WHEREAS, pursuant to proceedings duly had according to law, contracts have been let and per- formed for the construction of the following street improvements to the City of Salina, Kansas to -wit: Curbing, guttering and paving with concrete, J3 feet wide back of curb to back of curb, Chicago Street from the center line of Broadway Boulevard to the north Right- of-way of the Union Pacific Railroad, as provided for by Resolution Number 1535 and Ordinance Number 5965• Curbing, guttering, paving and grading to a width of Twenty- eight (28) feet, toe of gutter to toe of gutter, Connecticut Avenue from the north line of Stack Avenue to the north line of Greeley, as provided for by Resolution Number 1521 and Ordinance Number 5965. Resurfacing of Iron Avenue with two (2) inch hot asphaltic Concrete from the eatt line of College Avenue to the west line of Ninth Street, as provided for by Resolution Number 1649 and Ordinance Number 6048. jWHEREAS, the total cost of said improvements has been ascertained and the portion thereof in ;the amount of $145,009.84 to be paid by general taxes to be levied upon all taxable property landsaid city for the improvement of squares and areas formed by the crossing of street land alleys and for the improvement of any of said streets, where the same Is through or adjacent to property of the city for which the city is liable, and of which amount the sum of $39,041.43' jhas been paid in cash, leaving a balance of $105,968.41 for which bonds are to be issued; and WHEREAS, thb total cost of said curbing, guttering, paving and grading of said streets, which fare to be paid by special assessments and to be levied upon lots and pieces of ground liable Ifor the payment of said curbing, guttering, paving and grading in said streets has been !ascertained and has been hereby found and determined to bh the sum of $449,602.30 which amount jhas been theretofore duly assessed and apportioned to the several lots and pieces of ground CONSOLID ATED-SALINA 1 1 liable therefor according to law provided for in the Ordinance of the City of Salina, Kansas, relating thereto, duly passed and approved of which amount the sum of $24,537.82 has been duly paid by the property owners liable therefor, leaving a balance of $425,064.48 for which bonds are to be issued; and i WHEREAS, bonds in the aggregate sum of $531,032.89 are to be issued to pay the actual cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas; Section 1. That the foregoing preambles be and they are hereby adopted as a part of thus ordinance and that for the purpose of providing funds to pay the cost of the improvements hereinabove referred to and described in the ordinances and resolutions of said city and hereinbefore referred to, there shall be issued Internal Improvement Bonds of the City of SalinI a, Kansas, in the total principal sum of $531,032.89, which shall consist of five hundred thirty- one, numbered 1 to 531, inclusive all dated November 11 1956, which shall bear interest at the rate of Three per cent 0%) per annum and from and after said date until the respective maturities of said bonds, payable semiannually on May 1, and November 1 in each year, said interest to be evidenced by interest coupons as herein provided for and said bonds shall become due as follows: Bonds Numbered 1 to 27 for $1,000.00 escept Bond Number 1 is for $1,032.89 due May 1, 1958. Said bonds shall be signed by the Mayor and shall be atteated by the signature of the City Clerk and the corporate seal of the city shall be affixed thereto and said bonds shall have attached thereto interest coupons representing the interest thereon, which coupons shall be in the form provided by the law and shall bear the printed or lithographed facsimile signature of the Mayor and City Clerk of said city and said bonds and interest coupons shall be registered in the office of the City Clerk and in the office of the Auditor l' of State as required by law. Section 3. This bond is one of a series of 531 bonds of like date and tenor, excepting denomination, and maturity, aggregating the principal sum of $531,032.89 issued by the City of Salina, Kansas, for the purpose of paying the cost of constructing, curbing, guttering, paving and grading improvements in said city by the authority of and in full compliance with the provisions, restrictions and limitations of the constitution and laws of the State of Kansas, including Sections 10-101 to 10-127, 12-601 to 12-608, and 13-1011 and 13-1011x, all of the General Statutes of Kansas, 1949, and amendments thereto, and all other provisions of the laws of said state applicable thereto, and this bond and all other bonds of this series, and all interest thereon are to be paid by the City of Salina, Kansas. And it is hereby declardd and certified that all acts, conditions, and things required to be done and exist precedent to and in the issuance of this bond have been properly done and performed and do exist in due and regular form and manner as required by the constitution and laws of the State of Kansas, and that the total indebtedness of said city, including this series of bonds, does not exceed any constitutional or statutory limitation.
