5916 Issue Park Bonds - PK-1641 1 Lei ORDINANCE NUMBER 5916 (Published in the Salina Journal '<-z-C) ,195+) AN ORDINANCE authorizing and providing for the issuance of the bonds of the City of Salina, Kansas, in the sum of $275,000.00 to pay the cost of acquiring lands for public parks and developing the same for such purpose, to be designated as Series "PK -164". WHEREAS, at an election duly called and regularly held in the City of Salina, Kansas, on August 3, 1954, there was submitted to the qualified electors of said city a propos- ition of "Shall the City of Salina issue its general obligation bonds in the amount of $275,000.00 under the provisions of Section 13-1024, 1953 Supplement to the General Statutes of Kansas, 1949, for the purpose of paying the cost of acquiring land for public parks and developing the same for such purposes within t6'lwithout the said city", all pursuant to Ordinance Number 5867 of said city and laws of the State of Kansas...; and WHEREAS, all directives of said ordinance, numbered 5867, and the requisites of the laws of the State of Kansas were duly and timely complied with; and WHERHAS, at such election the magority of said votes cast thereat upon said proposition were cast in favor of authorizing the said City of Salina to issue its bonds in said sum for such purpose, all as duly and regularly determined by the Board of Commissioners of said city meeting as a Board of Canvassers (ex officio) in the manner and form required by a law; and WHEREAS, Harold F. Harper, City Engineer of said city, was be resolution Number 1494, duly adopted by the Board of Commissioners of said city, directed to and did submit unto the Board of Commissioners of said public parks and developing and the same for such purpose, all in compliance with the directives of said resolution numbered as aforesaid; and WHEREAS, said Board of Commissioners did receive, accept, and approve said detailed es- timate of cost thereof; and WHEREAS, the estimate of cost was the sum of $275,000.00; and SO, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF SALINA, KANSAS: Section 1. AUTHORIZATION OF BOND ISSUE. That the foregoing preambles are here- by made a part of this ordinance. That the Board of Commissioners of the City of Salina, Kansas, deem it necessary to provide for the acquisition of land for public parks and the development of the same for such pirpose as heretofore duly authorized by the qualified electors of said city. That for the purpose of paying the cost of acquiring said land and developing the same for said purpose, it is hereby ordered that internal improvement e and general obligation bonds of the City of Salina, Kansas, in the principal sum of $275,000.00 be issued, that being the estimated cost of acquiring said land and developing the same as duly authorized as aforesaid. That the sum of $275,000.00 shall be represent- ed by 275 bonds in the principal sim of $1,000 each, and numbered 1 to 275, both in- clusive, and said bonds shall be dated November 1, 1954. Said bonds shall bear interest one and give -eighths per cent per annum, at the rate/payable May 1, 1955, and semi-annually thereafter on the succeeding November 1 and May 1 of each year. That said bonds shall be signed by the Mayor and shall be attested by the signature of the City Clerk, and the corporate seal of the City shall be affixed thereto. Each of said bonds shall have interest coupons attached, which coupons shall be in the form required by law and each thereof shall bear the lithographed facstmile signature of the Mayor and City Clerk of said city; and said bonds, with interest coupons attached, shall be registered in the Office of the City Clerk and in the Office of the State Auditor as required by law. Section 3. FORM OF BONDS . Said bonds are hereby designated as Series "PK -164," and shall be in the form and contain recitals substantially as follows, to wit: No. $1,000.00 UNITED STATES OF AMERICA STATE OF KANSAS COUNTY OF SALINE, CITY OF SALINA INTERNAL IMPROVEMENT BOND, SERIES " PK -164" KNOW ALL MEN BY THESE PRESENTS: That the City of Salina of the County of Saline, State of Kansas, acknowledges itself to be indebted for value received and hereby promises to pay the stm of ONE THOUSAND DOLLARS in lawful money of the United States of America, on the first day of , 19, with interest thereon from the date hereof at the rate ofOne & Fsve Eila cent (1 per annum, payable May 1, 1955, and semi-annually thereafter on the first days of each November and May in each year on presentation and surrender of the interest coupons hereto affixed, as said coupons severally become due, both principal and interest of this bond being payable at the Office of the State Treasurer of the State of Kansas in the city of Topeka, Kansas. Said City of Salina, Kansas, is held and firmly bound by these presents, and the full faith, credit, and resources of the said city are hereby irrevocably pledged for the payment of said principal and interest at maturity. This bond is one of a series of 275 bonds of like date and tenure, except number and maturity, aggregating the principal sum of $275,000.00 issued by the City of Salina , Kansas, for the purpose of paying the cost of acquiring land for public parks and develop- ing the same for such purpose, by authority of and in full compliance with the provisions, restrictions, and limitations of the laws of the State of Kansas, including Sections 10- 101 to 10-125, both inclusive, of the General Statutes of Kansas, 1949, and all amend- ments thereto and all other provisions of the laws of said state applicable thereto. This bond and all other bonds of this series and all interest thereon are to be paid by the City of Salina, Kansas. And it is hereby declared and certified that all acts, condijtions, and things required to be done and to exist precedent to and in the issuance of this bond have been properly done and performed and do exist in due and regular form and manner as required by the constitu- tion and laws of the State of Kansas; and that the total indebtedness of said city, in- ! cluding this series of bonds, does not exceed any constitutional or statutory limitation. The Board. of Commissioners of the City of Salina shall annu]ly make provisions for the payment of the principal and interest on said bonds as the same become due by levying taxes upon all property liable therefor within said city, as provided by law.
