6003 Authorize ContractORDINANCE NUMBER 6003 (Published In The Salina Journal �� f;��} r ( , 1955 ) AN ORDINANCE retifying and confirming a contract with Brown & Brown , Inc., for the construc- tion of certain paving and grading improvements on certain streets in the City of Salina, Kansas, and providing for the issuance of temporary notes to pay the cost thereof pending the issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas; Section 1. That the acceptance by the City of Salina, Kansas, of the proposal of the i Brown & Brown Construction Co., Inc., hereinafter referred to as the "Contractor" as submi.ttedj ato the Board of Commissioners on October 11, 1955, which is hereby found to be the lowest and I best bid for such work, and the contract awarded by the Board of Commissioners of said City to said contractor and signed on behalf of the City by its Mayor on October 18, 1955, for the construction of certain public improvements in the City of Salina, Kansas, to -wit; Paving and grading of Ellsworth Avenue (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the east side of Roach Street to the west side B ' of Lewis Avenue, by Resolution Number 1586 and Ordinance Number 5995• Paving and grading of Illinois Street with two (2) inch hot asphalt mix over six inch rock base, from the east line of Merrill Street to the west line of Sheridan i Street, by Resolution Number 1582 and Ordinance Number j 5995. i Paving and grading of Lewis Street with two (2) inch i hot asphalt mix over six ) inch rock base, from the south line of Jewell Avenue to the North line of Kirwin Avenue, by Resolution Number 1585 and Ordinance Number 5995. Paving and grading of Phillips Street (twenty-eight (28) feet wide toe of gutter to toe of gutter) with two (2) j inch hot asphalt mix over six (6) inch gushed rock base, I from the north line of Crawford Avenue to the south line of Charles street, by Resolution Number 1593 and Ordi- nance Number 5995. j i i jat and for the unit price for said work contained in said proposal, which proposal and contract dare hereby referred to and made parts of this ordinance, be and the same is hereby ratified l and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer on file in the Office of the City Clerk, which esti- mates are are hereby referred to and made a part of this ordinance. � I Section 2. Said improvements shall be built and constructed in accordance with the plangI land specifications therefore prepared by the City Engineer on file in the office of the City I Clerk and in accordance with the proposal of said eontradbDr and under the terms of said con- I (tract, all of which are hereby referred to and made parts of this ordinance. Section 3. That temporary notes signed by the Mayor and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the contractof rice 16 p $ ,94 7.70, for such work, such notes to bear interest not to exceed 4- per cent per annum and to mature not later than December 1, 1956, and to be issued in such amounts and at such time as money for the payment I i' of the cost of such notes being issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof. a Section 4. This ordinance shall take effect and be in force from and after its publi- cation once in the official city paper.
