5909 Authorize ContractORDINANCE NUMBER 5909 i (Published in the Salina Journal 11954) AN ORD334ANCE ratifying and confirming a contract with Brown & Brown, Inc., for the con- struction of certain curb and gutter and pairing and grading improvements on certain streets in the City of Salina, and providing for the issuance of temporary notes to pay the cost thereof pending the issuance and sale of bonds. BE IT ORDAINED By the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina, Kansas, of the proposal of the Brown & Brown Construction Co., Inc., hereinafter referred to as the "Contractor" as submitted to the Board of Commissioners on October 4, 1954, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said city to said contractor and signed on behalf of the City by its Mayor on October 11, 1954, for the construction of certain public improvements in the City of Salina, Kansas to -wit: Curbing, guttering and paving and grading with two-inch hot mixed asphaltic concrete over a six-inch rock stabilized base, 32 feet wide from face of curb to face of curb BIRCH DRIVE from the north line of Lot 9, Block 8 and the north line of Lot 23, Block 7, all in Replat of Edgemere Addition to the west line of Hemlock Drive by Ordinance Number 5896. Grading and paving with two-inch hot mixed asphaltic concrete over a six- inch rock stabilized base, HEMLOCK DRIVE, 28 feet toe of gutter to toe of J gutter from the north line of Lot 7, Block 9, Replat of Edgemere Addition to the south line of Redwood Drive by Ordinance Number 5896. publication once in the official city paper. a Curbing, guttering, and grading of Hemlock Drive from the north line of Lot 7, Block 9, Replat of Edgemere Addition to the center line of Redwood Drive, by Ordinance Number 5896• 9 P h at and for the unit price for said work contained in said proposal, which proposal and y d contract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said d improvements as shown by the sworn estimates of the City Engineer on file in the Office of the City Clerk, which estimates are hereby referred to and made a part of this Ordinance. Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefore prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract, all of which are hereby referred to and made parts of this ordinance. Section 3• That temporary notes signed by the Mayor and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required gg N by law, the total amount thereof not to exceed the contract price of $17,402.00, for such work, such notes to bear interest not to exceed 42 per cent per annum and to mature not later than December 1, 1955, and to be Issued in such amounts and at such time as money for thepayment of the cost of such notes being issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof.
