5987 Levy AssessmentsORDINANCE NUMBER 5987 (Published in the Salina Journal 1955) , AN ORDINANCE relating to and apportioning and levying special assessments on certain lots and pieces of ground in the City of Salina, Kansas, to pay the cost of curbing, guttering and grading of Beatrice Avenue from the center line of Martin Avenue to the center line of McAdams) Road; of Cloud Street on the north side from the center line of Pershing Avenue to the center line of Broadway Boulevard and on the south side from the center line of Ninth Street to the center line of Broadway Boulevard; of Gypsum Avenue on the north side from the center line of Indiana Avenue to the center line of Iowa Avenue and on the south side from the center) line of Missouri Avenue to the center line of Iowa Avenue; of the south side of Haven Avenue! from the center line of Steahlin Avenue to the center line of Whittinghill Avenue; of the south side of Haven Avenue from the center line of Whittinghill Avenue to the center line of Viemont Avenue; of Lewis Avenue from the center line of Martin Avenue to the center line of McAdams Road; of McAdams Road from the center line of Pearl Avenue to the center line of Lewis Avenue; of north side of Martin Avenue from the west line of Lewis Avenue to the center line of Ohio Street; of Missouri Avenue from the center line of Stack Place to the center line of Greeley Avenue; of east side of Roach Street from the center line of Jewell Avenue to the center line of Kirwin Avenue; of south side of Republic Avenue from the east line of U.S. Highway No. 81, thence east to the east line of the Missouri Pacific Railroad right-of-way, and the north side of Republic Avenue from the west line of Hancock Street, thence west to a point 216 feet west of the east right-of-way line of the Missouri Pacific Railroad; of Steahlin Avenue from the center line of Crawford Avenue tcs the center line of Haven Avenue; of Viemont Avenue from the center line of Crawford Avenue to the center line of Haven Avenue; of Whittinghill Avenue from the center line of Crawford Avenue to the center line of Haven Avenue, and relating to and providing for the collection and payment of such assessments. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. For that purpose of paying for that part of the cost of improving certain portions of certain streets as hereinafter set forth in the following sections of this ordi- nance which is chargeable to the private property in the assessment district for each of such simprovements, respectively, as set forth in the following sections of this ordinance with a respect to each of such improvements, there are hereby levied and assessed on the property j I liable therefore, being all the lots and pieces of ground lying on either side of said streetsil so improved, respectively, to the middle of the block for the distance improved, with respect to the improvements mentioned in Sections 2, 3, 4, 5, 6, 7, 8, 9, 101 11, 12, 13, 14, and 15 of this ordinance, according to the appraised value of such lots and pieces of ground with i, 9 respect to each of such improvements, without regard to the buildings or improvements thereon, special assessments covering the cost of such work and improvements, and special assessments d being based on the special valuation and appraisement of said lots and pieces of ground here- tofore made by three disinterested appraisers appointed by the Board of Commissioners of the i City of Salina, Kansas, with respect to each of such improvements, which said appraisements are herebyreferred to and made parts of this ordinance, and the several amounts levied, { apportioned and assessed against the lots and pieces of ground for each of such improvements, 3 respectively, for the purpose aforesaid are hereby found and determined to be the amounts set forth in the following sections of this ordinance with respect to each of such improvements. q Section 2. Said amounts levied, apportioned and assessed aforesaid will be due and collectible in four equal annual installments, the first becoming due with the taxes for the year 1956 and one of said installments falling due each and every year thereafter until all are paid, and all to be collected with interest as in this ordinance PROVIDED, HOWEVER, that the owner of any piece of property liable for any such assessment may redeem his property from such liability by paying into the City Treasury the entire amount chargeable against the same as in this ordinance designated at any time within thirty days from the publication of this ordinance and before the issuance of bonds of said city in payment of the balance of the cost of said improvements, and the property so paid on shall not thereafter be liable for any further assessments for the cost of said improvements nor for any part of said bonds. Section 17. There is hereby further levied and assessed against each lot and piece of ground described in this ordinance, interest at such rate per annum as shall be borne by the bonds hereafter to be issued for the payment of the remaining cost of such improvements, to be hereafter determined and fixed by ordinance when such bonds are issued, on all of said installments mentioned and provided for in this ordinance, from the date of the bonds which may be issued at the end of thirty days as specified in the preceding sections hereof, as by law provided, to the time of the collection of the last installment, as provided by law,which said interest shall be collected annually at the same time and in the same manner as said installments are collected, and after the taking effect of this ordinance, the fixing of said interest rate when such bonds are authorized and issued, it shall be the duty of the City Clerk of said City to annually at the some time other taxes are certified and until all of said assessments so apportioned and levied therein have been certified, to certify to the i County Clerk of Saline County, Kansas, a full list of all property on which the special assessment and taxation for such work and improvments is chargeable, except such property such on which the special assessments aforesaid have been paid in full as hereinbefore pro- vided, together with the respective amounts due oneach of such lots and pieces of ground, which amounts shall include the annual installments of such special assessments together with the interest for one year at the rate to be fixed as provided for in this ordinance, on all I unpaid balances of such assessments, and such amounts so certified as herein provided for (SEAL) Attest: City Clerk 1 1 Introduced: August 9, 1955 Passed: August 16, 1955 Acting Mayor
