wide from toe of gutter to toe of gutter) Charles Street from the west line of Eleventh
Street to the east .line of Twelfth Street; paving and grading with two (2) inch hot asphalt
mix over a six (61W� k base (twenty-eight (28) feet from toe of gutter to toe of gutter)
Claflin Avenue from the east line of Roach to the west line of Lewis; paving and grading
with two-(2T—inch hot asphalt mix over a six (6) inch crushed rock 'base (twenty-eight (28)
feet wide from toe of gutter to toe of gutter) Fairview Street from the east line of SHerman
Street to the west line of Eleventh Street; Pairing and grading with two (2) inch hot asphalt
mix over a six (6) inch crushed rock base (twenty-eight (28) feet wide from toe of gutter to
toe of gutter) Illinois Street from the east line of Merrill Street to the east line of
Hancock Street; paving and grading with two (2) inch hot asphalt mix over a six (6) inch

AUpper Mill Heights from Greeley Avenue to Greeley Avenue; curbing, guttering,
paving and grading with two 2) inch hot asphalt mix over a six (6) inch crushed rock base
(thirty-three (33) feet back of curb to back of curb) Willow Drive from a line on the south
line of Willow Court extended across Willow Drive to a line crossing; Willow Drive from the
south east corner of Lot 45 Block 6 Edgemere Addition to the south west corner of Lot 13,
Block 5 Edd-eme-re Addition; and relating to and providing for the collection and payment of
such assessments.
BE IT ORDAINED by the Board of Cor,mdssioners of the City of Salina, Kansas:
Section 1. For the purpose of paying for that part of the cost of improvements in
certain portions of certain streets as hereinafter set forth in the following section of'this
ordinance which is chargeable to the private property in the assessment district for such
improvements as set forth in the following sections of this ordinance with respect to such
improvements there are hereby levied, and assessed on the property liable therefor, being
all the lots and pieces of ground lying on either side of said street so improved, to the
middle of the block for the distance improved, with respect to the improvements mentioned
in Section_ 2 and 3/of5th& 80PL*nance, according to the appraised value of such lots and
pieces of ground with respect to such improvements, without regard to the buildings or
improvements thereon, special assessments covering the cost of such work and improvements,
said special assessments being based on the special valuation and appraisement of said lots
and pieces of ground heretofore made by three disinterested appraisers appointed by the Board
of Commissioners of the City of Salina., Kansas, with respect to such improvements, which said
appraisement is hereby referred to and made a part of this ordinance, and the several amounts
so levied, apportioned and assessed against the lots and pieces of ground for such improve-
ment, for the purpose aforesaid, are hereby found and determined to be the amounts set forth
in the following sections of this ordinance with respect to each of said improvements.
Section 2. For that part of the cost of pavirng-gnd grading with two-inch hot mixed

Section 9. For that part of the cost of curbing, guttering, paving and grading with
tow -inch hot mixed asphaltic concrete over a six-inch rock stabilized base, (thirty-three
(33) feet back of curb to back of curb) Willow Drive from a line on the south line of
Willow Court extended across Willow Drive to a line crossing Willow Drive from the south
east corner of Lot 45 Block 6 Edgemere Addition to the south west corner of Lot 13, Block
5 Edgemere Addition, which is chargeable against the private property within the district
chargeable therefor, and which cost is hereby determined to be $20,064.62, there is hereby

Section 10. Said amounts so levied, apportioned and assessed as aforesaid shall be due
and collectible in ten equal installments, the first becoming due with the taxes levied for
the year 1956, and one of said installments falling due each and every year thereafter until
all are paid, and all to be collected with interest as in this ordinance provided, however,
that the owner of any piece or pieces of property liable for any such assessment may redeem
his property from such liability by paying into the City Treasury the entire amount charge-
able against the same, as in this ordinance designated, at any time within thirty days after
the publication of this ordinance and before the issuance of bonds of said city in payment of
the balance of the cost of said improvements, the property so paid on shall not thereafter
be liable for any further assessments for the cost of said improvements nor for any part of
said bonds.
Section 11. There is hereby levied further and assessed against such lots and pieces of
ground described in this ordinance, interest at such rate per annum as shall be borne by the
bonds hereafter to be issued for the payment of the remaining unpaid cost of such improve-
ments, to be hereafter determined and fixed by ordinance when such bonds are issued, on all
of said installments mentioned and provided for in this ordinance, from the date of the bonds
which may be issued at the end of thirty days as specified in the preceding sections hereof,
as by law provided, to the time of the collection of the installment as provided by law,
which said interest shall be collected annually at the same time and in the same manner as
said installments are collected and after the taking effect of this ordinance and the fixing
of the said interest rate when such bonds are authorized and issued, it shall be the duty of
the City Clerk of said City to annually at the same time other taxes are certified and until
all of said assessments so apportioned and levied have been certified to the County Clerk of
Salina County, Kansas, a full list of all property liable to assessment and taxation for such
work and improvement except such property on which the special assessments aforesaid have been
paid in full as hereinbefore provided, together with the respective amounts due on each of
such lots and pieces of ground which amounts shall include the annual installments of such
special assessments together with the Interest for one year at the rate to be fixed as pro-
vided for in this ordinance, on all unpaid balances of such assessments, and such amounts so
certified as herein provided shall be placed upon the tax roll by the County Clerk of Saline
County, Kansas, and collected as other taxes are collected.
Section 12. This ordinance shall take effect and be in force from and after its adoption
and publication once in the official city paper.
