ORDINANCE NUMBER 5917

AN ORDINANCE authorizing and providing for the issuance of Improvement Bonds of the City
of Salina, Kansas, in the sum of $32,267.88 to pay the cost of improving certain streets
in said city to be designated as Series Number P-162.
WHEREAS, pursuant to proceedings duly had according to law, contracts have been lot and
performed for the construction of the following street improvements in the City of Salina,
Kansas, to -wit:
Curbing, guttering and grading of the North side of Cloud Street
from the center line of Eleventh Street to the center line of
Pershing Avenue, as providing by Resolution Number 1380 and
Ordinance Number 5792.
Curbing, guttering and grading of Eleventh Street from the
center line of Hamilton Street to the center line of Antrim
Street, as providing by Resolution Number 1386 and Ord.iaance
Number 5792.
Curbing, guttering, and grading of the east side of Fourth
Street from the center line of Lamar Street to the center
line of Republic Avenue, as providing by Resolution Number
1390 and Ordinance Number 5792• .
Curbing, guttering and grading of the south side of Martin
Avenue from the east line of Lewis Avenue to the west line
of Ohio Avenue, as providing by Resolution Number 1384 and
Ordinance Number 5792.
Curbing, guttering and grading of Second Street on the west
side from the center line of Wilson Streetm 200 feet south from
the south line of Wilson Street and on the east side from the center
line of Wilson Street south 350 feet south from the south
line of Wilson Street, as providing by Resolution Number 1358
and Ordinance Number 5792•
Curbing, guttering and grading of the west side of Third
Street from the north line of Walnut Street 350 feet, more
or less, to the north bank of the Smoky Hill River, as
providing by Resolution Number 1388 and Ordinance Number
5792•
Curbing, guttering and grading of the north aide of Wilson
Street from the center line of Fourth Street to the east
lot line of Lot Twelve (12) Mock Five (5), College View
Addition and curbing, guttering and grading of Wilson Street
(south side) from the center line of Fourth Street to the
west line of Third Street, as providing by Resolution Number
1395 and Ordinance Number 5792.
Curbing, gutterfing and grading of South Side of Il.lsworth
Avenue from east line of Lewis Street to the West line of
Ohio Street, as providing by Resolution Number 1434 and
Ordinance Number 5848.
Curbing, guttering and grading of Fifth Street, from center
line of Harsh Avenue to center line of Hamilton Avenue, as
providing by Resolution Number 1427 and Ordinance Number 5848.
Curbing, guttering and grading of the north aide of Jewell Avenue
from the center line of Roach Street to the center line of
Ohio Avenue, as providing by Resolution Number 1360 and
Ordinance Number 5848.
Curbing, guttering and grading of Lewis Street from the
north line of Jewell Avenue north approximately 128 feet
more or less, as providing by Resolution Number 1433 and
Ordinance Number 5848.
Curbing, guttering and grading of Linciln Avenue from the
center line of Chester Avenue to the center line of Arthur
Avenue, as providing by Resolution Number 1441 and Ordinance
Number 5848.
Curbing, guttering and grading of Missouri Avenue, from
the south line of Stack Avenue to the south line of Gypsum
Avenue, as providing by Resolution Number 1431 and Ordinance
Number 5848.

Curbing, guttering and grading the West Side of Ohio.
Avenue from the center line of Ellsworth Avenue to the
center line of Jewell Avenue, as providing by Resolution
Number 1364 and Ordinance Number 5848.
WHEREAS, the total cost of said improvements has been ascertained and the portion thereof
in the amount of $20,488.69 to be paid by the general taxes to be levied upon all tax-
able property within said city for the improvement of squares and areas formed by the
crossing of street and alleys and for the improvement of any of said streets where the
same is through or adjacent to property of the city for which the city is liable, and
for which bonds are to be issued; and
WHEREAS, the total cost of said curbing, guttering and grading'of said streets, which are
to be paid by special assessments are to be levied upon lots.and pieces of ground liable
for the payment of said curbing, guttering and grading in said street has been ascertained
and has been found and determined to be the sum of $37,-485.08, which amount has bben hereto-
fore duly assessed and approtioned to the several lots and pieces of ground liable there-
fore according to law provided for in the ordinance of the city of Salina, Kansas, relating
thereto, duly passed and approved, of which amount the sum of $5,217.20 has been duly paid
by the property owners liable therefore, leaving a balance of $11,779.19, for which bonds
are to be issued; and
WHEREAS, bonds in the aggregate sum of $32,267.88 are to be issued to pay the actual net
cost thereof.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the foregoing preambles be and they are hereby authorized as a part
of this ordinance and that for the purpose of providing funds to pay the cost of the
improvements herein above referred to and described in the Ordinances and Resolutions
hereinbefore referred to, there shall be issued Internal Improvement Bonds of the City
of Salina, Kansas, in the total principal sum of $32,267.88, which shall consist of
`Dirty -Two bonds numbered 1 to 32, inclusive, all dated November 1, 1954, which shall
bear interest at the rate of One and five-eighths (1-5/8%) per cent

per annum from and after said date until the respective maturity of said bonds, payable
May 1, and November 1, 1955 thereafter on each May 1, and November 1, in each year, said
interest to be evidenced by interest coupons as herein provided for and said bonds shall
become due as follows:
Bonds numbered 1 to 4, for $1,000.00 each
except Number 1 is for $1,267.88 due May
1, 1956.
Bonds numbered 5 to 8, for $1,000.00 each
due November 1, 1956.
Bonds numbered 9 to 12, for $1,000.00 each
due May 1, 1957•
Bonds numbered 13 to 16, for $1,000.00 each
due November 1, 1957•
Bonds numbered 17-20, for $1,000.00 each
due May 1, 1952.
Bonds numbered 21 to 24, for $1,000.00 each
due November 11 195'.
Bonds numbered 25 to 28, for $1,000.00 each
due May 11 1957
Bonds numbered 29 to 32, for $1,000.00 each
due November 1, 19 5.
Section 2. Said bonds shall be signed by the Mayor and shall be attested by the
signature of the City Clerk and corporate seal of the city shall be affixed thereto, and
said bonds shall have attached thereto interest coupons representing the interest thereon,
which coupons shall be in the form provided by law and shall bear the printed or lith-
ographed facsimile signature of the Mayor and City Clerk of said city and sfid bonds

?and interest coupons shall be registered in the office of the City Clerk and in the office
of the Auditor of State, as required by law.
Section 3. Said bonds shall be designated as Series P-162 and shall be in the

KNOW ALL MEN BY THESE PRESENTS, That the City of Salina in the County of Saline, State of
Kansas, acknowledges itself to be indebted and for value received hereby promises to pay to
the bearer the sum of DOLLARS in lawful money of the United
States of America, on the first day of 19 , with interest thereon
from the date hereof at the rate of 4r. r p - per cent per annum payable
May 1, and November 1, 1955 thereafter on each May 1, and November 1, in each year, on
presentation and surrender of the interest of this bond being payable at the office of the
State Treasurer of the State of Kansas, in the City of Topeka, Kansas, and siad City of Salina.,'
Kansas, is held and firmly bound by these presents and the full faith, credit and resources
of said city are hereby irrevocably pledged for the payment of said principal and interest
at maturity.
This bond is one of a series of 82 bonds of like date and tenor, excepting denomination, and
;maturity, aggregating the principal sum of $32,267.88 issued by the City of Salina, Kansas,

for the purpose of paying the cost of constructing certain curbing, guttering and grading
in said city by the authority of and in full compliance with the provisions, re-
$strictions and limitations of the constitution of and the laws of the S ate of Kansas, in-
cluding Section 10-101 to 10---127, 12-601 to 12-608 and 13-1011 and 1311011a, all of the
General Statutes of Kansas, 1949, and amendments thereto, and all other provisions of the
,laws of said state applicable thereto, and this bond and all other bonds of this series, and
fall interest thereon are to be paid by the City of Salina, Kansas.
And it is hereby declared and certified that all acts, conditions, and things required to be
done and to exist precedent to and in the issuance of this bond have been properly done and
performed and do exist and in due and regular form and named as required by the constitution
and laws of the State of Kansas and that the total indebtedness of said city, including this
series of bonds, does not exceed any constitutional or statutory limitation.
IN WITNESS WHEREOF, the said City of Salina, Kansas, has executed this bond by causing it to
be signed by its Mayor and its corporate seal to be hereto affixed, attested by its City
Clerk and the coupons hereto attached to be signed with the facsimile signatures of said
officers, and this bond to be dated the first day of November 1954.

Section 4. The Mayor and City Clerk are herby authorized and directed to prepare and
execute the bonds hereinbefore described and to advertise and sell thb same in the manner
provided by law, and when executed and registered to deliver and said bonds to the pur-
chaser or purchasers thereof.

Section 5. The full faith, credit and resources of the City of Salina, Kansas,
shall be and the same are hereby irrevocably pledged for the prompt payment of said bonds
and all interest thereon. The Board. of Corwdssioners of the City of Salina, Kansas, shall
annially make provision for the payment of the principal and interes on s*Ad, bonds as they
severally become clued by levying taxes and assessments upon the property liable therefore
as provided by law.
Section 6. This ordinance shall take effect and be in force from and after the
publication once in the official city paper.
