6030 Utility Imp - Cloud Add1 1 L (9 (0 -� 0 ORDINANCE NUMBER 6030 {published in the Salina Journal Ua,.,, j 9-3) , 1956) AN ORDINANCE providing for the constructionof a certain storm sewer and drainage in the City of Salina, Kansas, to be designated as 'Cid--Avenue Storm Sewer, and providing for the letting of contract for such construction and for the payment of the cost thereof. WHEREAS, at all times heretofore, the entire City of Salina, Kansas, has constituted a storm sewer and drainage district and bonds issued to pay the cost thereof are payable by a general tax as provided by law; and BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: i Section 1. That the preamble of this ordinance is hereby incorporated herein . That the entire City of Salina is hereby determined to be the benefit district for the purpose of the installation of a system of storm sewers and drainage in the said city. Mat the entire limits of said city has always constituted one district for said purposes. Section 2. That it is necessary and it is hereby ordered that a storm sewer, which is hereby designated as Storm Sewer, together with all necessary inlets, inlet connections, manholes, connecting lines, sluice gates and other appurtenances, be constructed in the City of Salina along the following course, to -wit: LATERAL "Ax; A 24" concrete pipe sewer beginning at an existing manhole in easement for utilities at the southeast corner of Lot 28, Block 7, Likens -Foster Addition to the City of Salina, Kansas,thence west along center line of easements for utilities to the center line of Oak Street, thence south in said Oak Street to a point 20 ft. north of the south line of Bachtold Avenue, thence west along a line 20 ft. north of the south line of Bechtold Avenue, to the center line of Beach Street where a manhole will be constructed, thence west with a 21" concrete pipe sewer to the center line of Maple Street, where a manhole will be con- structed, thence west with an 18" concrete pipe sewer to the center line of Sycamore Street, where a manhole will be constructed, thence west with a 15" concrete pipe sewer to a point 30 ft. west of the east line of Cherokee Drive where a manhole will be constructed, thence south with a 15" concrete pipe sewer along a line 30 ft. west of the east line of Cherokee Drive, 420 ft. where a manhole will be con- structed which will be terminus of Lateral "A". LATERAL "B"; Beginning at a manhole on Lateral "A" which is in the inter- section of Bachtold Avenue and Beach Street, thence south along the center line of Beach Street with a 15" concrete pipe sewer to the in- tersection of Oak Circle and Beach Street, where a manhole will be con- structed which will be terminus of Lateral "B". LATERAL "C"; Beginning at a manhole on Lateral "A" and the intersec- tion of Maple Street and Bachtold Avenue, thence south along center line of Maple Street 374 ft. to a point where a manhole will be con- structed which will be terminus of Lateral "C". LATERAL "D"; Beginning at a manhole on Lateral "A" and intersection of Sycamore Street and Bachtold Avenue, thence south along the center line of Sycamore Street 425 ft. to a point where a manhole will be constructed which will be terminus of Lateral "D". Section 3. That on or before the 24th day of January , 1956, the City Engineer j i shall prepare and file in the office of the City Clerk, detailed plans and specifications for the construction of the storm sewer provided for in Section 2 of this ordinance with vitrified and/or corrugated metal pipe, bituminous coated, and/or concrete sewer pipe or any combination of such typed of sewer pipe and on or before the same date shall prepare and file in the office of the City Clerk, under oath, a detailed estimate of the cost thereof. i }fter such plans and specifications and estimate of cost shall have been filed, the City Clerk hall advertise by advertisements published in the official city paper for at least three consecutive days for sealed proposals for the building and construction of such storm sewer a hand at the time and place mentioned, the Board of Commissioners may let a contract with the lowest and best responsible bidder for the building and construction of such storm and drainage 9 ;sewers, but the right to reject any and all bids shall be and it is hereby reserved, and pro- hided further that if no responsible person shall purpose to enter a contract at a price not exceeding the estimated cost, then the Board of Commissioners may procedd to construct said improvements within the estimated cost thereof and shall purchase the necessary tools, appara- tus, and materials and employ the necessary labor for the purpose of constructing the sewer. Section 4. That for the payment of the cost of said work, the Board of Commissioners °shall issue General Obligation and Improvements Bonds of the City of Salina, Kansas, in an amount not to exceed the total cost of such work and improvements, to be payable in Oath% ;approximately equal annual installments and to bear interest at not to exceed five per cent per annum and from the date of such bonds, and for the purpose of paying such bonds and interest las they severally become due, the Board of Commissioners shall annually levy a tax upon all !real and personal property im, the City of Salina in an amount sufficient to pay the annual installments of such principal and interest, and that pending the issuance of such bonds, temporary notes shall be issued according to last, to pay the cost of such work. Section 5. This ordinance shall take effect and be in force from and after its publi- cation in the official city paper.
