5990 Utility Improvements1 1 ORDINANCE NUMBER 5990 7 (Published in the Salina Journal ,'-'_� 1..yti��r , 1955) AN ORDINANCE creating and defining a certain lateral sanitary sewer district in the city of { Salina, Kansas, designated as Lateral Sanitary Sewer District Number 326 and providing for the construction of a lateral sanitary sewer in said Lateral Sanitary Sewer District Number 326, so created, and providing for the payment of the cost thereof and for the levying of 1 special assessments against the property in said district for the payment of the cost of such construction and for the issuing of bonds to pay the cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. Lateral Sanitary Sewer District Number 326. That there be and there is hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 326 and which district shall include all the following described property in the City of Salina, Kansas, to -wit: Benefit District: Kenwood Park. Section 2. It is necessary and it is hereby ordered that an eight -inch V. C. P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appurten- ances be constructedand built in and to serve said Lateral Sanitary Sewer District Number 326 as created by Section 1 of this ordinance along the following course, to -wit: Branch No. 1 -An eight -inch clay pipe sewer begining at an XxtRtIM manhole to be constructed on an 8 inch clay sewer stub, 5 feet west of the west curb on Front Street, 135 feet north of the center line of Prescott Avenue, at a bearing of North 70 East for 280 feet to a manhole to be constructed 35 feet south of south curb on Center Street; thence crossing Center Street at a bearing of North 500 301 East for 670 feet, corssing Kenwood Drive, to a manhole to be constructed east of east curb on Kenwood Drive; thence at a bearing of North 180 East to a manhole to be constructed; thence along east curb of Kenwood Drive at a bearing of North 430 30t East for 400 feet to manhole to be constructed; thence at a bear- ing of North 510 30t East for 580 feet to a manhole to be constructed, corssing street (Oakdale extended) 80 feet west of manhole; Branch No. 2 -Beginning at a man- hole to be constructed 290 feet west of final manhole of Lateral No. 326 Branch 1 at a bearing of South 540 Eastfbr 487 feet, crossing street to manhole; Branch 27BraNo. 3 -Beginning at final manhole of Lateral No. _327- Branch nch 2, at a bearing of North 470 East for 290 feet to a manhole to be constructed; thence at a bearing of North 240 30t East for 360 feet to a manhole to be con- structed; thence at a bearing of North 670 East for 100 feet to a manhole to be constructed which will be term- inus of Lateral 326. Section 3. That the City Engineer shall on or before September 27th., 1955, prepare and file in the office of the Qty Clerk, plans and specifications for the construction of the lateral sanitary sewer provided for in the proceeding sections of this ordinance which shall I be of the proper character to serve the property lying within the district for which such i sewer is to be constructed and shall on or before the same date prepare and submit to the I Board of Commissioners a detailed estimate under oath of the cost thereof. That thereafter the City Clerk shall advertise for three consecutive days in the official city paper for saled proposals for the building and construction of such a sewer according to such plans and specifications, which proposals shall be filed with City Clerk on or before the time fixed' in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such sewer to the lowest and best responsible bidder or bidders therefore, i if there be any whose bids do not exceed the estimated cost thereof, but said Board shall i reserve the right to reject any or all such proposals, and if not bids shall be received within such estimate, the Board of Commissioners diall have the power to do such work and make such improvements within the estimated cost thereof as provided by law. Section 4. That for the cost of building and construction of such sewer, special assessments shall be made for the full cost thereof on all lots and pieces land within and for which such sewer shall be built, according to the appraised value thereof, without regard to the buildings or improvements thereon. Section 5. After the passage and publication of this ordinance, the Board of Commiss- ioners shall appoint three distinterested appraisers, who after having taken oath to make a true and impartial appraisement of all lots and pieces of land liable to taxation for the cost of such improvements, shall within five days after having been notified of their appoint= ments proceed to appraise all of the lots and pieces of land within the district liable to assessment and taxation as aforesaid, without the regard to the buildings or improvements thereon, and after making such appraisements, shall return to the Board of Commissioners of a said city and said Board shall designate a time for a special meeting of said Board for the i purpose of hearing any complaints that may be made as to the value of any lot or piece of u land appraised as aforesaid, of which special session due notice shall be given in the offi- cial city paper, at which special session said Board may alter any valuation of any lot or E i I piece of land, if, in their opinion, the same has been appraised too high or too low. I Section 6. The special assessment herein provided for may be paid by the person liable therefore in four approzimately equal annual installments but the owner of any property liable to such assessment may within thirty days from the date of determining the amount j assessed against the property, pay the same in full and his property so paid on shall not be liable for any assessments for the cost of such improvements, and bonds as hereinafter pro- vided for shall be issued in an amount of the cost of such improvements remaining unpaid at the end of thirty days from the time such assessment is fixed. Section 7. For the purpose of paying for the work and improvements in this ordinance provided for, the Board of Commissioners may and are hereby authorized and directed to issue gq improvement bonds of the City of Salina, Kansas, on an amount not to exceed the total cost fi of such improvement, and to run for a period of four years and be payable in four approxi- mately equal annual installments, together with interest not to exceed five per cent per annum, which bonds shall be issued and payable according to law; and for the purpose of paying the principal and interest on said bonds as they severally become due and payable the Board ii of Commissioners shall apportion and assess against the lots and pieces of land within the 4 taxing district of such improvements, special assessments covering the cost of such improve- ment and apportionment therein contained shall hold good for all of the installments th6t are to be collected from the specific property chargeable therefore, with such improvements; such assessment and apportionment ordinance shall contain the total amount of tax apportioned to h such tract, piece or parcel of land within the taxing district and shall state the number of i annual installments in which such tax is to be collected; and thereafter the City Clerk shall i annually, at the same time that other taxes are certified, certify to the County Clerk of { Saline County, Kansas, a full list of all property liable for such work and improvement, to-gether with the respective numbered amounts due on each of said tracts, pieces or parcels of land, which amounts shall include the annual installments and interest on all unpaid bal- 1 ances for one year at the rate of not to exceed five per cent per annum on such amounts so certified, which amounts shall be collected as other taxes are collected. Section 8. This ordinance shall take effect and be in force from and after its publi- cation once in the official city paper.
