5988 Authorize ContractORDINANCE NUMBER ?5988 (Published in the Salina Journal 1955 ) AN ORDINANCE ratifying and confirming a contract with Brown & Brown, Inc., for the construe - tion of certain curb, gutter, paving and grading improvements on certain streets in the City j of Salina, and providing for the issuance of temporary noteSto pay the cost thereof pending the issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina, Kansas, of the proposal of the Borwn & Brown Construction Co., Inc., hereinafter referred to as the "Contractor" as y submitted to the Board of Commissioners on August 16, 1955, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said City to said contractor and signed on behalf of the City by its Mayor on August 23, 1955,; for the construction of certain public improvements in the City of Salina, Kansas, to -wit: Paving and grading of Charles Street (twenty-eight (28) i n feet wide from toe of gutter to toe of gutter) with two (2) inch hot asphalt mix over six (6) inch rock base, from the west line of Eleventh Street to the east line of Twelfth Street, by Resolution Number 1571 and Ordi- nance Number 5982. Paving and grading of Claflin Avenue (to a width of twenty-eight (28) feet from toe of gutter to toe of gutter) with two (2) inches hot asphalt mix and six (6) inches crushed rock base, from the east line of Roach Street to the west line of Lewis Street, by Resolution Number 1542 and Ordinance Number 5982. i Paving and grading of Fairview Street (to a width of d twenty-eight (28) feet from toe of gutter to toe of gutter) with crushed rock base and two (2) inch hot asphalt mix f from the east line of Sherman Street to the west line of Eleventh Street, by Resolution Number 1540 and Ordinance Number 5982• Paving and grading of Illinois Street (twenty-eight (28) feet wide from toe of gutter to toe of gutter) with two (2) inch hot asphalt mix over six (6) inch rock base, from the east line of Merrill Street to the east line of Hancock Street, by Resolution Number 1570 and Ordinance Number 5982. j Paving and grading of Roach Street with two (2) inch k hot mix asphalt over a ­six ( inch rock base, from the e north line of Kirwin Avenue to the south line of Claflin Avenue, by Resolution Number 1563 and Ordinance Number 5982. Paving and grading of Tenth Street with two (2) inch hot i asphalt with six (6) inch crushed rock base, from the south line of Antrim Avenue to the north line of Inez Avenue, by Resolution Number 1562 and Ordinance Number 5982. Paving and grading of U pper Mill Heights Drive, (twenty- seven (27) feet wide from back of header to back of header) j with two (2) inch hot asphalt on six (6) inch rock base, Q from Greeley Avenue to Greeley Avenue, by Resolution Number 1555 and Ordinance Number 5982• w' w Curbing, guttering, paving and grading of Willow Drive (thirty-three (33) feet back of curb to back of curb with two (2) inch hot asphalt over six (6) inch rock base, from a line on the south line of Willow Court extended across Willow Drive to a line crossing Willow Drive from the southeast corner of Lot 45, Block 6, Edgemere Addition to the southwest corner of Lot 13, Block 5, Edgemere Addition, by Resolution Number 1569 and Ordinance Number 5982. - at and for the unit price for said work contained in said proposal, which proposal and con- tract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by thesworn edimates of the City Engineer on file in the Office of the City Clerk, which estimates are hereby referred to and made a part of this ordinance. Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefore prepared by the City Engineer on file in the office of i the City Clerk and in accordnace with the proposal of said contractor and under the terms i of said contract, all of which are hereby referred to and made parts of this ordinance. i Section 3. That temporary notes signed by the Mayor and attested by the City Clerk f be issued from time to time as the work progresses in the manner and form as required by P law, the total amount thereof not to exceed the contract price of $90,545.40, for such work, such notes to bear interest not to exceed 42 per cent per annum and to mature not later than December 1, 1956, and to be issued in such amounts and at such time as money for the payment of the cost of such notes being issued to said contractor and to be redeemed and cancelled j at the time that permanent bends are issued in lieu thereof.
