5980 Annexation1 j I ORDINANCE NUMBER 5980 (First Published in the SALINA JOURNAL/-�-' , (;�.-,; l 1955 ) i AN ORDINANCE providing for the inclusion of certain land within the corporate limits of the City of Salina, Kansas, prescribing the corporatelimits of said city and repealing Section 5 of Ordinance Number 5834• WHEREAS, all conditions precedent to the inclusion of certain land in the City of Salina, Kansas, have come to pass, AND NOW, 9 BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That certain tract of land adjoining the corporate limits of the City of a Salina, which land has been platted into lots and blocks and is known as St. Mary's Addition, and is legally described as follows: All that part of the Northeast Quarter (NE/4) of the Northwest Quarter (NW/4) of Section Twenty-five (25), Township Fourteen (14) South, Range Three (3) West of the Sixth Principal Meridian in Saline County, Kansas, lying east of the right of way of the Union Pacific Railroad, containing in all acres, more or less; be and the same is hereby incorporated within the limits of the said City. P Section 2. That a certain tract of land adjoining the corporate limits of the City of Salina, which land is platted into lots and blocks and is known as Southern View Addition, and is legally described as follows: The Northwest Quarter (NW/4) of the Northeast Quarter (NE/4) of Section Twenty-five (25), Township Fourteen (14) South, Range Three (3) West of the Sixth Principal Meridian; and the North 330 feet of the Southwest Quarter (SW/4) of the Northeast Quarter (NE/4) of Section Twenty-five (25), Township Fourteen (14) South, Range Three (3) West of the Sixth Principal Meridian in Saline County, Kansas; excepting a tract of land described as follows: Beginning at the Northeast corner of the Northwest Quarter (NW/4) of the Northeast Quarter (NE/4) of said Section, thence west 440 feet; thence south 990 feet; thence east 4h0, feet; thence north 990 feet to the point of beginning; the said tract first described above containing in all acres more or less; be and the same is hereby incorporated within the limits of the said City,. Section 3. That a certain tract of land adjoining the corporate limits of the City of Salina and forming a part of Section Twenty-five (25), Township Fourteen (14) South, Range Three (3) West of the Sixth Principal Meridian in Saline County, Kansas, so that over two thirds (2/3) of one boundary thereof adjoins the existing corporate limits of the City of Salina, and containing not more than twenty (20) acres and legally described as follows: Beginning at a point 978.8 feet west of the Southeast corner of the Northeast Quarter (NE/4) of the Northwest Quarter (NW/4) of Section Twenty-five (25), Township Fourteen (14) South, Range Three (3) West of the Sixth Principal Meridian, thence west 100 feet; thence north 1320 feet; thence east 100 feet; thence south 1320 feet; to the point of beginning, containing acres, more or less; be and it is hereby incorporated within the limits of the said City, so that the boundary line of said City will be straight and harmonious. Section 4. That a certain tract of land adjoining the corporate limits of the City of Salina so that two thirds (2/3) of one boundary thereof adjoins the existing corporate limits and containing not more than twenty (20) acres, being a part of Section Fourteen (14) 1 jTownship Fourteen (14) South, Range Three (3) West of the Sixth Prinipal Meridian in Saline !County, Kansas, described as follows; Beginning at the northeast corner of West Haven Addi- tion, thence east a distance of 355 feet; thence south a distance of 622.44 feet; thence west ?a distance of 355 feet; thence north a distance of 622.44 feet to the place of beginning; be and the same is hereby incorporated within the limits of said city so that the boundary line of said City will be straight and harmonious. Section 5. That a certain tract of land adjoining the corporate limits of the City of Salina, which land has been platted into lots and blocks beginning at the Northwest corner of Eisenhower Addition to the City of Salina, thence North a distance of 622.44 feet thence east <a distance of 1131 feet; thence south a distance of 622.44 feet; thence west a distance of ' 1131 feet to the point of beginning; containing in all approximately acres; be and the same is hereby incorporated within the limits of the said City. Section 6. That the corporate limits of the City of Salina be and the same are hereby extended to include the territory added to, taken into, and made parts of said City under the provisions of the preceding sections of this Ordinance; and that all of the land lying within the following described boundaries be and the same is hereby declared to be within the cor- porate limits are hereby defined as; Commencing at a point on the center line of Ninth Street extended south, 770 feet south of the intersection of the center line of Ninth Street, with the center line of Cloud Avenue, said intersection being the corner common to Section 23, 24, 25, 26, Township 14 South, Range 3 west of the Sixth Principal Meridian in Saline County, Kansas, thence west to a point on the northeast right-of-way line of U.S. 81 Highway By -Pass which point is 750 feet due south of the north line of said Section 25, thence north westerly along the northeast right-of-way line of U.S. 81 By -Pass, to the intersection of said right-of-way line with the west Boundary of Rush Street extended;thence north to the northwest corner of Park View Addition to said city; thence west along the south line of Highland Court Addition to the southwest corner of said addition; thence north to the center line of Jewell Avenue, thence west 2700 feet to the west line of Section 23, Town- ship 14, south, Range 3 west of the Sixth Principal Meridian, thence north 1280 feet to the northwest corner of the southwest quarter of Section 23, Township 14 South, Range 3 west of the Sixth Principal Meridian; thence west 993.3 feet, thence north 2640 feet to a point on the north line of SectJm 22, township 14 South, Range 3 west of the Sixth Principal Meridian, thence east 993.3 feet to the northwest corner of Section 23, Township 141 South, Range 3 west of the Sixth Principal Meridian, thence north 1242.44 feet; thence east 1417 feet to a point 165 feet west of the west right-of- way of U.S. 81 By -Pass; thence north parallel to the west right-of-way line of U.S. 81 By -Pass to a point on the center line of Walnut Street 165 feet west of the west right-of-way line of U.S. 81 By -Pass; thence west along the center line of Walnut Street to the center line of Dry Creek, thence in a northerly direction down the center of Dry Creek to the intersection of the center line of said creek with the center line of the channel of the Dry Creek cut-off channel as now established, being the first point of intersection of said lines lying north of Walnut Street, thence north along the center line of the channel of said Dry Creek cut-off channel as now established to its next intersection with the center line of Dry Creek as originally existing; thence down the center line of the chanmi of Dry Creek as originally existing to the point of intersection of said line with the center line of the channel of Dry Creek cut-off channel as now estab- lished; being the first point of intersection of said lines lying north of the main line right-of-way of the Union Pacific Railroad and lying adjacent to Block 10 in Chicago Addition; thence northeasterly down the center line of the channel of the Dry Creek cut-off channel as now estab- lished to the next intersection of said line with the center line of Dry Creek; thence down the center line of Dry Creek as originally existing to its intersection with the west line of Pacific Addition, being the west line of the northwest quarter of the northeast quarter of Section 11, Town- ship 14, Range 3, thence north along Ad line to the northline of said Section 11, thence east along said line of Pacific Avenue to the intersec- tion of said line of pacific to the intersection of said line with the southwesterly line, extended southeasterly of Lots 1, 3, and 5 of Block 32 in Military Addition, thence northeasterly along said line and along the west line of Lots 7 and 9 in said Block 32, being the westerly boundary of said Block 32 in Military Addition, to the northwest quarter I of said Lot 9 in Block 32, thence due west 40 feet to a point; thence north 395 feet, more or less, to a point in the center of the original channel of Dry Creek (as heretofore existed) thence northerly and westerly up the center of the original channel of Dry Creek to its intersection with the north line of the south half of the northeast quarter of said Section 2;
