5899 Levy AssessmentsORDINANCE NLWER 5899 (Published in the Salina Journal. ` , �r,�t-r' , 1954) AN ORDINANCE relating to and apportioning and levying special assessments on certain lots and pieces of ground in the City of Salina, Kansas, to pay the cost of acquisi- tion of land for the use of the City of Salina, Kansas, for the opening and extend- ing of Franklin Street from the west line of Southern Heights Addition to the City of Salina, Kansas, to the -east line of Sunset Manor Addition to the City of Salina, Kansas, the same being more particularly described herein, and relating to and pro- viding for the collection and payment of such assessments. i BE IT ORDAIM by the Board of Commissioners of the City of Salina, Kansas: Section 1. That for the purpose of paying for the cost of acquiring by con- demnation proceedings certain real estate for the use of the City of Salina, Kansas, for the opening and extending of Franklin Avenue from the west line of Southern Heights Addition to the City of Salina, Kansas, to the east line of Sunset Manor Addition to the City of Salina, Kansas, said property being more particularly described as follows; to -wit: Part of the North Half (P-21) of Section Twenty Three (23) Township Fourteen (14), Range Three (3), West of the 6th P. M. in Saline County, Kansas, described as: Beginning at a point which is the southeast corner of Lot 1, Block 2, in Sunset Manor Addition to the City of Salina, Kansas, thence east a distance of 216 feet to the southwest corner of Lot 8, Block 15, Southern Heights Addition to the City of Salina, Kansas, thence west a distance of 216 feet to the northeast corner of Lot 19, Block 1, Sunset Manor Addition to the City of Salina, Kansas, thence north a distance of 60 feet to the place of beginning; as authorized by the provision of Ordinances Number 5852 and 5858, according to 1 the appraised value of such lots and pieces of ground without regard to the build- ings or improvements thereon, special assessments covering the cost of the acquisition I of such land, said special assessments being based on the special valuation and i appraisement made by three disinterested Commissioners appointed by the Judge of i the District Court of Saline County, Kansas, in Case N=ber 20315 in the District Court of Saline County, Kansas, which said appraisal is hereby referred to and made j a part of this ordinance, and the several amounts levied, and apportioned against i I the lots and pieces of ground in said area found by the said Commissioners to be benefited by the acquisition of the land aforesaid for the use stated, hereby found I and determined to be as set forth in the following section of this Ordinance. Section 2. Said amounts levied, apportioned, and assessed as aforesaid shall be due and collectible in one equal installment, becoming due with taxes levied for the year 1955, all to be collected with interest as in this Ordinance provided, provided, however, that the owner of any piece or parcel of property liable for any such assessment may redesn his property from any such assessment liability by paying into the City Treasury the entire amount chargeable against the same as in this Ordinance designated at any time within Thirty (30) days from the publication of this Ordinance, and before the issuance of the bonds of said city in payment of the cost of said improvements, and his property so paid on shall not thereafter be liable for any furhher assessmnet for the cost of said improvements nor for any part of said bonds. Section 4. There is hereby levied and assessed further against said lots Fand pieces of ground as described in this ordinace, interest at such rate pdr annum as shall be borne by the bonds hereafter to be issued for the payment of the a remaining unpaid cost of such improvements, such rate to be hereafter determined 1 i and fixed by ordinance when such bonds are issued, on all of said installments i imentioned and provided for in this ordinance, from iihe date of the bonds which may be issued at the end of thirty days as specified in the preceding section hereof as by law provided, to the time of collection of the last installment as provided by law, which sadd interest shall be collected annually at the same time and in the same manner as said installments are collected, and after the taking effect of i this ordinance and the fixing of the interest rate when such bonds are authorized and issued, it shall be the duty of the City Clerk of said city to annually at the j same time other taxes are certified, to certify to the County Clerk of Saline County, Kansas, a full list of all property liable to assessment and taxation for such work and improvements except such p property on which the special assessments aforesiad have been paid in full as hereinbefore provided, together with the respective amounts due on each of such lots and pieces of ground, which amounts I G shall include the annual installment of such special assessmnent together with the interest at the rate to be fixed and provided for in this ordinance being the d rate borne by the bonds to be issued on all unpaid balances of such assessments i and such amounts so certified as herein provided shall be placed upon the tax roll ggk P by the County Clerk of Saline County, Kansas, and collected as all other taxes are collected. i I Section 5.
