Avenue; Curbing, guttering, paving and grading Kirwin Avenue with two-inch hot mix asphalt
over a six-inch crushed rock base twenty-eight (2 feet wide from toe of gutter to toe of
gutter from the east line of Lewis Avenue to the west line of Ohio Street; Paving and grading
Kirwin Avenue with two-inch hot mixed asphaltic concrete over a six-inch rock stabilized base,
from east side of Roach Street to west side of Lewis Avenue; Paving and grading Kansas Avenue
with two-inch hot mixed asphaltic concrete over a six-inch rock stabilized basq from the north
line of Ash Street to the south line of Elm Street;Paving and grading Lewis Avenue with two
inch hot mixed asphaltic concrete over a six-inch rock stabilized base to a width of twenty-
eight (28) feet from toe of gutter to toe of gutter, from the north line of Martin Avenue to I
the south line of McAdams Road; Curbing, Guttering, Paving and grading Redwood Drive with two;
inch hot mixed asphaltic concrete over a six-inch rock stabilized base, from the west line of
Cherokee Drive to the east lin a of Willow Court; and relating to and providing for the toll -I
ection and payment of such assessments. I
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas;
Section 1. For the purpose of paying for that part of the cost of improvements in cer-
tain portions of certain streets as hereinafter set forth in the following sections of this
I
ordinance which is chargeable to the private property in the assessment district for such
improvements as set forth in the following sections of this ordinance with respect to such
improvements there are hereby levied, and assessed on the property liable therefore, being
I
all the lots and pieces of ground lying on either side of said street so improved, to the
i
middle of the block for the distance improved, with respect to the improvements mentioned in
I
Sections 2, 3, 4, 5) 6, 7, and 8 of this ordinance, according to the appraised value of such I
Ilots and pieces of ground with respect to such improvements, without regard to the buildings
or improvements thereon, special assessments covering the cost of such work and improvements,
said special assessments being based on the special valuation and appraisement of said lots
and pieces of ground heretofore made by three disinterested appraisers appdnted by the Board ; j
of Commissioners of the City of Salina, Kansas, with respect to such improvements, which said

9 appraisement is hereby referred to and made a part of this ordinance, and the several amounts i
so levied, apportioned and assessed against the lots and pieces of ground for such improve-
ment, for the purpose aforesaid, are hereby found and determined to be the amounts set forth

Section 9. Said amounts so levied, apportioned and assessed as aforesaid shall be due
and collectible in ten equal installments, the first becoming due with the taxes levied for
the year 1956, and one of said installments falling due each and every year thereafter until
all are paid, and all to be collected with interest as in this ordinance PROVIDED, HOWEVER,
that the owner of any piece or pieces of property liable for any such assessment may redeem I
his property from such liability by paying into the City Treasury the entire amount charge-
able against the same, as in this ordinance designated, at any time within thirty days after j
I
the publication of this ordinance and before the issuance of bonds of said city in payment j
of the balance of the cost of said improvements, the property so paid on shall not thereafter
s
I
be liable for any further assessments for the cost of said improvements nor for any part of
I
said bonds.
i
Section 10. There is hereby levied further and assessed against such lots and pieces
I
of ground described in this ordinance, interest at such rate per annum as shall be borne by

the bonds hereafter to be issued for the a
p yment of the remaining unpaid cost of such im-
provements to be hereafter determined and fixed by ordinance when such bonds are issued,
on all of said installments mentioned and provided for in this ordinance, from the date of I
the bonds which may be issued at the end of thirty days as specified in the preceeding sec-
tions hereof, as by law provided, to the time of the collection of the installment as provided
y
by law, which said interest shall be collected annually at the same time and in the same I
[i
manner as said installments are collected and after the taking effect of this ordinance and
the fixing of the said interest rate when such bonds are authorized and issued, it shall be
the duty of the City Clerk of said City to annually at the same time other taxes are certified
and until all of said assessments so apportioned and levied have been certified to the County;
Clerk of Saline County, Kansas, a full list of all property liable to assessment and taxation'
for such work and improvement except such property on which the special assessments aforesaid'

1 have been paid in full as hereinbefore provided, together with the respective amounts due on
each of such lots and pieces of ground which amounts shall include the annual installments of
i
such special assessments together with the interest for one year at the rate to be fixed as '
I provided for in this ordinance, on all unpaid balances of such assessments, and such amounts j
so certified as herein provided shall be placed upon the tax roll by the County Clerk of
i
Saline County, Kansas, and collected as other taxes are collected.
Section 11. This ordinance shall take effect and be in force from and after its
adoption and publication once in the official city paper.
