6035 Utility Imp - Southern Viei ORDINANCE NUMBER 6035 (Published in the Salina Journal s �-Uc 1956) AN ORDINANCE creating and defining certain main and lateral sanitary sewer districts in the city of Salina, Kansas, designated as Main Sanitary Sewer District "AC" and lateral Sanitary Sewer Districts Numbered 332, 333, 334, 335, 336, 337, 338, 339 and 340 and providing for the construction of a main sanitary sewer "AC" and lateral sanitary sewers in each of said lateral Sanitary Sewer Districts Numbered 332, 333, 334, 335, 336, 337, 338, 339 and 340, so created, and providing for the payment of the cost thereof and for the levying of special assessments against the property in said districts for the payment of the cost of such construction and for the issuing of bonds to pay the cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas. Section 1. Main Sanitary Sewer District Number AC. That there be and there is hereby created a main sanitary sewer district in the City of Salina, Kansas, which shall be and it is hereby designated as Main Sanitary Sewer District Number "AC" and which district shall 'include all the following described property in the City of Salina, Kansas, to -wit: j Benefit District. A11 of Blocks 1, 2, 3, 4, 5, 6, 7., '0 j ! in Southern View Addition, City of Salina, Saline County, Kansas. Section 2. It is necessary and it is hereby ordered that a ten inch V.C.P. main sanitary, ,sewer with all necessary connections, manholes, flushing tanks and other appurtenances be 9constructed and built in and to serve said main sanitary sewer District Number "AC" as created,) jby Suction 1 of this ordinance along the following course, tolwit: A ten inch clay pipe weaver beginning at an exisiting manhole in Cloud Street and 142 feet east of the east line of Quincy Street which is south of Cloud Street, thence east on Cloud Street to a point which is 20 feet east of the west line of Norton Street which is south of Cloud Street, there a manhole to be constructed; thence south with a 10 inch clay pipe sewer along a line 20 feet east of the west line of Norton Street to the center line of easement for utilities first north of Ralph Avenue, there a manhole to be constructed; thence south with an 8 inch clay pipe sewer 20 feet east of F the west line of Norton Street to enter line of ease- j ment for utilities first north of Avenue where a man- hole will be constructed which will be terminus of Main Sanitary Sewer "AC". Section 3. Lateral Sanitary Sewer District Number 332. That there be and there is hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 332 and which district I shall include all the following described property in the City of Salina, Kansas, to -wit: R Benefit District. All of Block 1 Southern Heights ?_ Addition, City of Salina, Saline County, Kansas. i Section 4. It is necessary and it is hereby ordered that an eight inch V.C.P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appurtenance i be constructed and built in and to serve said Lateral Sanitary Sewer District Number 332 as created by Section 3 of this ordinance along the following course, to -wit: An 8 inch clay pipe sewer beginning at a manhole to be con- structed over a 10 inch sewer in Cloud Street and 95 feet east of the east line of Quincy Avenue south of Cloud Street; thence south along easement for ]ztilities first east of Quincy Avenue to a point 20 feet south of the north line of Max Avenue; thence east along a line 20 feet south of the north line of Max Avenue 237.0 feet i where a manhole will be built which will be terminus of Lateral 332. a Section 5- lateral Sanitary Sewer District Number 333- That there be and there is j hereby created, Lateral Sanitary Sewer District in the MV of Salina.. Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 333 and which district i shall include all the following described property in the City of Salina, Kansas, to -wit: i Benefit District. Lots 1, 2, 3, and 4, Block 2, Southern View Addition, City of Salina, Saline County, Kansas. Section 6. It is necessary and it is hereby ordered that an eight inch V.C.P. lateral a sanitary sewer with all necessary connections, manholes, flushing tanks, and other appur- tenances be constructed and built in and to serve said lateral Sanitary Sewer Number 333 as created by Section 5 of this ordinance along the following course, to -wit: An 8 inch clay pipe sewer beginning at an exisiting maxihole which is 20 feet east of the west line of Norton Street and on the center line extended west ' of easement for utilities second north of Max Avenue; thence east along center line of said easement 180 feet where a manhole will be built which will be the terminus of Lateral 333 - Section 7. Lateral Sanitary Sewer District Number 334. That there be and there is here- by created lateral sanitary sewer district in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 334 and which district shall include all the following described property in the City of Salina, Kansas, to -wit: Benefit District. Lots 5, 61 7, and 8, Block 2 Southern View Addition, City of Salina, Baline County, Kansas, Section 8. It is necessary and it is hereby ordered that an eight inch V.C.P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appur- tenances be constructed and built in and to serve said Lateral Sanitary Sewer District Num- ber 334 as created by Section 7 of this ordinance along the following course, to -wit: An 8 inch clay pipe sewer beginning at an exisiting manhole which is 20 feet east of the west line of Norton Street and on the center line extended west of easement for utilities first north of Dias Avenue; thence east along center line of said easement 180 feet where a manhole will be built which will be terminus of Lateral 334. Section 9. Lateral Sanitary Sewer District Number 335. That there be and there is here- by created lateral sanitary sewer district in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 335 and which district shall include all the following described property in the City of Salina, Kansas, to -wit: Benefit District: All of Block 3, Southern View { Addition, City of Salina, Saline County, Kansas. Section 10. It is necessary and it is hereby ordered that an eight inch V.C.P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appur- tenances be constructed and built in and to serve said lateral Sanitary Sewer District Number 335 as created by Section 9 of this ordinance along the following course, to -wit: An 8 inch clay pipe sewer beginning at an exisiting manhole which is 20 feet east of the west line of Norton Street and on the center line of easement for utilities extended east of first north of Ralph Avenue; thence west along center line of said easement 545 feet where a manhole will be built which will be terminus of Lateral 335• Section 11. Lateral Sanitary Sewer District Number 336. That there be and there is hereby created lateral sanitary sewer district in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 336 and which district shall include all the following described property in the City of Salina, Kansas to -wit: c Benefit District: All of Block 4 Southern View Addition, t City of Salina, Saline County, Kansas Section 12. It is necessary and it is hereby ordered that an eight inch V.C.P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appur- tenances be constructed and built in and to serve said lateral. Sanitary Sewer District Number 336 as created by Section 11 of this ordinance along the following course, to -wit: An 8 inch clay pipe sewer beginning at an existing manhole which is 20 feet east of the west line of Norton Street and on the center line of easement for utilities extended west of first north of Ralph Avenue; thence east along the center line of said easement 180 feet where a manhole will be built which will be terminus of lateral 336. Section 13. Lateral Sanitary Sewer District Number 337. That there be and there is hereby created lateral sanitary sewer district in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 337 and which district shall include all the following described property in the City of Salina, Kansas to -wit: Benefit District: All of Block 5, Southern View Addition City of Salina, Saline County, Kansas. ary y g Section 14. It is necessary and it is hereby ordered that an eight inch V.C.P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appur- tenances be constructed and built in and to serve said Lateral Sanitary Sewer District Number 337 as created by Section 13 of this ordinance along the following course, to -wit: An 8 inch clay pipe sewer beginning at an existing manhole i which is 20 feet east of the west line of Norton Street and on the center line of easement for utilities extended east of first north of Carl Avenue; thence west along the center line of said easement 545 feet where a manhole will be built which will be terminus of Lateral 337. 1 i i Section 15. Lateral Sanitary Sewer District Number 338. That there be and there is i hereby created Lateral Sanitary sewer district in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 338 and which district shall include all the following described property in the City of Salina, Kansas, to -wit: Benefit District. All of Block 6, Southern View Addition, City of Salina, Saline County, Kansas. Section 16. It is necessary and it is hereby ordered that an eight inch V.C.P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appur- tenances be constructed and built in and to serve said Lateral Sanitary Sewer District Number 338 as created by Section 15 of this ordinance along the following course, to -wit: An 8 inch clay pipe sewer beginning at an exLsiting man- hole which is 20 feet east of the west line of Norton Street and on the center line of easement for utilities extended west of first north of Carl Avenue; thence east along the center line of said easement 180 feet where a manhole will be built which will be the terminus of Lateral 338• Section 17. Lateral Sanitary Sewer District Number 339• That there be and there is hereby created Lateral sanitary sewer district in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 339 and which district shall include all the following described property in the City of Salina, Kansas, to -wit: Benefit District: All of Block 7, Southern View Addition, City of Salina, Saline County, Kansas. Section 18. It is necessary and it is hereby ordered that an eight inch V.C.P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appur- tenances be constructed and built in and to serve said Lateral Sanitary Sewer District Number 339 as created by Section 17 of this ordinance along the following course, to -wit: An 8 inch clay pipe sewer beginning at an existing manhole which is 20 feet east of the west line of Norton Street and on the center line of easement for utilities first north of Albert Avenue extended east; thence west along center line of said easement 545 feet where a manhole will be built which will be the terminus of Lateral 339• Section 19. Lateral Sanitary Sewer District Number 340. That there be and there is hereby created Lateral sanitary sewer district in the City of Salina, Kansas, which shall be and it is hereby designated as lateral Sanitary Sewer District Number 340 and which district shall include all the following described property in the City of Salina, Kansas to -wit: Benefit District: All of Block 8, Southern View Addition City of Salina, Saline County, Kansas. i i u Section 20. It is necessary and it is hereby ordered that an eight inch V.C.P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appur- tenances be constructed and built in and to serve said Lateral Sanitary Sewer District Number 340 as created by Section 19 of this ordinance along the following course, to -wit: an 8 inch clay pipe sewer beginning at an existing manhole which is 22 feet east of the west line of Norton Street and on the center line of easement for utilities first north of Albert Avenue extended west; thence east along center line of said easement 580 feet where a manhole will be built which will be terminus of Lateral 34+0. Section 21. That the City F,hgineer shall on or before Ftiebruary`l4 1956, prepare and file in the office of the City Clerk, plans and specifications for the construction of the sanitary seven provided for in the preceding sections of this ordinance which shall be of the proper character to serve the property lying within the district which such sewer is to be constructed and shall on or before the same date prepare and submit to the Board of Commissioners a detailed estimate under oath of the cost thereof. That thereafter the City Clerk shall advertise for three consecutive days in the official city paper for sealed proposals for the building and construction of such sewer according to such plans and specifications, which proposals shall be filed with the City Clerk on or before the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such sewers to the lowest and best responsible bidder or bidders therefore, if there be any whose bids do not exceed the estimated cost thereof, but said Board shall reserve the right to reject any or all such proposals, and if no bids shall be received within such estimate, the Board of Commissioners shall have the power to do such work and make such improvements within the estimated cost thereof as provided by law, Section 22. That for the cost of building and construction of such sewer, special assessments shall be made for the full cost thereof on all lots and pieces of land within and for which such sewer shall be built, according to the appraised value thereof, without regard to the buildings or improvements thereon. Section 23. After the passage and publication of this ordinance, the Board of Connis- sioners shall appoint three disinterested appraisers, who after having taken an oath to make a true and impartial appraisement of all lots and pieces of land liable to taxation for the cost of such improvements, shall within five days after having been notified of their appointments proceed to appraise all of the lots and pieces of land within the district liable to assessment and taxation as aforesaid, without regard to the buildings or improve- ments thereon, and after making such appraisements, shall return to the Board of Commisioners of said city and said Board shall designate a time for a special meeting of said Board for the purpose of hearing any complaints that may be made as to the value of any lot or piece of land appraised as aforesaid, of which special session due notice shall be given in the official city paper, at which special session said Board may alter any valuation of any lot Section 26. This ordinance shall take effect and be in force from and after its publi- cation once in the official city paper. The special assessment herein provided for may be paid by the person liable therefore in four approximately equal annual installments but the owner of any property liable to such assessment may within thirty days from the date of determining the amount a assessed against the property, pay the same in full and his property shall not be liable for any assessments for the cost of such improvements, and bonds as hereinafter provided for !' d shall be issued in the amount of the cost of such improvements remaining unpaid at the end 1 of the thirty days from the time such assessment is fixed. Section 25. For the purpose of paying for the work and improvements in this ordinance provided for, the Board of Commissioners may and are hereby authorized and directed to issue j improvement bonds of the City of Salina, Kansas, in an amount not to exceed the total cost of such improvement, and to run for a period of four years and be payable in four approxi- mately equal annual installments, together with interest not to exceed five per cent per annum, which bonds shall be issued and payable according to law; and for the purpose of 3 paying the principal and interest on said bonds as they severally become due and payable the Board of Commissioners shall apportion and assess against the lots andp ieces of land within the taxing district of such improvements, special assessments covering the cost of such 1 improvement and apportionment therein contained hold shall good for all of the installments s that are to be collected from the specific property chargeable therefore, and with such a G improvements; such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece or parcel of land within the taxing district and j shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time that other taxes are certified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable for such work and improvement, together with the respective amounts due on each of said tracts, pieces or parcels of land, which amounts shall include the annual installment and interest on all unpaid balances for one j p year at the rate of not to exceed five per cent per annum on such amounts so certified, which amounts shall be collected as other taxes are collected. Section 26. This ordinance shall take effect and be in force from and after its publi- cation once in the official city paper.
