AN ORDINANCE relating to and apportioning and levying special assessments on certain
lots and pieces of ground in the City of Salina, Kansas,to pay the cost of acquisi-
tion of land for the use of the City of Salina, Kansas, for the opening and extend-
ing of Ohio Street south to its interesection with the north line of Cloud Street,
the same beingmore particularly described herein, and relating to and providing for
the collection and payment of such assessments.
BE IT ORDAINED by the Board of Commissioners of the City of Salina., Kansas:

Section 1. That for the purpose of paying for the cost of acquiring by
condemnation proceedings certain real estate for the use of the City of Salina,
Kansas, for the opening and extending of Ohio Street south to its intersection with
the north line of Cloud Street, said property being more particularly described
as follows, to -wit:

Tract 1. A tract of land in the North 2 (N2) of the south-
west Quarter of Section Nineteen, Township Fourteen South,
Range Two West of the Sixth Principal Meridian, in Saline
County, Kansas, described as follows: Beginning at a point
662 feet, more or less, south of the Northwest corner of
said Southwest Quarter of Section 19, Thence east 50 feet,
thence south to the south line of the North Half of the
Southwest Quarter of said Section 19, thence west 50 feet
s to the west line of said Quarter Section, thence north along
said west line to the place of beginning.
} Tract 2. The West Fifty Feet of the West Half of the North
Half of the North Half of the Southwest Quarter of the South-
west Quarter of Section Nineteen, Township Fourteen South,
Range Two West of the Sixth Principal Meridian in Saline
County, Kansas.

Tract 3. The East Fifty Feet of the North Half of the North
Half of the Southeast Quarter of the Southeast Quarter of
Section Twenty Four, Township Fourteen South, Range Three West
of the Sixth Principal Meridian in Saline County, Kansas.
Tract 4. The West Fifty feet of the South Half of the Northwest
Quarter of the Southwest Quarter of the Southwest Quarter of
Section Nineteen, Township Fourteen, South, Range Two West of
the Sixth Principal Meridain in Saline County, Kansas.
Tract 5. The East Fifty Feet of the South Half of the North
Half of the Southeast Quarter .of the Southeast Quarter of
Section Twenty Four, Township Fourteen South, Range Three west
of the Sixth Principal Meridian in Saline County, Kansas.

Tract 6. The east Fifty feet of the East Four acres of the
South Half of the Southeast Quarter of the Southeast Quarter
of Section Twenty -Four, Township Fourteen South, Range Three
West of the Sixth Principal Meridian in Saline County, Kansas.
Tract 7. The west Fifty feet of the South Half of the Southwest
Quarter of the Southwest Quarter of Section Nineteen, Township
Fourteen South, Range Two West of the Sixth Principal Meridian
in Saline County, Kansas.
as authorized by the provisions of Ordinances Numbered 5855 and 5861, according
to the appraised value of such lots and pieces of ground without regard to the
buildings or improvements thereon, special assessments covering the cost of the
acquisition of such land, said special assessments being based on the special
valuation and appraisement made by three disinterested Commissioners appointed by
the Judge of the District Court of Saline County, Kansas, in Case Number 20314 in
the District Court of Saline County, Kansas, which said appraisal is hereby
referred to and made a part of this ordinance, the several amounts levied, and
apportioned against the lots and pieces of ground in said area found by the said
Commissioners to be benefited by the acquisition of the land aforesaid for the
opening and extending of Ohio Street south to its intersection with the north
line of Cloud Street, the amount levied, apportioned and assessed against the
lots and pieces of ground which the said Commissioners have determined to be
benefited by the said street development are found and determined to be as
follows, to -wit:
Tract 1. A tract of land in the North Half of the Southwest
Quarter of Section Nineteen, Township Fourteen South, Range
Two West of the Sixth Principal Meridian in Saline County,
Kansas, described as follow: Beginning at a point 662 feet,
more or less, South and 50 feet east of the Northwest corner
of said Southwest Quarter of Section Nineteen, Thence east
200 feet, thence south to the south line of the North Half
of the Southwest Quarter of said Section Nineteen, thence
West 200 feet to the east line of Ohio Street extended,thence
north along said line to the place of beginning.

Section 3. Said amounts levied, appottioned and assessed as aforesaid shall
be due and collectible in one installment, becoming due with taxes levied for the
year 1955, all to be collected with interest as in this Ordinance provided, provided
however, that the owner of any piece or parcel of property liable for any such
assessment may redeem his property from any such assessment liability by paying
into the City Treasury the entire amount chargeable against the same as in this
Ordinance designated at any time within Thirty days from the publication of this
Ordinance, and before the issuance of Ahe bonds of said City in payment of the
cost of said improvements, and his property so paid on shall not thereafter be
liable for any further assessment for the cost of said improvements nor for any
paf"t of said bonds.
Section 4. There is hereby levied and assessed further against said lots
and pieces of ground as described in this Ordinance, interest at such rate per
annum as shall be borne by the bonds hereafter to be issued for the payment of
the remaining unpaid cost of such improvements, such rate to be hereafter deter-
mined and fixed by Ordinance when such bonds are issued, on all of said install-
ments mentioned and provided for in this ordinance, from the date of the bonds
which may be issued at the end of thirty days, as specified in the preceding
section hereof as by law provided, to the time of collection of the last install-
ment as provided by law, which said interest shall be collected annually at the
same time and in the same manner as said installments are collected, and after
the taking effect of this ordinance and the fixing of the interest rate when
such bonds are authorized and issued, it shall be the duty of the City Clerk of
said City to annually at the same time other taxes are certified, to certify to
the County Clerk of Saline County, Kansas, a full list of all property liable to
assessment and taxation for such work and improvements, except such property on

which the special assessments aforesaid have been paid in full as hereinbefore
provided, together with the respective amounts due on each of such lots and pieces
of ground, which amounts shall include the annual installments of such special
assessments together with the interest at one year at the rate to be fixed and
provided for in this ordinance being the rate borne by the bonds to be issued
on all unpaid balances of such assessments and such amounts so certified as herein
provided shall be placed upon the tax roll and by the County Clerk of Saline
County, Kansas, and collected as all other taxes are collected.
Section 5. That this ordinance shall be in effect and force from and
after its publication once in the official city paper.
