5905 Utility Imp - Stack PlORDINANCE NUMBER 5(905 �1 (Published in the Salina Journal (Xti �#-t } y_, -( ,1954) AN ORDINANCE creating and defining certain lateral sanitary sewer districts in the City of Salina, Kansas, designated as Lateral Sanitary Sewer Districts Numbered 307 and 3o8, and providing for the construction of a lateral sanitary sewer in each of said Lateral Sanitary Sewer Districts Numbered 307 and 308, so created, and providing for the payment of the cost thereof and for the levying of special assess- ments against the property in said districts for the payment of the cost of such construction and for the issuing of bonds to pay the cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. Lateral Sanitary Sewer District Number 307. That there be and there is hereby created lateral sanitary sewer district in the City of Salina, Kansas which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 307 and which district shall include all the following described property in the City of Salina, Kansas, to -wit: Benefit District: All of Block 8, Stack Place, on Addition to said city and that part of Lot 6, Surveyor's, Plat 7 in said city, described as follows: Beginning at the northeast corner of said Block 8, Stack Place thence east 142 feet, thence south to a point due east of the southeast corner of said Block 8, thence west to the southeast corner of said Block 8; thence north to the northeast corner of said Block 8, the point of beginning. Section 2. It is necessary and it is hereby ordered that an eight inch V. C. P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and R gg other appurtenances be constructed and built in and to serve said Lateral Sanitary Sew- er District Number 307 as created by Section 1 of this ordinance along the following lcourse, to -wit: An 8 inch clay pipe sewer beginning at an existing manhole 5 feet south of the north line of Stack Avenue on Center line of easement in Block 4, Stack Place extended; thence south easterly to a point 5 feet east of the northeast corner of Lot 1, Block 8, thence south along a line 5 feet east of the east line of Block 8 Stack Place to a point 5 feet south of the north line of Greeley Avenue where a manhole will be built, which will be terminus of Lateral 307. Section 3. Lateral Sanitary Sewer District Number 308. That there be and there is hereby created Lateral sanitary sewer district in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 308 and which district shall include all the following described property in the City of Salina, Kansas, to -wit: Benefit District. Lots 1 to 18 inclusive, all in Harper Addition to the City of Salina, Kansas. Section 4. It is necessary and it is herby ordered that an eight inch V. C. P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District Numberb 08 as created 3 y Section 3 of this ordinance along the following course, to -wit: An 8 inch clay pipe sewer beginning at an existing manhole in the center i line of Lewis Street and the center line of easement in Wymore Addition, thence south along the center line of Lewis Street 345.13 feet to the center line of easement in Harper Addition extended east; thence west along the center line of said easement in Harper Addition 565 feet where a manhole will be constructed which will be terminus of Lateral 308. i Section 5. That the City Cngineer shall on or before October 18th 1954, prepare and file in the office of the City Clerk, plans and specifications for the construction of the lateral sanitary sewer provided for in the preceeding sections of this iordinance which shall be of the proper character to serve the property lying within the district which such sewer is to be constructed and shall on or before the same date prepare and submit to the Board of Commissioners a detailed estimate under oath of the cost thereof. That thereafter the City Clerk shall advertise for these consectutive days in the official 3 i city paper for sealed proposals for the building and construction of such sewer according j to such plans and specification, which proposals shall be filed with the City Clerk on or I before the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such sewer to the lowest and best responsible bidder or bidders therefore, if there be any whose bids do not exceed the estimated cost thereof, but said Board shall reserve the right to reject any or all such proposals, and if no bids shall be received within such estimate, the Board of Commissioners shall have the power to do such work and make such improvements within the estimated cost thereof as provided by law. Section b. That for the cost of building and construction of such sewer, special assessments shall be made for the full cost therof on all lots and pieces of land within and for which such sewer shall be built, according to the appriased :Value thereof, without 0 regard to the buildings or improvements thereon. Section 7. after the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterest appraisers, who after having taken an oath to make a true and impartial appraisement of all lots and pieces of land liable to taxation for the cost of such improvements, shall within five days after having beeennotified of theft appointments proceed to appraise all of the lots and pieces of land within the idstrict liable to assess - went and taxation as aforesaid, without regard to the building or improvements theron, and after making such appraisements, shall return to the Board of Commissioners of said city and said Board shall designate a time for a special meeting of said Board for the purpose of hear- ing any complaints that may be made as to the balue of any lot or piece of land appraised as aforesaid, of which special session due notice shall be given in the official city paper, at which special session said Board may alter any Valuation of any lot or piece of land, if, in their opinion, the same has bben appraised too high or too low. Section 8. The special assessment herein prodded for may be paid by the person liable therefore in four approximately equal annual installments but the owner of any property liable to such assessment may within thirty days from the date of determining the amount assessed against the property, pay the same in full and his property shall not be liable for any assessments for the cost of such improvements, and bonds as hereinafter provided for shall be issued in the amount of the cost of such improvements remaining unpaid at the end of the thirty days from the time such assessment is fixed. Section 9. For the purpose of paying for the work and improvements in this ordinance provided for, the Board of Commissioners may and are hereby authorized and directed to 11 1 1 issue improvement bonds of the City of Salina, Kansas, in an amount not to exceed the total cost of such improvement, and to run for a period of four years and be payable in four approximately equal annual installments, together with interest not to exceed the total cost of such improvements, and to run for a period of four years and be payable in four approximately equal annual installments, together with interest not to exceed five per cent per annum, which bonds shall be issued and payable according to law; and for the purpose of paying the principal and interest on said bonds as they severally become due and payable the Board of Commissioners shall apportion and eeeess againstthe lgts and pieces of land within the taxing district of such improvements, special assessments cover- ing the cost of such improvement that are to be collected from the specific property chargeable therefore, and with such improvements; such assessment and apportionment ordin- ance shall contain the total amount of tax apportioned to each such tact, piece or parcel of land within the taxing district and shall state the number of anneal installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time that other taxes are certified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable for such work and improvement, together with the respective amounts due on each of said tracts, pieces or parcels of land, which amounts shall include the annual installment and interest on all unpaid balances for one year at the rate of not to exceed five per cent per annum on such amounts so certified, which amounts shall 'be collected as other taxes are collected. Section 10. This ordinance shall take effect and be in force from and after its publication once in the official city paper.
