AN ORDINANCE Providing for the appropriation and condemning of certain land within the city
limits of the City of Salina, Kansas, for the use of said City for the construction thereon
of a river water intake system and a sedimentation basin to be used to supply said City and
its inhabitants with water.
WHEREAS, the governing body of the city of Salina, Kansas, on December 20, 1955, by Resolu-
tion No. 16+2, found it necessary to appropriate certain private property in Salina, Saline
County, Kansas, as described in said Resolution and as further described hereinafter for the
use of said City for the construction thereon of a river water intake system and sedimenta-
tion basin to be used to supply said City and its inhabitants with water and directing that
a survey and a description of such lands so required be made;
WHEREAS, on the 20th day of December, 1955, a survey and description of the land so required
was duly filed;

S0, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMUSSIONERS OF THE CITY OF SALINA, KANSASi ;
Section 1. The following described land is hereby condemned and appropriated for the
use of the City of Salina, Kansas, for the construction thereon of a river water intake system!
and sedimentation basin to be used to supply said City and its inhabitants with water, to -wit:'
Tract 1. The South One Half (1/2) of Lot Four (4) on Fourth
Street in Holland's Addition to the City of Salina,
Saline, County, Kansas;
Tract 2. The South Fifty (50) feet of the East One Hundred
Twenty (120) feet of Lot Two (2) in Block Three
(3) in the Replat of Beebe's Second Addition to
Salina, Saline County, Kansas;
Tract 3. The East One Hundred Twenty (120) Feet of Lot Three
(3) in Block 'Three (3) in the Replat of Beebe's
Second Addition to Salina, Saline County, Kansas;
Section 2. There shall be no special benefit district for such improvement, the
entire cost thereof being charged to the city as a whole and to be paid for out of proceeds
from bonds heretofore authorized and issued.
Section 3. That the City Attorney, is hereby ordered and directed to forthwith pre-
pare and present in the name of the Board of Commissioners of the City of Salina, Kansas, a
written application to the Judge of the District Court of Saline County, Kansas, praying for
an order of appointment of commissioners to make appraisement and assessment of damages
arisingfrom the
appropriation of said real estate described in Section 1 hereof, and to do I
and perform all things in and about the procuring and recording of said order of appointment
required by law, and completing the appropriation of said land as provided by law.
Section 4. This Ordinance shall take effect and be in full force from and after its
publication in the official city paper.
