6055 Authorize Contract61 1 1 CCLYNA ORDINANCE NUMBER 6055 (Published in The Salina Journal qo L- j 97 1956) AN ORDINANCE ratifying and confirming a contract with Brown & Brown, Inc. for the construction of certain paving and grading improvements on certain streets in the City of Salina, Kansas, and providing for the issuance of temporary notes to pay the cost thereof pending the issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina, Kansas, of the proposal of the Brown & Brown Construction Co. Inc. hereinafter referred to as the "Contractor` as submitted to the Board of Commissioners on April 17, 1956, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said City (to said contractor and signed on behalf of the City by its Mayor on April 24, 1956, for the construction of certain public improvements in the City of Salina, Kansas, to -wit: Paving and grading of Brown Street (twenty-eight (28) feet wide toe of gutter to toe of gutter) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the east line of Sherman Street to the west line of Eleventh Street, as provided for by Resolution Number 1609 and Ordinance Number 6048. Paving and grading of Claflin Avenue, (thirty six (36) feet wide from toe of gutter to toe of gutter) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the west line of Lewis Avenue to the west line of Ohio Street, as provided for by Resolution Number 1606 and Ordinance Number 6048. Paving and grading of Lewis Avenue (twenty-eight (28) feet wide from toe of gutter to toe of gutter) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the south line of Kirwin Avenue to the north line of Claflin Avenue, as provided for by Resolu- tion Number 1620 and Ordinance Number 6048. Paving and grading of Lewis Avenue (twenty-eight (28) feet wide toe of gutter totoe of gutter) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the north line of Republic Avenue to the south line of Martin Avenue, as provided for by Resolu- tion Number 1626 and Ordinance Number 6048. Paving and grading of Martin Avenue (twenty-eight (28) feet wide from toe of gutter to toe of gutter) with two (2) inch hot asphalt mix over a six (�) inch crushed rock base, from the east line of Roach Street to the east line of Pearl Avenue, as provided for by Resolution Number 1608 and Ordinance Number 6048. Paving and grading of Martin Avenue with two (2) inch hot asphalt mix over six inch crushed rock base, from the east line of Pearl Street to the east line of Lewis Avenue, as provided for by Resolution Number 1614 and Ordinance Number 6048. Paving and grading of Martin Avenue (twenty-eight (28) feet wide from toe of gutter to toe of gutter) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the west side of Lewis Avenue to the east line of Beatrice Avenue, as provided for by Resolution Number 1638 and Ordinance Number 6048. 1 n C� Curbing, guttering paving and grading of Prescott Avenue (thirty-three (33) feet wide back of curb to back of curb) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the east line of Fourth Street to the west line of Front Street, as provided for by Resolution Number 1613 and Ordinance Number 6048. Curbing, guttering, paving and grading of 'Russell Avenue (thirty-one (31) feet wide from back of curb to back of curb) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the east line of Roach Street to the west line of Lewis Avenue, as provided for by Resolution Number 1621 and Ordinance Number 6048. Curbing, guttering, paving and grading of Willow Court with two (2) inch hot asphalt mix over a six inch crushed rock base, from the west line of Redwood Drive to the west end of Willow Court, as provided for by Resolution Number 1604 and Ordinance Number 6048. Curbing, guttering and grading of Claflin Avenue from the east line of Lot 5, Block 1, Countryside addition to the west line of Ohio Street, as provided for by Resolution Number 1607 and Ordinance Number 6048. Resurfacing of Ninth Street with two-inch hot mixed asphaltic concrete from the south line of Ash Street to the south line of South Street, as provided for by Resolution Number 1651 and Ordinance Number 6048. Resurfacing of Ninth Street with two-inch hot mixed asphaltic concrete from the north line of Republic Avenue to the north line of Crawford Avenue, as provided for by Resolution Number 1650 and Ordinance Number 6048. Resurfacing of Iron Avenue with two-inch hot mixed asphaltic concrete from the east line of College Avenue to the west line of Ninth Street, as provided for by Resolution Number 1649 and Ordinance Number 6048. at and for the unit price for said work contained in said proposal, which proposal and con- tract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer on file in the Office of the City Clerk, which estimates are hereby referred to and made a part of this ordinance. Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefore prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said con- tract, all of which are hereby referred to and made parts of this ordinance. Section 3. That temporary notes signed by the Mayor and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the amount of $115,357.00, for such work, such notes to bear interest not to exceed 42 per cent per annum and to mature not later than December 1, 1957, and to be issued in such amounts and at such time as money for the payment CONI -,f I TE:A L INA ,6f the cost of such notes being issued to said contractor and to be redeemed and cancelled at I the time that pe rmanent bonds are issued in lieu thereof.
