6053 Authorize ContractORDINANCE ratifying and confirming a contract with the H. J. Taylor Construction Company for the consturction of certain curbing, guttering and grading improvements on certain streets in the city of Salina, Kansas, and providing for the issuance of temporary notes to pay the cost thereof pending the issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina, Kansas, of the proposal of the H. J. Taylor Construction Company, hereinafter referred to as the `Contractor" as submitted to the Board of Commissioners on April 17, 1956, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said city to said contractor and signed on behalf of the City of Salina, Kansas, by the Mayor on April 24, 1956, for the construction of certain public improvements in the City of Salina, Kansas to -wit: ! Curbing, Guttering and Grading of Lewis Avenue on the west side i from the center line of Russell Avenue to the center line of Cloud Street; and the curbing, guttering and grading of Lewis Avenue on the east side from a point 150 feet south of j the south line of Russell Avenue to the center line of Cloud Street, as provided for by Resolution Number 1631 and Ordinance Number 6046 Curbing, guttering and grading of Roach Street from the center line of Mellinger Drive to the center line of Manor Road, as provided for by Resolution Number 1629 and Ordi- nance Number 6046. Curbing, guttering and grading of the east side of Roach Street from the center line of Claflin Avenue to the center line of Cloud Street, as provided for by Resolution Number 1630 and Ordinance Number 6046. Curbing, guttering and grading of the East side of South Broadway Boulevard, from the north line of Armory Road north feet, as provided for by Resolution Number 1646 and Ordi- nance Number 6046. Curbing, guttering and grading of the West side of Ohio Street from the center line of Kirwin Avenue to the center line of Jewell Avenue, as provided for by Resolution Number 1648 and Ordinance Number 6046. at and for the unit price for said work contained in said proposal, which proposal and con- tract are hereby referred to and made a part of this ordinance, be and the same is ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer on file in the office of the City Clerk, which estimates are hereby referred to and made a part of this ordinance. Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefore prepared by the City Engineer on file in the Office of the City Clerk and in accordance with the proposal of said contractor and under the terms of the said contract, all of which are hereby referred to and made parts of this ordinance. 1 1 Section 3. That temporary notes signed by the Mayor and attested by the signature of ;he City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the amount of $92,977.50 for such cork, such notes to bear interest not to exceed 4z per cent per annum and to mature not later ;hen December 1, 1957, and to be issued in such amounts and at such time as money for the )40nent of the cost of such notes to be issued to said contractor and to be redeemed and ancelled at the time that permanent bonds are issued in lieu thereof.
