ORDINANCE NUMBER 6106

AN ORDINANCE authorizing and providing for the issuance of Improvement Bonds of the City
of Salina, Kansas, in the sum of x;46,438 92 to pay the cost of improving certain Streets in
said city to be designated as Series P-171.
WHEREAS, pursuant to proceedings duly had according to law, contracts have been let and
performed for the construction of the following street improvements in the City of Salina,
Kansas, to --wit;
Curbing, guttering and grading of the North side of Crawford Avenue
from the center line of Whittinghill Avenue to the center line of
Viemont Avenue, as provided for by Resolution Number 1545 and
Ordinance Number 5966.
Curbing and guttering of the north side of Crawford Avenue,
from the center line of Steahlin Avenue to the center line of
Whittinghill Avenue, as provided for by Resolution Number 1534
and Ordinance Number 5966.
Curbing, guttering and grading of the north side of Claflin
Avenue from the center line of Lewis to bhe center line of
Ohio, as provided for by Resolution Number 1533 and Ordinance
Number 5966.
Curbing, guttering and grading of Duvall Avenue, from the
center line of Crawford Avenue to the center line of Haven
Avenue, as provided for by Resolution Number 1522 and Ordinance
Number 5966.
Curbing, guttering and grading of Lewis Avenue from the
center line of Jewell Avenue to the center line of Kirwi.n
Avenue, as provided for by Resolution Number 1512 and Ordinance
Number 5966.
Curbing, guttering, and grading of Mohawk Avenue from the
center line of Franklin Avenue to the north line of Lot 23,
Block 6, Sunset Manor Addition estended West, as provided
for by Resolution Number 1539 and Ordinance Number 5966.
Curbing, guttering and grading of Shawnee Avenue from the
center line of Franklin Avenue to the north line of Lot 7,
Block 2, Sunset Manor Addition, estended West, as provided
for by Resolution Number 1537 and Ordinance Number 5966.
Curbing, guttering and grading of Seminole Avenue from the center
line of Franklin Avenue to the North line of Lot 13, Block 4,
Sunset Manor Addition, extended West, as provided for by Resolution
Number 1538 and Ordinance Number 5966.
Curbing, and guttering , and grading of Franklin Street
from the center line of Shawnee Avenue to the center line
of Hancock Street, as provided for by Resolution Number 1578
and Ordinance Number 5996.
Curbing, guttering, and grading of Lewis Street, from the center
line of McAdams Road to the center line of Mellinger Street,
as provided for by Resolution Number 1584 and Ordinance Number 5996•
Curbing, guttering and grading of Mellinger Street, from the
east line of Roach Street to the west line of Ohio Street, as
provided for by Resolution Number 1583 and Ordinance Number
5996•
Curbing, guttering, and grading of Roach Streeter from the center line
of McAdams Road to the center line of Mellinger Drive, as provided
for by Resolution Number 1575 and Ordinance Number 5996.
Curbing, guttering and grading of the West side of Broadway Boulevard
beginning on the north directly east of the southeast corner of Banker's
Addition thence south 318.2 feet more or less to a point directly
east of the northeast corner of Block 8, Sunset Manor Addition, as
provided for by Resolution Number 1591 and Ordinance Number 5996•

Curbing, guttering and grading of the East side of South
Broddway Boulevard, from the north line of Armory Road
north 400 feet, as provided for by Resolution Number 1646
and Ordinance Number 6046.
Curbing, guttering, and grading of Lewis Avenue on the West
Side from the center line of Russell Avenue to the Center line
of Cloud Street; and the curbing, guttering and grading of Lewis
Avenue on the east side from a point 150 feet wouhh of the south
line of Russell Avenue to the center line of Cloud Street, as
provided for by Resolution Number 1631 and Ordinance Number 6046.
Curbing, guttering and grading of the west side of Ohio Street,
from the canter line of Kirwin Avenue to the center line of
Jewell Avenue, as provided for by Resolution Number 1648 and
Ordinance Number 6046.
Curbing, guttering and grading of the east sdde of Roach Street,
from the center line of Claflin Avenue to the center line of
Cloud Street, as provided for by Resolution Number 1630 and
Ordinance Number 6046.
Curbing, guttering and grading of Roach Street, from the
center line of Mellinger Drive to the center line of Manor
Road, as provided for by Resolution Number 1629 and Ordinance
Number 6046.
WHEREAS, the total cost of said improvements has been ascertained and the portion thereof
in the amount of $28,824.97 to be paid by the general taxes to be levied upon all taxable
property within said city for the improvement of squares and areas formed by the crossing
of streets and alleys and for the improvement of any of said streets where the same is through
or adjacent to properly of the city for which the city is liable, and for which bonds are to
be issued; and,
WHEREAS, the total cost of said curbing, guttering and grading of said streets, which are
to be paid by special assessments are to be levied upon lots and pieces of ground liable for
the payment of said curbing, guttering and grading in said street has been ascertained and
has been found and determined to be the sum of $22,688.87, which amount has been heretofore
duly assessed and apportioned to the several lots and pieces of ground liable therefor
according to law provided for in the ordinance of the City of Salina, Kansas, relating thereto,
duly passed and approved, of which amount the sum of $5,074.92 has been duly paid by the
properly owners liable therefor, leaving a balance of $17,613.95 for which bonds are to be
issued; and
WHEREAS, bonds in the aggregate sum of $46,438.92 are to be issued to pay the actual net
coat thereof.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas;
Section 1. That the foregoing preambles be and they are hereby adopted as a part of
this ordinance and that for the purpose of providing funds to pay the cost of the improvements
hereinabove referred to and described in the Ordinances and Resolutions hereinbefore referred
to, there shall be issued Internal Improvement Bonds of the City of Salina, Kansas in the
total principal sum of $46,438.92, which shall consist of Forty six bonds numbered 1 to 46,
inclusive, all dated November 1, 1956, all of which bonds shall bear interest at the rate of

evidenced by interest coupons as herein provided for and said bonds shall become due as

Section 2. Said bonds shall be signed by the Mayor and shall be attested by the
signature of the City Clerk and Corporate seal of the city shall be affixed thereto, and
said bonds shall have attached thereto interest coupons representing the interest thereon,
which coupons shall be in the form provided by law and shall bear the printed or lithographed
facsimile signature of the Mayor and City Clerk of said city and said bonds and interest
coupons shall be registered in the office of the City Clerk and in the office of the Auditor
of State, as required by law.
Section 3. Said bonds shall be designated as Series P-171 and shall be in the form
and shall contain recitals substantially as follows:

KNOW ALL MEN BY THESE PRESENTS, that the City of Salina, in the Countyo of Saline, State of
Kansas, acknowledges itself to be indebted and for value received hereby promises to pay to
the bearer the sum of DOLLARS in lawful money of the United
States of America, on the first day of , 19 , with interest thereon
from the date hereof at the rate of Three 3 per cent per annum]
payable semiannually on May 1, and November 1 in each year, on presentation and surrender
of the coupons hereto attached both principal of and interest on this bond being payable at
the office of the State Treasurer of the State of Kansas, in the City of Topeka, Kansas,
and said City of Salina, Kansas, is held and firmly bound by these presents and the full
faith, credit and resources of said city and hereby irrevocably pledged for the payment of
said principal and interest at maturity.
This bond is one of a series of 46 bonds of like date and tenor, excepting denomination, and.
maturity, aggregating the principal sum of $46,438.92, issued by the City of Salina,Kansas,
for the purpose of paying the cost of constructing certain curbing, guttering and grading
improvements in said city by the authority of and in full compliance with the provisions,
restrictions and limitations of the constitution of and the laws of the State of Kansas,
including Section 10-101 to 10-127, 12-601 to 12-608 and 13-1011 and 13-1011a, all of the
General Statutes of Kansas, 1949, and amendments thereto, and all other provisions of the
laws of said state app3.icable thereto, and this bond and all other bonds of this series,
and all interest thereon are to be paid by the City of Salina, Kansas.
And it is hereby declared and certified that all acts, conditions, and things required to
be done and to exist precedent to and in the issuance of this bond have been properly done
and performed and do exist in due and regular form and used as required by the constitution
and laws of the State of Kansas and that the total indebtedness of said city, including this
series of bonds, does not exceed any constitutional or statutory limitation.
IN WITNESS WHEREOF, the said City of Salina, Kansas, has executed this bond by causing it
to be signed by its Mayor and its corporate seal to be heretoa affixed, attested by its City
Clerk and the coupons hereto attached to be signed with the facsimile signatures of said
officers, and this bond to be dated the first day bf November 1956.

execute the bonds hereinbefore described and to advertise and sell the same in the manner

purchasers thereof.

Section 5. The full faith, credit and resources of the City of Salina, Kansas, shall

be and the same are hereby irrevocable pledged for the prompt payment of said bonds and all
interest thereon. The Board of Commissioners of the City of Salina, Kansas, shall annually
make provision for the payment of the principal and interest on said bonds as they severally
become due by levying taxes and assessments upon the property liable therefor as provided
by law.
Section o_ This ordinance shall take effect and be in force from and after the
publication once in the official City Paper.
