5918 Issue GO Bonds P-163ORDINANCE NUMBER 5918 1 (Published in the Salina, JournalL j s if t? �� ,.�. r ,1954 ) AN ORDINANCE authorizing and providing for the issuance of Improvement Bonds of the City ;of Salina, Kansas, all in the sum of $239,314.90, to pay the cost of improving certain ,streets in said city to be designated as Series Number P-163. !WHEREAS, pursuant to proceedings duly had according to law, contracts have been lst and per- formed for the construction of the following street improvements in the City of Salina, Kansas, to-wit: Curbing, guttering, grading and paving to a width of forty (40) { feet with two-inch hot mixed asphaltic concrete over a six- inch rock stabilized base, Crawford Avenue, from the west line of the Union Pacific Railroad Right of Way, thence east to the west line of Roach Street, extended north or south, as provided for by Resolution Number 1387 and Ordinance Number 5780. Curbing and guttering, paving and grading of Marietta Avenue from the west line of Clark Street to the east line of Chicago Street, as provided for by Resolution Number 1401 and Ordinance Number 5791. Paving of Connecticut Avenue from the south line of Gypsum Avenue to the south line of Stack Avenue, as pro- vided for jjy Resolution Number 1379 and Ordinance Number 5791• Paving of Kenison Road from the south line of Wilson Street a to the south line of McAdams Road, as provided for by Res- olution Number 1394 and Ordinance Number 5791. Paving of Ellsworth Street from the west line of Highland Circle to the east line of Pershing Street, as provided for by Resolution Number 1419 and Ordinance Number 5807. Paving of Phillips Street from the north line of Prescott Avenue to the south line of Charles Street, as provided for by Resolution Number 1406 and Ordinance Number 5807. Paving of Roach Street from the north line of McAdams Road to the south line of Martin Avenue, as provided for by Resolution Number 1414 and Ordinance Number 5807. Curbing, guttering, and paving of Roach Street from the south line of Minneapolis Avenue to the north line of Beloit Street, as provided for by Resolution Number 1408 and Ordinance Number 5807. Curbing, guttering and grading of Third Street, from the north line of Harsh Avenue to the south line of Hamilton Avenue, as provided for by Resolution Number 1402 and Ordinance Number 5807. Paving of Wilson Street from the west line of Kenison Road to the east line of Sunrise Drive, as provided for by Res- olution Number 1409 and Ordinance Number 5807. Paving and grading of Wilson Street from the east line of Roach Stre6t to the west line of Sunrise Drive, as privided for by Resolution No. 1423. and Ordinance No. 5807. Grading and paving to a width of twenty-eight (28) feet with two-inch hot mixed asphaltic concrete over a six-inch rock stabilized base, Front Street from the north line of Iron Avenue to the South line of Ash Street, as providede for by Resolution Number 1437 and Ordinance Number 5859• Grading and paving to a width of twenty-eight (28) feet with two-inch hot mixed asphaltic concrete, over a six- inch rock stabilized base, of Twelfth Street from the north line of Charles Street to the north line of Crawford Avenue, as provided for by Resolution Number 1444 and Ordinance Number 5859• Grading and paving to a width of twenty-eight (28) feet with two-inch hot mixed asphaltic concrete, over a six- inch rock stabilized base, of Wilson Street from the East line of Front Street to the West line of Kenison Road, as provided for by Resolution Number 1442 and Ordinance Number 5859• Paving of Frost Street from the east lineof Sherman to the east line of Eleventh Street, as provided for by Resolution Number 1445 and Ordinance Number 5849. Paving of Sunrise Drive from the North line of Wilson Street to the South line of McAdams Road, as provided for by Resolution Number 1446 and Ordinance Number 5849. Paving and grading of Sunrise DRive from the north line of Morningside Drivw to noitth line of Republic Avenue, as provided for by Resolution Number 1432 and Ordinance Number 5849. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the foregoing preambles be and they are hereby authorized as a part of this ordinance and that for the purpose of providing funds to pay the cost of im- provements herein above referred to and described in the ordinances and resolutions of and hereinbegote referred to, there shall be issued Internal Improvement Bonds of the City of Salina, Kansas, in the total principal sum of $239,314.90, which shall consist of Two Hundred Thirty -Nine, numbered 1 to 239, inclusive all dated November 1, 1954, which shall bear interest at the rate of One and Five-Ei hths- l cent er 8 p � 5j ) Per annum and from and after said date until the repective maturities of said bonds, payable May 1, and November 1, 1955 thereafter on each May 1, and November 1 , in each year, siaid interest to be evidenced by interest coupons as herein provided for and said bonds shall become due as follows: Paving of Washington Street from the west line of Twelfth Street to the west line of Phillips Street, as provided for c by Resolution Number 1428 and Ordinance Number 5849. WHEREAS, the total cost of said improvements has been ascertained and the portion thereof in the amount $98,684.67 to of be paid by general taxes to be levied upon all taxable property within said city for the improvement of squares and areas formed by the crossing of streets and alleys and for the improvement of any of said streets, where the same is through or ad- jacent to property of the City for which the city is liable, and for which bonds are to be i issued; and / J WHEREAS, the total cost of said curbing, guttering, paving and grading of sai streets, which are to be paid by special assessments and to be levied upon lots and pieces oftground liable for the payment of said curbing, guttering, grading and paving in saidstreets has been ascertained and has been hereby found and determined to be the sum of $256 4:51.79Cwhich amount has been heretofore duly assessed and apportioned tothe several lots and pieces of ground liable therefore according to law provided for in the ordinance of the City of Salina, j' Kansas, relating thereto, duly passed and approved of which amount the sum of $17,136.89 ! has been duly paid by the property owners liable therefore, leaving a balance of $140,630.23 for which bonds are to be issued; and WHEREAS, bonds in the aggregate sum of $239,314.90 are to be issued to pay the actual cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. Said bonds shall be signed by the Mayor and shall be attested by the signature of the City Clerk and corporate seal of the city shall be affixed thereto and said bonds shall have attached thereto interest coupons represneting the interest thereon, which coupon shall be in the form provided by the law and shall bear the printed or lith- ographed facsimile signature of the Mayor and City Celrk of said city and said bonds and interest coupons shall be registered in the office of the City Clerk and in the office of the Auditor of State,,. as required by law. Section 3. Said bonds shall be designated as Series P-163 and shall be in the form and shall contain recitals substantially as follows, to -wit: C. UNITED STATES OF AMERICA STATE OF KANSAS COUNTY OF SALINE CITY OF SALINA INTERNAL IMPROVENM BONDS No. Series P-163 KNOW ALL MEN BY TEEESE PRESENTS, That the City of Salina in the County of Saline, State of Kansas, acknowledges itself to be indebted and for value received hereby promises to pay to the bearer the sum of DM TARS in lawful money of the United States of America, on the first day of ,i9 , with interest thereon from the date hereof at the rate of per cent per annum payable May 1, and November 1, 1955 thereafter on each May 1, and November 1, in each year, on presentation and surrender of the interest doupong heret©:.�i'- fixed as said coupons become severally due, both principal and interest of this bond being payable at the office of the State Treasurer of the State of Kansas, in the City of Topeka, Kansas. I This bond is one of a series of 239 bonds of like date and tenor, excepting denominations, i� interest rate and maturity, aggregating the principal sum of $239,31+.90 issued by the City of Salina, Kansas, for the purpose of paying the cost of constructing, curbing, gutter-) ing, paving and grading improvements in said city by the authority of and in full com- pliance with the provisions, restrictions and limitations of the constitution and laws of the State of Kansas, including Sections 10-101 to 10-128, 12-601 to 12-608 and 13--1011 and 13-1011a, all of the General Statutes of Kansas, 1949, and amendments thereto, and all other provisions of the laws of said state applicable thereto, and this bond and all other bonds of this series, and all interest thereon are to be paitd by the city of Salina, Kansas.; And it is hereby declared and certified that all acts, conditions, and things required to be done and exist precedent to and in the issuance of this bond have been pro rl done Pe Y and performed and do exist in due and regular form and manner as required by laws and the constitution and laws of the State of Kansas, and that the total indebtedness of said city, including this series of bonds, does not exceed any constitutional or statutory limitation.
