AN ORDINANCE authorizing and providing for the issuance of Improvement Bonds of the City
of Salina, Kansas, in the sum of $56,593.95 to pay the cost of improving certain streets in
said city to be designated as Series Number P-168.
WHEREAS, pursuant to proceedings duly had according to law, contracts have been let and
performed for the construction of the following street improvements in the City of Salina,
Kansas, to -wit:
Curbing, guttering and grading of Claflin Avenue from the center
line of Roach Street to the center line of Lewis Street, as pro-
vided by Resolution Number 1478 and Ordinance Number 5894.

Curbing, guttering and grading of Eighth Street from the center
line of Grand Avenue to the center line of Decatur Street, as
s provided by Resolution Number 1463 and Ordinance Number 5894•
Curbing, guttering and grading of Franklin Street from the center
line of Seminole Avenue to the center line of Shawnee Avenue, as
provided by Resolution Number 1458 and Ordinance Number 5894.
Curbing, guttering and grading of Kirwin Avenue from the center
line of Roach Street to the center line of Lewis Street, as

Curbing, guttering and grading of Lewis Avenue from the center

Kirwin Avenue, as provided by Resolution Number 1476 and

Curbing, guttering and grading of Shawnee Avenue from the center
line of Seminole Avenue to the center line of Franklin Street,
as provided by Resolution Number 1456 and Ordinance Number 5894•
Curbing, guttering and grading of Beatrice Avenue from the center
line of Martin Avenue to the center line of McAdams Road, as pro-
vided by Resolution Number 1501 and Ordinance Number 5921.
Curbing, guttering and gradag of Cloud Street on the north side
from the center line of Pershing Avenue to the center line of
Broadway Boulevard and on the south side from the center line
of Ninth Street to the center line of Broadway Boulevard, as
provided by Resolution Number 1492 and Ordinance Number 5921.
Curbing, guttering and grading of Gypsum Avenue on the north
side from the center line of Indiana Avenue to the center line
of Iowa Avenue and on the south side from the center line of
Missouri Avenue to the center line of Iowa, Avenue, as provided
by Resolution Number 1493 and Ordinance Number 5921.
Curbing and guttering and grading of the south side of Haven
9 Avenue from the center line of Steahlin Avenue to the center
n line of Whittinghill Avenue, as provided by Resolution Number
1480 and Ordinance Number 5921.
Curbing, guttering and grading of the south side of Haven Avenue
from the center line of Whittinghill Avenue to the center line
of Viemont Avenue, as provided by Resolution Number 1481 and
Ordinance Number 5921.
Curbing, guttering and grading of Lewis Avenue from the center

Curbing, guttering and grading of the south side of Republic
s Avenue, from the east line of U. S. Highway No. 81, thence
east to the east line of the Missouri Pacific Railroad right-
of-way, and the north side of Republic Avenue from the west
3 line of Hancock Street, thence west to a point 216 feet west
of the east right-of-way line of the Missouri Pacific Rail-
road, as provided by Resolution Number 1485 and Ordinance
Number 5921.

line of Crawford Avenue to the center line of Haven Avenue, as
provided by Resolution Number 1489 and Ordinance Number 5921.
y Curbing, guttering and grading of Viemont Avenue from the center
line of Crawford Avenue to the center line of Haven Avenue, as
provided by Resolution Number 1482 and Ordinance Number 5921.

Curbing, guttering and grading of Whittinghill Avenue from the
center line of Crawford Avenue to the center line of Maven Avenue,
as provided by Resolution Number 1483 and Ordinance Number 5921.
WHEREAS, the total cost of said improvements has been ascertained and the portion thereof
in the amount of $23,781.63 to be paid by the general taxes to be levied upon all taxable
property within said city for the improvement of squares and areas formed by the crossing
of streets and alleys and for the improvement of any of said streets where the same is throug4
or adjacent to property of the city for which the city is liable, and for which bonds are to
be issued; and
WHEREAS, the total cost of said curbing, guttering and grading of said streets, which are
to be paid by special assessments are to be levied upon lots and pieces of ground liable for
I the payment of said curbing, guttering and grading in said street has been ascertained and
has been found and determined to be the sum of $40,129.99, which amount has been heretofore
duly assessed and apportioned to the several lots and pieces of ground liable therefor
I according to law provided for in the ordinance of the city of Salina, Kansas, relating there-
to, duly passed and approved, of which amount the sum of $7,317.67 has been duly paid by the
property owners liable therefor, leaving a balance of $32,812.32, for which bonds are to be
issued: and

WHEREAS, bonds in the aggregate sum of $56,593.95 are to be issued to pay the actual net
cost thereof.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the foregoing preambles be and they are hereby adopted as a part of
this ordinance and that for the purpose of providingfunds
to pay the cost of the improve-
ments hereinabove referred to and described in the Ordinances and Resolutions hereinbefore

i� referred to, there shall be issued Internal Improvement Bonds of the City of Salina, Kansas,

in the total principal sum of $56,593.95, which shall consist of Fifty -Six bonds, numbered
g 1 to 56, inclusive, all dated November 1, 1955, which shall bear interest at the rate of

May 1, and November 1, 1956 thereafter on each May 1, and November 1, in each year, said
interest to be evidenced by interest coupons as herein provided for and said bonds shall
become due as follows:
Bonds numbered 1 to 7, for $1,000.00 each except
Number 1 is for $1,593.95 due May 1, 1957•
Bonds numbered 8 to 14, for $1,000.00 each due
November 1, 1957•
Bonds numbered 15 to 21, for $1,000400 each due
May 1, 1958.
Bonds numbered 22 to 28, for $1,000.00 each due
November 1, 1958•
Bonds numbered 29 to 35, for $1,000.00 each due
May 1, 1959•
Bonds numbered 36 to 42, for $1,000.00 each due
November 1, 1959•
Bonds numbered 43 to 49, for $1,000.00 each due
May 1, 1960.
Bonds numbered 50 to 56, for $1,000.00 each due
November 1, 1960.
Section 2. Said bonds shall be signed by the Mayor and shall be attested by the
signature of the City Clerk and corporate seal of the city shall be affixed thereto, and
said bonds shall have attached thereto interest coupons representing the interest thereon,
which cojpons shall be in the form provided by law and shall bear the printed or lithograph-
ed facsimile signature of the Mayor and City Clerk of said city and said bonds and interest
j coupons shall be registered in the office of the City Clerk and in the office of the Auditor',
of State, as required by law.
Section 3. Said bonds shall be designated as Series P-168 and shall be in the form
and shall contain recitals substantially as follows:

KNOW ALL MEN BY THESE PRESENTS, That the City of Salina, in the County of Saline, State of
Kansas, acknowledges itself to be indebted and for value received hereby promises to pay to
the bearer the sum of DOLLARS in lawful money of the United
States of America, on the first day of , 19 , with interest thereon
From the date hereof at the rate of per cent per annum
payable May 1, and November 1, 1956 thereafter on each May 1, and November 1, in each year,
on presentation and surrender of the coupons hereto attached both principal of and interest
on this bond being payable at the office of the State Treasurer of the State of Kansas, in
the City of Topeka, Kansas, and said City of Sa]iia, Kansas, is held and firmly bound by
these presents and the full faith, credit and resources of said city are hereby irrevocably
pledged for the payment of said principal and interest at maturity.
IN WITNESS WHEREOF, the said City of Salina, Kansas, has executed this bond by causing it
to be signed by its Mayor and its corporate seal to be hereto affixed, attested by its City
Clerk and the coupons hereto attached to be signed with the facsimile signatures of said

This bond is one of a series of 56 bonds of like date and tenor, excepting denomination,
and maturity, aggregating the principal sum of $56,593.95, issued by the City of Salina,
Kansas, for the purpose of paying the cost of constructing certain curbing, guttering and
i grading improvements in said city by the authority of and in full compliance with the pro-
visions., restrictions and limitations of the constitution of and the laws of the State of
j Kansas,_ including Section 10-101 to 10-127, 12-601 to 12-608 and 13-1011 and 13-1011a, all
of the General Statutes of Kansas, 1949, and amendments thereto, and all other provisions
of the laws of said state applicable thereto, and this bond and all other bonds of this
series, and all interest thereon are to paid by the City of Salina, Kansas.

And it is hereby declared and certified that all acts, conditions, and things required to
3 be done and to exist precedent to and in the issuance of this bond have been properly done
s and performed and do exist and in due and regular form and named as required by the con-
stitution and laws of the State of Kansas and that the total indebtedness of said city,
including this series of bonds, does not exceed any constitutional or statutory limitation.

Section 4. The Mayor and City Clerk are hereby authorized and directed to prepare and
execute the bonds hereinbefore described and to advertise and sell the same in the manner
provided by law, and when executed and registered to deliver and said bonds to the purchaser

Section 5. The full faith, credit and resources of the City of Salina, Kansas, shall
be and the same are hereby irrevocably pledged for the prompt payment of said bonds and all
interest thereon. The Board of Commissioners of the City of Salina, Kansas, shall annually
