ORDINANCE NUMBER 6042

AN ORDINANCE creating and defining certain lateral sanitary sewer districts in the City of
Salina, Kansas, designated as Lateral Sanitary Sewer Districts Numbered 343 and 344, and 345,
and providing for the construction of a Lateral sanitary sewer in each of said Lateral Sani-
tary Sewer Districts Numbered 343, 344, and 345, so created, and providing for the payments of
the cost thereof and for the levying of special assessments against the property in said dis-
tricts for the payment of the cost of such construction and for the issuing of bonds to pay
the cost thereof.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas.
Section 1. Lateral Sanitary Sewer District Number 343. That there bg and there is
hereby created lateral sanitary sewer district in the City of Salina, Kansas, which shall
be and it is hereby designated as Lateral Sanitary Sewer District 343 and which district
shall include all the following described property in the City of Salina, Kansas, to -wit:

Benefit District:is 7,8,9,10,11,12,13,14, and 15,
South one-half of 117,18,19,20,21,22, and 32, all in
Block 6, Sunset Manor Addition, City of Salina, Saline
County, Kansas.
Section 2. It is necessary and it is hereby ordered that an eight inch V.C.P. lateral
sanitary sewer with all necessary connections, manholes, flushing tanks and other appurte-
nances be constructed and built in and to serve said Lateral Sanitary Sewer District Number

343 as created by Section 1 of this ordinance along the following course, to -wit:
An 8 inch clay pipe sewer beginning at an existing
manhole on the center line of easement and at the
northwest corner of Lot 6, Block 6, Sunset Manor
Addition; thence north along said easement to the
northwest corner of Lot 11 of said Block; thence
east along center line of easement for utilities
400.0 feet where a manhole will be built which will
be terminus.of Lateral 343.
Section 3. Lateral Sanitary Sewer District Number344. That there be and there is

hereby created lateral sanitary sewer district in the City of Salina, Kansas, which will
be and it is hereby designated as Lateral Sanitary Sewer District Number 344, and which
district shall include all the following described property in the City of Salina, Kansas,
to -wit:
Benefit District: Lots 7,8,9,10,11 and 12 in Block 4,
Sunset Manor Addition, City of Salina, Saline County,
Kansas.
Section 4. It is necessary and it is hereby ordered that an eight -inch V.C.P. lateral

nances be constructed and built in and to serve said Lateral Sanitary Sewer District Number
344 as created by Section 3 of this ordinance along the following course, to -wit:

Section 5. Lateral. Sanitary Sewer District Number 345. That there be and there is
hereby created lateral sanitary sewer district in the City of Salina, Kansas, which will
be and it is hereby designated as Lateral Sanitary Sewer District Number 345, and which
district shall include all the following described property in the City of Salina, Kansas,
to -wit:
Benefit District: Lots 8,9, and 10, Block 2, Sunset
Manor Addition, City of Salina, Saline County, Kansas.
Section 6. It is necessary and it is hereby ordered that an eight -inch V.C.P. lateral
sanitary sewer with all necessary connections, manholes, flushing tanks and other appurte-
nances be constructed and built in and to serve said Lateral Sanitary Sewer District Number
345 as created by Section 5 of this ordinance along the following course, to -wit:
An 8 inch clay pipe sewer beginning at an existing manhole
in center line of easement and at the northeast corner of
Lot 7, Block 2, Sunset Manor Addition; thence north along
the center line of said easement 130.0 feet where a man-
hole will be constructed which will be terminus of Lateral
345.
section 7. That the City Engineer shall on or before March 6th, 1956, prepare and file
in the office of the City Clerk, plans and specifications for the construction of the Lateral
sanitary sewer provided for in the proceeding sections of this ordinance which shall be of
the proper character to serve the property lying within the district which such sewer is to
be constructed and shall on or before the same date prepare and submit to the Board of
Commissioners a detailed estimate under oath of the cost thereof. That thereafter the City
Clerk shall advertise for three consecutive days in the official city paper for sealed pro-
posals for the building and construction of such sewer according to such plans and specifi-
cation, which proposals shall be filed faith the City Clerk on or before the time fixed in
such notice, at which time the Board of Commissioners may let a contract for the building
and construction of such sewer to the lowest and best responsible bidder or bidders there-
fore if there be any whose bids do not exceed the estimated cost thereof, but said Board
shall reserve the right to reject any or all such proposals, and if no bids shall be received
within such estimate, the Board of Commissioners shall have the power to do such work and
make such improvements within the estimated cost thereof as provided by law.
Section 8. That for the cost of building and construction of such sewer, special
assessments shall be made for the full cost there of on lots and pieces of land within and
for which such sewer shall be built, according to the appraised value thereof, without regard
to the building or improvements thereon.
Section 9. After the passage and publication of this ordinance, the Board of Commiss-
ioners shall appoint three disinterested appraisers, who after having taken an oath to make
a true and impartial appraisement of all lots and pieces of land within the district liable
to assessment and taxation as aforesaid, without regard to the building or improvements there=
on, and after making such appraisements, shall return to the Board of Commissioners of said
city and said Board shall designate a time for a special meeting of said Board for the pur-
pose of hearing any complaints that may be made as to the value of any lot or piece of

land appraised as aforesaid, of which special session due notice shall be given in the offs -
tial city paper, at which time special session and said Board may alter any valuation of
any lot or piece of land, if in their opinion, the same has been appraised too high or too
low.
Section 10. The special assessment herein provided for may be paid by the persons
liable therefore in four approximately equal annual installments but the owner of any pro-
perty liable to such assessment may within thirty -days from the date of determining the
amount assessed against the property, pay the same in full and his property shall not be
liable for any assessments for the cost of such improvements, and bonds are hereinafter
provided for shall be issued in the amount of the cost of the such improvements remaining
unpaid at the end of the thirty days from the time such assessment is fixed.
Section 11. For the purpose of paying for the work and improvements in this ordinance
provided, for the Board of Commissioners may and are hereby authorized and directed to issue
improvement bonds of the City of Salina, Kansas, in an amount not to exceed the total cost
of such improvement, and to run for a period of four years and are payable in four approxi-
mately equal annual installments, together with interest not to exceed five per cent per
annum, which bonds shall be issued and payable according to law; and for the purpose of
paying the principal and interest on said bonds as they severally become due and payable
the Board of Commissioners shall apportion and assess against the lots and pieces of land
within the taxing district of such improvement, special assessments covering the cost of
such improvement that are to be collected from the specific property chargeable therefore,
and with such improvements; and such assessment and apportionment ordinance shall contain the
total amount of tax apportioned to each such tract, piece or parcel of land within the tax-
ing district and shall state the number of annual installments in which such tax is to be

collected; and thereafter the City Clerk shall annually, at the same time that other taxes
are certified, certify to the County Clerk of Saline County, Kansas, a full list of all
property liable for such work and improvement, together tirith the respective amounts due on

each of said tracts, pieces or parcels of land, which amounts shall include the annual
installment and interest on all unpaid balance for one year at the rate of not to exceed
five per cent per annum on such amounts so certified, which amounts shall be collected as
other taxes are collected.
Section 12. This ordinance shall take effect and be in force from and after its
publication once in the official city paper.
