IW�AS, by Resolutions Numbered 1619, 10;39, 1627, 1600, 1615, 1610, 1605, 1611, 1612, 1618, ;and 1628 duly adopted on November 1, 1955; November 29, 1955; November 22, 1955; September 27, .1955; October 251. 1955; October 18, 1955; by the Board of Commissioners of the City of Salina, Kansas., have declared that they deem it necessary to pave and grade Delathre-Avenue (twenty- ght (28) feet wide from toe of gutter to toe of gutter) with concrete from the south line of Iron Avenue to the south line of Stapler Avenue; Pave and Grade Eleventh Street (twenty- eight (28) feet wide toe of gutter to toe of gutter) with concrete from the nort line of Lincoln Avenue to the South line of Grand Avenue; Pave and Grade Haven Avenue, (twenty-eight (28) feet wide toe of gutter to toe of gutter) with concrete, from the east line of Duvall Avenue to the west line of Steahlin Avenue; Pave and Grade Johnstown Avenue, (twenty-eight (28) feet from toe of gutter to toe of gutter) with concrete, from the east line of Columbia venue to the east line of Kansas Avenue; Pave and Grade Lincoln Avenue, (twenty-eight (28) eet wide from toe of gutter to toe of gutter) with concrete, from the west line of Twelfth Street to the east line of Thirteenth Street; Pave and Grade McAdams Road, (twenty-eight (28) Meet wide from toe of gutter to toe of gutter) with concrete from the east line of Roach Street o the west line of Pearl Street; Pave and Grade Roach Street, (twenty-eight (28) feet wide from toe of gutter to toe of gutter) with concrete from the north line of Martin Avenue to the south line of Republic Avenue; Curb, Gutter, Pave and Grade Second Street (thirty-three (33) feet back of curb to back of curb, with concrete, from the north lineof Crawford to th south line of Prescott Avenue; Curb, Gutter, Pave and Grade Eighth Street, (thirty-three (33) eet back of curb to back of curb) with concrete from the north line of Lincoln Avenue to the south line of Decatur Avenue; Pave and Grade Viemont Avenue (twenty-eight (28) feet wide from toe of gutter to toe of gutter) with concrete, from the south line of Haven Avenue to the south line of Beverly Drive; Curb and Gutter South Side of Haven Avenue from the center line f Duvall Avenue to the center line of Steahlin Avenue. That it is necessary and it is hereby ordered that Delaware Avenue, from the south line of Iron Avenue to the south line of Stapler Avenue, be paved and graded with concrete twenty eight (28) feet wide from toe of gutter to toe of gutter, with excavation thereof, and graded to the established paving grade and paved between the guttering lines thereof. Section 2. That it is necessary and it is hereby ordered that Eleventh Street, from the north line of Lincoln Avenue to the South line of Grand Avenue, be paved and graded with concrete twenty-eight (28) feet wide from toe of gutter to toe of gutter, wittE excavation thereof, and graded to the established paving grade and paved between the guttering lines thereof. Section 3. That it is necessary and it is hereby ordered that Haven Avenue, from the east line of Duvall Avenue to the west line of Steahlin Avenue, be paved and graded with concrete twenty-eight (28) feet wide from toe of gutter to toe of gutter, with excavation thereof, and graded to the established paving grade and paved between the guttering lines thereof. Section 4. That it is necessary and it is hereby ordered that Johnstown Avenue, from the east line of Columbia Avenue to the east line of Kansas Avenue, be paved and graded with concrete twenty-eight (28) feet wide from toe of gutter to toe of gutter, with excavation thereof, and graded to the established paving grade and paved between the guttering lines thereof. Section 5. That it is necessary and it is hereby ordered that Lincoln Avenue, from the west line of Twelfth Street to the east line of ThUrteenth Street, be paved and graded with concrete twenty-eight (28) feet wide from toe of gutter to toe of gutter, with excavation thereof, and graded to the established paving grade and paved between the guttering lines thereof. Section 6. That it is necessary and it is hereby ordered that McAdams Road, from the east line of Roach Street to the west line of Pearl Street, be paved and graded with concrete twenty-eight (28) feet wide from toe of gutter to toe of gutter, with excavation thereof, and graded to the established paving grade and paved between the guttering lines thereof. Section 7. That it is necessary and it is hereby ordered that Roach Street, from the north line of Martin Avenue to the south line of Bepublic Avenue, be paved and graded with concrete twenty-eight (28) feet wide from toe of gutter to toe of gutter, with excavation thereof, and graded to the established paving grade and paved between the guttering lines thereof. 1 1 Section 8. That it is necessary and it is hereby ordered that Second Street, from the north line of Crawford Avenue to the south line of Prescott Avenue, be curbed, guttered, paved and graded with concrete thirty-three (33) feet back of curb to back of curb, with excavation thereof, and graded to the established paving grade and paved between the guttering lines thereof. Section 9. That it is necessary and it is hereby ordered that Eighth Street, from the north line of Lincoln Avenue to the south line of Decatur Avenue, be curbed, guttered, paved and graded with concrete thirty-three (33) feet back of curb to back of curb, with excavation thereof, and graded to the established paving grade and paved between the gutter— ing lines thereof. Section 10. That it is necessary and it is hereby ordered that Viemont Avenue, from the south line of Haven Avenue to the south line of Beverly Drive, be paved and graded with concrete twenty-eight (28) feet wide toe of gutter to toe of gutter, with excavation thereof, and graded to the established paving grade and paved between the guttering lines thereof. Section 11. That it is necessary and it is hereby ordered that South Side of Haven Avenue, from the center line of Duvall Avenue to the center line of Steahlin Avenue, in said city be curbed, and guttered with excavation necessary therefore and graded to the established, paving grade to each side thereof, as may be necessary for the completion of said work Section 12. That for the work and improvements herein provided for the City Engineer shall make and file with the City Clerk on or before the 3rd day of April 1956, complete plans and specifications for the curbing, guttering, paving and grading with excavation necessary therefore, of each of the streets or portions thereof described in Section 1 to 11, both inclusive of this ordinance, with the following type of improvements: Concrete combined curb and gutter on each side thereof, 30 inches wide from back of curb to paving line, curb 12 inches deep at back, gutter 6 inch deep; and the necessary grading of each to the established paving grade, and the paving thereof with 6r reinforced con- crete, provided that in the event of the non-availability of reinforced material that then said pavement shall be constructed with concrete to a depth of 7 inches between the curb and gutter line on each side thereof and within the limits of said streets hereinbefore described. The streets between the guttering lines and within the limits hereinbefore defined shall be graded to the established paving grades and paved with reinforced concrete six (6) inches deep, provided that in the event of the non-avail- ability of reinforced material, then that said pave- ment shall be constructed with concrete to a depth of 7°' deep and said Engineer shall on or before the same date, submit to the Board of Commissioners d under oath, detailed estimates of the cost of such work and improvements. 1 1 Section 13- That after such plans and specifications have been made and prepared by the City Engineer and filed with the City Clerk as aforesaid, the Board of Commissioners may advertise published advertisement in the official city paper of the City of Salina, Kansas, for three consecutive days for the receipt of sealed proposals for the improving of said streets with the kind of material named and specified in the preceeding sections hereof, and for the excavating and grading necessary for the completion of said work, and after the receipt of such proposals, the said Board of Commissioners may and are hereby authorized and directed to let contracts for the improving of said streets with the materials selected by them to the lowest responsible bidder or bidders thereof, as determined by the Board of Commissioners, and for such excavation and grading. Said Board reserves the right to reject any or all bids. Section 14. That for the improving of the above mentioned streets, such assessments shall be made for the full cost thereof according to law on all lots and pieces of land to the center of the block on either side of the streets to be improved according to the ap- praisers valuation thereof, without regard to the buildings or improvements thereon for the distance to be improved. Section 15. After the passage and publication of this ordinance, the Board of Com dss- inners shall appoint three disinterested appraisers, householders, who after having taken an oath to make a true and impartial appraisement, of all lots and pieces of land liable to assessment and taxation as aforesaid, as may he designated by the Board of Commissioners of said city, without regard to the buildings or improvements thereon and after making such appraisement shall return to the Board of Commissioners of said city and said Board of Comm- issioners shall designate a time and place for the hearing of any complaints that may be made as to the value of any lots and pieces of land appraised as aforesaid, of which due notice shall be given in the official city paper, at which hearing the Board of Commissioners may alter any valuation of any lot or piece of land, if, in their opinion, the same has been appraised too high or too low. Section 16. That for the purpose of paying the cost of the work and improvements in this ordinance provided for, the Board of Commissioners are hereby authorized and directed to issue internal improvement bondscf the City of Salina in an amount not to exceed the contract rice for the cost of such improvements mprovements and to run for a period of ten years and be payable in i ten equal installments, together with interest not to exceed five per cent per annum, which bonds shall be made payable at the Fiscal Agency of the State of Kansas and for the purpose of paying the principal and interest on said bonds as they severally become due and payable the Board of Commissioners shall apportion and assess against the lots and pieces of land within the taxing district of such improvements special assessments covering the cost of such 3 J { i f j,mproving and the apportionment herein contained shall hold good for all of the installments IIthat are to be collected from the specific property chargeable with said improvements. Such assessments and apportionment ordinance shall contain the total amount of tax apportioned to tract, piece or parcel of land within the taxing district and shall state the number of installments in which such tax is to be collected; and thereafter the City Clerk shall , at the same time other taxes are certified, certify to the County Clerk of Saline, County, Kansas, a full list of all property liable to such work and assessments, together th the respective amounts due on each of said tracts, pieces of land, which amounts shall the annual installments and interest on all unpaid balances for one year at the rate not to exceed five per cent per annum on such amounts so certified which shall be collected as other taxes are collected; PROVIDED, that for the purpose of defraying the cost of improv- j ing the intersections and areas formed by the crossing of streets and alleys, and for the grading of said streets where the same is provided for in this ordinance as well as where the improvement is through or adjacent to property of the city for which the city is liable, the assessment will be made against all taxable property of the city and paid by the city at large. Section 17. This ordinance shall take effect and be in force from and after its publication once in the official city paper.
