AN ORDINANCE relating to and apportioning and levying special assessments on certain lots
and pieces of ground in the City of Salina, Kansas, to pay the cost of acquisition of land
for the use of the City of Salina, Kansas, in the widening of the south side of Cloud Street
frpap the west line of ninth street to the east line of U.S. Highway 81 By -Pass, the same
being more particularly described herein, and relating to and providing for the collection
and payment of such assessments.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That for the purpose of paying for the cost of acquiring by condem-
nation proceedings certain real estate for the use of the City of Salina, Kansas, in the
widening of the south side of Cloud Street from the west line of Ninth Street to the east
line of U.S. Highway 81 By -Pass, said property being more particularly described as follows,
to -wit:
Tract 3. Beginning at a point 20 feet south of the north line
of Section Twenty-six (26), Tswnship Fourteen (14) South, Range
Three (3) West of the 6th P.M. and 979 feet west of the east line of
said section, thence south a distance of 10 feet, thence west
a distance of 400 feet, thence north a distance of 10 feet, thence
east a distance of 400 feet to the point of beginning.
Tract 4. Beginning at a point 20 feet south of the north line
of Section Twenty-six (26), Township Fourteen (14) South, Range
Three (3) West of the 6th P.M. and 1413 feet west of the east
line of said section, thence south 10 feet, thence west a dis-
tance of 290.25 feet, thence northwesterly along the east
right/of/way line of U.S. 81 By -Pass a distance of 13.2 feet,
thence east a distance of 298.25 feet to the place of beginning.
as authorized by the irovision of Ordinances Numbered 5857 and 5862, according to the
EEEEappraised balue of such lots and pieces of ground without regard to the buildings or im-
provements thereon, special assessments covering the cost of the acquisition of such lands,
said special assessments being based on the special baluation and appraisement made by these
three disinterested appraisers appointed by the Judge of the District Court of Saline County,
Kansas, in Case No. 20393 in the District Court of Saline County, Kansas, which said ap-
praisal is hereby referred to and made a part of this Ordinance, and the several amounts
Ilevied, and apportioned against the lots and pieces of ground in said area found by the said
lappraisers to be benefited by the acquisition of the land aforesaid for the use stated, is
hereby found and determined to be as set forth in the following section of this Ordinance.
Section 2. That for the purpose of the payment of the cost of acquisition of the
above described land for the use of said City in the widening of the south side of Cloud
Street from the west line of Ninth Street to the east line of U.S. H#ghway 81 Bypass, the

Section 3. Said amounts levied, apportioned and assessed as aforesaid shall
be in due and collectible in one installment, becoming due with taxes levied for the year
1955, all to be collected with interest as in this Ordinance provided, provided however,
that the owner of any piece or parcel of property liable for any such assessment may reduce
his property from any such assessment liability by paying into the City Treasury the entire
amount chargeable against the same as in this Ordinance, and before the issuance of the
bonds of said City in payment of the cost of said improvements, and his property so paid
on shall not thereafter be liable for any further assessment for the cost of said improvements
nor for any part of said bonds.
Section 4. There is hereby levied and assessed further against said lots and
pieces of ground as described in this Ordinance, interest at such rate per annum as shall be
borne by the bonds hereafter to be issued for the payment of the remaining unpaid cost of
such improvements, such rate to be hereafter determined and fixed by Ordinance when such

bonds are issued, on all of said installments mentioned and provided for in this ordinance,
from the date of the bonds which may be issued at the end of thirty days, as specified in

!in the preceding section hereof as by law provided, to the time of collection of the last
;installment as provided by law, which said interest shall be collected annually at the same
!time and in the same amnner as said installments are collected, and after same the taking
effect of this ordinance and the fixing of the interest rate then such bonds ate authorized
and issued, it shall be the duty of the City Clerk of said City to annually at the same
time other taxes are certified, to certify to the County Clerk of Salina, Kansas, a full
list of all property liable to assessment and taxation for such work and imptovements, excelt

such property on which the special assessments aforesaid have been paid in full as hereinbeforj
provided, together with the respective amounts due on each of such lots and pieces of ground,
which amounts shall include the anntal installments of such special assessments together
with the interest at one year at the rate to be fixed and provided for in this ordinance be-
ing the rate borne by the bonds to be issued on all unpaid balances of such assessments and
such amounts so certified as herein provided shall be placed upon the tax roll and by the
County Clerk of Salina County, Kansas and collected as all other taxes are collected.
Section 5. That this ordinance shall be ineffect and force from and after
its publication once in the official city paper.
