6024 Water Conservation1 1 1 ORDINANCE NUMBER 6024 (Published in the Salina Journal tt u.�r1✓ ? f;� Sl wll/1�1�\t AN ORDINANCE relating to the conservation of water and control- ling the use of the -municipal sewer system; regulating the use thereof by air conditioning equipment; prohibiting waste; re- quiring a permit from the building inspector before installing, remodeling or adding to any air conditioning system of speci= fied size using water from the municipal supply or emptying into municipal storm or sanitary sewers and providing for the revoca- tion thereof; defining certain terms and providing penalties for the violation of its provisions: BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. 28-123. DEFINITIONS. For the purpose of these regulations, the following terms shall have, and shall be con- strued to have, the following meaning: (a) The term "air conditioning system" shall include any combination of equipment, whether compressor or other type, by which heat is removed from the air and from which the accumulated or effluent heat is wholly or partially removed by the use of water. (b) "System" shall mean a single air conditioning unit or a group or collection of such units or any other combination of air conditioning apparatus connected to the municipal water supply in a common location, such as an apartment or office building or supplied with water through any single customer service pipe connected to the municipal water supply system or emptying into municipal storm or sanitary sewers, 1 (c) „Person" shall mean all users of water from the public supply, including natural persons, partnerships, corporations, or associations. Whenever used with respect to penalty, the term "person" as applied to partnerships or associa- tions shall mean the partners thereof, and as applied to corporations, the officers thereof. (d) "Building Inspector" shall mean the Building inspector of the City of Salina or such officer or agent as he shall duly authorize to act in enforcement of these regulations. (e) "Water conservation equipment or facilities" shall mean evaporative condensers, cooling towers, spray ponds, recirculating pumps or state approved return disposal well. (f) "Horsepower" shall mean the manufacturer°s horse power name plate -rating of the compressor motor on an air conditioning system so operated. For the purpose of this ordinance the term "horsepower" shall also apply to air conditioning systems utiliz- ing cooling coils or radiators or similar devices connected directly to the municipal water supply or to a private well in the air conditioning process, which systems shall be considered as hav- ing the equivalent of two (2) horsepower for each square foot of coil or radiator face area. Correlative horse power ratings for other types of air conditioning systems shall be set by the Building Inspector. Section 2. 28-124* PRRMIT REQUIRED FOR INSTALLING SYSTEMS; PERMIT FEE, No person shall install, remodel or add to any air conditioning system which uses water from the municipal supply or empties into the municipal storm or sanitary sewer without first having procured written permit therefor from the Building In- spector; PROVIDED9 Howevers this section shall not apply to systems used for single family residential purposes only or systems used for any other purpose with a total rated capacity of two (2) horsepower or less. The Building Inspector shall charge a fee of Three Dollars ($3000) for the issuance of such permit. Section 3. 28-125. INSTALLATION OF AIR CONDITIONING SYSTEMSs REPORT AND INSPECTION REQUIRED* No one other than a plumbor li- censed by the City of Salina shall connect any such air condition- ing system to the city water systems nor shall any one other than an electrician licensed by the City of Salina do any electrical work in connection with such installation,. Within forty-eight (48) hours following the completion of any such work authorized. by the permit required by the foregoing section of this ordinance, the person doing such work shall file in the office of the Build- ing Inspector written notice of such completion and request for inspection, which inspection shall be promptly made by the Building Inspector. Licensed plumbers or electricians who violate any of the provisions and regulations herein set forth may be denied the privilege of securing further permits from the Building Inspector. Section 4. 28-126. WATER USE CONSERVATION AND REGULATION* (a) Inasmuch as the conservation of water and regulation of sewer load during periods of peak demand is in the public interests a surcharge is hereby authorized against all air conditioning systems connected to the municipal water supply or emptying into munici- pal storm or sanitary sewersn which surcharge is hereby fixed at $2.50 per montjx per horsepower of manufacturer's rated capacity for the months of June, July, August, and September in each year 1 beginning June 1. 1956* This surcharge shall be in addition to the regular charges for water consumed and the City Commission shall be authorized to assess the surcharge at any time that it shall deem neces- sary in the interest of the conservation of the municipal water supply and/or the limitation of use of the municipal storm or sanitary sewers; PROVIDED, however, this surcharge shall not apply to any of the following air conditioning systems: (1) Systems now or hereafter used for single family residential purposes* (2) Systems now or hereafter used for any other purpose with a total rated capacity of two (2) horsepower or less. (3) Any system utilizing water conservation equipment and facilities, (b) In order to prevent back siphonage into the municipal water supply there shall be no direct or indirect con- nection between the municipal water supply and any air conditioning system using water from a source other than the municipal supply. Section 50 28-127. REPORT OF EXISTING AIR CONDITIONING SYSTEMS: PENALTY* All owners of air conditioning systems with a total rated capacity of three (3) horsepower or more and now in use for any purpose other than in a residence used for single family occupancy only shall report the following information with regard to such system to the Building Inspector on or before yV it 1956: (A) The name and address of the ownero (b) The location of the installation* (c) The make and model number. (d) The rated horsepower or the total square feet of coil or radiator area. (e) A full description of all water conservation equip- ment or facilities, if any, used in conjunction with such system. 1 1 1 PROVIDED, however, that any air conditioning system not connected to the municipal water supply or emptying into the municipal storm orsanitary sewer system need not be reported. There shall be a penalty of One Dollar ($1.00) per day after i, 19569 assessed against all persons not complying with the provisions of this sectiono Section 6. 28-128. WASTE PROHIBITED* It shall be unlawful to waste water. The use of water in violation of any of the terms of this ordinance shall be deemed waste, Water flowing into a gutter or onto.a street, alley or sidewalk, directly or in- directly from an air conditioning system, shall be deemed waste. Section 7, 28-129. USE OF WATER OR SEWERS FOR CERTAIN PURPOSES DECLARED PERMISSIVE ONLY, The use of water by any person or persons from the municipal supply for air condition- ing, the sprinkling of lawA9 or washing of vehicles direct from a hose or other outl"et, is hereby declared permissive only. The use of the municipal storm or sanitary sewers for the discharge of water directly or indirectly from air condition- ing systems is hereby declared permissive only. Section 8. 28-130. AUTHORITY TO REVOKE PERMISSIVE USE AND DIS- CONTINUE SERVICE. The governing body of the City of Salina is hereby authorized to revoke the permissive use of water by any person or persons from the municipal supply at any time if, in its judgment, the same is necessary to protect the public health, welfare or safety. The following shall be deemed grounds for revocation of permissive user (a) Water supply emergency or shortage or an impending water supply emergency or shortage. (b) Physical conditions hazardous to the potable water supply either within the premises or in the supply mains. (c) Unnecessary waste of water. L 1 (d) Continued or wilful violations of the terms of this ordinance, (e) Capacity or near capacity sewer load, In the event any person or persons fails to discontinue such permissive use after notice by legal publication or other- wise, the City Manager may order the entire service of such person or persons disconnected. Section 9. 28-131. PENALTIES* Any person who shall violate any of the terms of this ordinance shall be deemed guilty of a public offense and upon conviction thereof shall be fined in an amount not to exceed $50,00, or be imprisoned for a period not to ex- ceed ten'(10) days or be both so fined and imprisoned and shall be subject to having his water service discontinued, Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder. Section 10. 28-132. EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its publication once in the official city paper.
