AN ORDINANCE relating to and apportioning and levying special assessments on certain
lots and pieces of ground in the City of Salina, Kansas, to pay the cost of paving
and grading of Frost Street from the east line of Sherman Street to the east line of
Eleventh Street; for the paving and grading of Sunrise Drive from the north line of
Wilson Street to the south line of McAdams Road; for the paving and grading of Sunrise
Drive from the north line of Ybraingside Drive to the north line of Republic Avenue;
and for the paving and grading of Washington Street from the west line of Twelfth
Street to the nest line of Phillips Street, and relating to and providing for the
collection and payment of such assessments.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. For the purpose of paying for that part of the cost of inroovements in
certain portions of certain streets as hereinafter set forth in the following sections
of this ordinance which is chargeable to the private property in the assessment
districts for each of such improvements, respectively, as set forth in the following
sections of this ordinance with respect to each of such improvements, there are hereby
levied and assessed on the property liable therefor, being all the lots and pieces of
ground lying on either side of said street so improved, respectively, to the middle
! of the block for the distance improved, with respect to the improvements mentioned in

Sections 2, 31 4 and 5 of this ordinance, according to the appraised value of such

lots and pieces of ground with respect to each such improvement, without regard to
the buildings or improvements thereon, special assessments covering the cost of such
work and improvements, said special assessments being based on the special valuation
made
and appraisement of said lots and pieces of ground heretofore/by three disinterested
appraisers appointed by the Board of Commissioners of the City of Salina, Kansas, with
respect to each such improvement, which said appraisements are hereby referred to and
made parts of this ordinance, and the several amounts so levied) apportioned and
assessed against the lots and pieces of ground for each such improvements, respectively,
for the
purpose aforesaid, are hereby found and determined to be the amounts set forth

in the following sections of this ordinance with respect to each of said improvements.
Section 2. For that part of the cost of paving and grading Frost Street from the
east line of Sherman Street to the east line of Eleventh Street, which is chargeable
against the private property within the district chargeable therefor, and which cost is

hereby determined to be $4,828.43, there is hereby levied, apportioned and assessed

Section 6. Said amounts so levied, apportioned and assessed as aforesaid will
be due and collectible in ten equal installments, the first becoming due with the lamas

taxes levied for the year 1955, and one of said installments falling due each and every
year thereafter until all are paid and all to be collected with interest as in this
i
ordinance provided, PROVIDED, HOWEM, that the owner of any pieces of property liable
i for an such assessment may redeem his
Y y property from such liability by paying into the
i
City Treasury the entire amount chargeable against the same, as in this ordinance pro-
vided at any time within thirty days after the publication of this ordinance and before
the issuance of bonds of said city in payment of the balance of the cost of said improve -
I
ments, the property so paid on shall not thereafter be liable for any further assess-
ments for the cost of said improvements nor for any part of said bonds.
Section 7. X There is hereby levied further and assessed against such lots and
pieces of ground described in this ordinance, interest at such rate per annum as shall

j be borne by the bonds hereafter to be issued for the payment of the remaining unpaid
cost of such improvements, to be hereafter determined and fixed by ordinance when such
bonds are issued, on all of said installments mentioned and provided for in this ordi-

nance, from the date of the bonds which may be issued at the end of thirty days as
specified in the preceding sections hereof, as by law provided.. to the time of the
collection of the installment as provided by law, which said interest shall be
collected annually at the same time and in the same manner as said instal n are
collected and after the taking effect of this ordinance and the fixing of the said
interest rate when such bonds are authorized and issued, it shall be the duty of the
City Clerk of said City to annually at the same time other taxes are certified and
until all of said assessments so apportioned and levied have been certified to the
County Clerk of Saline County, Kansas, a full list of all property liable to assess-
ment and taxation for such wo$k and improvement, except such property on which the
special assikssments aforesaid have been paid in full as i hereinbefore yep pro-
vided, together with the respective amounts due on each of said lots and pieces of
ground which amounts shall include the annual installments of such special assessments
together with the interest for one year at the rate to be fixed as provided for in
this ordinance, on all unpaid balances of such assessments, and such amounts so
certified as herein provided shall be placed upon the tax roll by the County Clerk of
Saline County, Kansas, and collected as other taxes are collected.
Section 8. This ordinance shall take effect and be in force from and after its
publication once in the official city paper.
