6052 Smoky Hill River Boating1 1 1 y _ - ORDINANCE NUMBER 6052 (Published in the Salina Journal /4j2j--j�j g�3 , 1956) AN ORDINANCE providing for the regulating, equipping and operation of boats, and prohibiting swimming in the Smoky Hill River within the City Limits of Salina, Kansas, and providing penalties for the violation thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1.- 18-1139 That from and after the passage of this Ordinance the use and operation of motor boats, row boats, canoes, kayaks, and all other water vehicles in and upon the Smoky Hill River within the City Limits of Salina,. Kansas, shall be governed by i the following rules and regulations: 1. It shall be unlawful for any person to operate any type of a boat while under the influence of intoxicating beverage, or for any person or persons to operate a boat in such a manner as to indicate a willful or wanton disregard for the safety of persons or pro- perty 2. No boat shall be driven at a speed greater than is reasonable and prudent under the conditions then existing. 3. No person shall operate a boat within 300 feet of the dam. 4. All boats while in use must be seaworthy, well constructed, and manageable. 5. No boat shall carry more than the maximum safe capacity of the boat. 6. All boats sixteen feet or over in length must be provided with fire extinguishers. 7. All boats when in use must be equipped with sufficient and adequate life preserver for each boat occupant. 8. All motor boats must be provided with stork factory mufflers or under -water exhaust or other modern device to prevent excessive or unusual noises. 9. All boats operated between sunset and sunrise must be equipped with a light, lantern or flashlight exhibiting a white light which shall be visible from a distance of at least 300 -feet. 10. All boats when not in use or docked must be properly and securely anchored. 11. All boats submerged or unattended on or in the Smoky Hill River within the City Limits of Salina, Kansas, are declared a nuisance, and dangerous to public health and are by the City declared contra- band and shall be sold at public auction after ten days published notice in the official city paper. Section 2. It shall be unlawful for any person to swim or bathe in the Smoky Hill River within the City Limits of Salina, Kansas. Section 3. Any person or persons violating any of the provisions of this Ordinance, shall upon conviction thereof, be punished by a fine not exceeding One Hundred Dollars, or by confinement to the City Jail not exceeding thirty days, or by both such fine and imprison- ment Section 4. In the event any part or parts of this Ordinance shall be determined to be invalid, such determination of invalidity shall not affect any other portion of this Ordinance. Section 5.
