6005 Authorize ContractC ORDINANCE NUMBER 6005 i (Published in the Salina Journal 1955 ) AN ORDINANCE ratifying and confirming a contract with the H. J. Taylor Construction Company Ifor the construction of certain curbing, guttering, paving and grading improvements on certain ;streets in the City of Salina, Kansas, and providing for the issuance of temporary notes to pay 'the cost thereof pending the issuance and sale of bonds. IBE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas; Section 1. That the acceptance by the City of Salina, Kansas, of the proposal of the H. J. Taylor Construction Company, hereinafter referred to as the "Contractor" as subMitted to the Board of ConmLissioners on October 11, 1955, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Cormnissioners of said city to said contractor and signed on behalf of the City by its Mayor on October 18, 1955, for the yconstruction of certain public improvements in the City of Salina, Kansas, to -wit; i Paving and grading of Duvall Street (twenty-eight (28) FEEt wide from toe of gutter to toe of gutter) with con- crete, from the north line of Crawford Avenue to the north line of Haven Avenue, as provided for by Ordinance Number 5997• Paving and grading of Ellsworth Avenue (twenty-eight (28) feet wide from toe of gutter to toe of gutter) with con- crete, from the east line of Sunrise Drive to the east line of Roach Street, as provided for by Ordinance Number 5997. Paving and grading of Gebhart Street (twenty-eight (28) feet wide from the toe of gutter to the toe of gutter) with concrete, from the south line of Cloud Street to the north line of Charlotte Street, as provided for by Ordinance Number 5997• Paving and grading of Gebhart Street (twenty-eight (28) feet wide from toe of gutter to toe of gutter) with con- crete, from the north line of Charlotte Avenue to the south line of Leslie Avenue, as provided for by Ordinance Number 5997. Paving and grading of McAdams Road (twenty-eight (28) feet wide toe of gutter to toe of gutter) with concrete, from the west line of Pearl Avenue to the east line of Lewis Avenue, as provided for by Ordiance Number 5997• Curbing, guttering, paving and grading of Armory Road (forty-one (41) feet wide back of curb to back of curb) with concrete, from the edge of present pavement on Broadway Boulevard to a line 100 feet west of the west line of the Missouri Pacific Railroad right-of-way, as provided for by Ordinance Number 5997• Curbing, guttering, paving and grading of West Walnut Street (thirty-three (33) feet back of curb to back of curb) with concrete, from the west line of Clark Street to the center line of Broadway Boulevard, as provided for by Ordinance Number 5997• Paving and grading of the alley first east of Twelfth Street, (twenty (20) feet wide) with concrete, from the north line of Elm Street to the south line of Bishop Street, as provided for by Ordinance Number 5997- t and for the unit price for said work contained in said proposal, which proposal and con- tractors hereby referred to and made parts of this ordinance, be and the same is hereby ra and confirmed, saidpoposal being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer on file in the office of the City Clerk, which estimates fare hereby referred to and made a part of this ordinance. Section 2. Said improvements shall be built and constructed in accordance with the 'plans and specifications therefore prepared by the City Engineer on file in the office of the i 1 City Clerk and in accordance with the proposal of said contractor and under the terms of said contract, all of which are hereby referred to and made parts of this ordinance. s Section 3. That temporary notes signed by the Mayor and attested by the City Clerk be °'issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the amount of $98,612.80, for such work, such notes Ito bear interest not to exceed 42 per cent per annum, and to mature not later than December 1, 1956, and to be issued in such amounts and at such time as money for the payment of the cost of such notes being issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof. Section 4.
