AN ORDINANCE providing for and authorizing the issuance of Improvement Bonds of the City
of Salina, Kansas, in the sum of $116,547.25, to pay the cost of constructing main sani-
tary sewers and certain lateral sanitary sewers and storm sewer, in the City of Salina,
Kansas, which bonds shall be designated as Series 5-167.
WHEREAS, pursuant to proceedings duly had according to law, certain main and certain
lateral sanitary sewers and storm sewer have been constructed in the City of Salina, Kansas,
in main sewer districts and certain lateral sanitary sewer districts, as follows;

WHEREAS, the total cost of said sewers constructed in and as the sewer districts above
mentioned and to be paid by special assessments levied upon lots and pieces of ground
liable for the payment of said sewers in the sewer districts above mentioned has been
ascertained and is hereby found and determined to be the sum of $67,716.05, which amount
has been heretofore duly assessed and apportioned to the several lots and pieces of ground
liable therefor according to law and as provided for in the Ordinances of the City of
Salina relating thereto, of which amount the sum of $6,368.35 has been paid by the owners
of the property liable therefor, leaving a balance for which bonds will be issued in the
sum of $61,347.70.
WHEREAS, the total cost of the said Storm Sewer has been ascertained in the amount of
$55,199.55 to be paid by general taxes to be levied upon all taxable property within said
city; and for which bonds are to be issued; and
WHEREAS, bonds in the aggregate sum of $116,547.25 are to be issued to pay the actual net
cost thereof; NOW THEREFORE,

BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the foregoing preambles are being hereby adopted and made apart
of this ordinance and that for the purpose of providing funds to pay the cost of the
improvements, hereinbefore described, there shall be issued and there hereby are issued,
Internal Improvement Bonds of the City of Salina, Kansas, in the total principal sum of
$116,5+7.25, which issue shall consist of 116 bonds numbered from 1 to 116 inclusive, all
dated November
1,
1955, bonds numbered 1 to 116
inclusive, to bear interest from date at
the rate
per cent per annum, payable August 1, 1956 and thereafter semiannually on February 1st and
August lst of each year to be evidenced by interest coupons as herein provided for, and
said bonds shall become due serially in denomination as follows:
Bonds numbered 1 to 29 for $1,000.00 each except
Number 1 is for $1,5+7.25 due August 1, 1957.
Bonds numbered 30 to 58 for $1,000.00 each, due
August 1, 1958•
Bonds numbered 59 to -77 for $1,000.00 each, due
August 1, 1959•
Bonds numbered 78 to 116 for $1,000.00 each, due
August 1, 1960.
Section 2. Said bonds shall be signed by the Mayor and shall be attested by the
signature of the City Clerk and the corporate seal of the City shall be affixed thereto,
and shall have attached thereto interest coupons representing the interest thereon, which
coupons shall be in the Form provided by law and shall bear the printed or lithographed
facsimile signatures of the Mayor and the City Clerk of said City and bonds and interest
coupons shall be registered in the offices of the City Clerk and the State Auditor as
required by law.
Section 3. Said bonds shall be designated as Series S-167, and shall be in the
form and shall contain recitals substantially as follows, to -wit:

KNOW ALL MEN BY THESE PRESENTS, That the City of Salina, in the County of Saline, State of
Kansas, acknowledges itself to be indebted and for value received hereby promises to pay
the bearer the sum of
DOLLARS
in lawful money of the United States of America, on the first day of August 19
with interest thereon from the date hereof at the rate of
per cent per annum, payable August 1, 1956 and thereafter semiannually on the first days
of February and August in each year, on presentation and surrender of the interest
coupons hereto annexed as said coupons severally become due, both principal and interest
of this bond being payable at the office of the State Treasurer of the State of Kansas,
in the City of Topeka, Kansas. And said City of Salina, Kansas, is held and firmly bound
by these presents and the full faith, credit and resources of said city are hereby
irrevocable pledged for the payment of said principal and interest at maturity.
This bond is one of a series of 116 bonds of like date and tenor, excepting denomination
and maturity, aggregating the principal sum $116,547.25, issued by the City of Salina,
Kansas, for the purpose of paying the cost of constructing a main sanitary sewer and
certain lateral sanitary sewers and storm sewers,Iid said city be the authority of and in
full compliance with the provisions, restrictions and limitations of the constitution and
laws of the State of Kansas, including Sections 10-101 to 10-127,Sections 12-617 to
12-620, Sections 12-626 to 12-629, and Sections 13-1013 to 13-1018, all in the General
Statutes of Kansas, 1949, and amendments thereto, and all other provisions of the laws
of said state applicable thereto and this bond and all other bonds of this series, and all
interest thereon, are to be paid by the City of Salina, Kansas.
And it is hereby declared and certified that all acts, conditions and things required to
be done and to exist precedent to and in the issuance of this bond have been properly
done and performed and do exist in due and regular form and manner as required by the
constitution and laws of the State of Kansas, and that the total indebtedness of said
city, including this series of bonds, does not exceed any constitutional or statutory
limitations.
IN WITNESS WHEREOF, the said City of Salina, Kansas, has executed this bond by causing it
to be signed by its Mayor and its corporate seal to be hereto affixed attested by its City
Clerk and the coupons hereto attached to be signed with the facsimile signatures of said
officers, and this bond to be dated the first day of November , 1955•

Section 4. The Mayor and the City Clerk are hereby authorized and directed to pre-
pare and execute the bonds hereinbefore described and to advertise to and sell the same
in the manner provided by law, and, when duly executed and registered, to deliver said
bonds to the purchaser or purchasers thereof.
Section 5. The full faith, credit and resources of the City of Ralina, Kansas,
shall be and the same are hereby irrevocably pledged for the prompt payment of said bonds
and all interest thereon. The Board of Commissioners of the City of Salina, Kansas, shall
annually make provisions for the payment of the principal and interest on said bonds, the
same become due by levying taxes and assessments upon the property liable therefore as
provided by law.
Section 6. This ordinance shall take effect and be in force from and after its
publication once in the official city paper.
