable in four approx-
imately equal annual installments, together with interest not to exceed fire per cent per
i
annum, which bonds shall be issued and payable according to law; and for the purpose of pay-
I ing the principal and interest on said bonds as they severally become due and payable the
i
Board of Commissioners shall apportion and assess against the lots and pieces of land with-
in the taxing district of such improvements, special assessments covering the cost of such
improvement that are to be collected from the specific property chargeable therefore, and
with such improvements; such assesment and apportionment ordinance shall contain the total
amount of tax apportioned to each such tact, piece or parcel of land within the taxing dis-
trict and shall state the number of annual installments in which such tax is to be collected;
and thereafter the City Clerk shall annually, at the same time that other taxes are certified

certify to the County Clerk of Saline County, Kansas, a full list of all property liable for

such work and improvement, together with the respective amounts dued on each of said tracts,
� pieces or parcels of land, which amounts shall include the annual installment and interest
on all unpaid balances for one year at the rate of not to exceed five per cent per annum, I
I
on such amounts so certified, which amounts shall be collected as other taxes are collected.
Section 14. This ordinance shall take effect and be in force from and after its
publication once in the official city paper.
