6104 Authorize ContractCONSOLIDATED-SALINA 1 1 L_J ORDINANCE NUMBER 6104 (Published in The Salina Journal 1956) III AN ORDINANCE ratifying and confirming a contract with Brown and Brown, Inc. for the construction of certain paving and grading improvements on certain streets in the City of Salina, Kansas and providing for the issuance of temporary notes to pay the cost thereof pending the issuance and sale Of bonds. ZE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina, Kansas, of the proposal of the Brown and Brown Construction Co., Inc. hereinafter referred to as the "Contractor" as submitted to the Board of Commissioners on October 30, 1956, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said City to said contractor and signed on behalf of the City by its Mayor on November 6, 1956, for the construction of certain public improvements in the City of Salina, Kansas, to -wit: Paving and grading of Ellsworth Avenue (twenty-eight (28) feet wide toe of gutter to toe of gutter) with two (2) inch hot asphalt mix over a six (6) inch rolled rock base, from the west line of Sunrise Drive to the east line of Norton Street, as provided for by Resolution Number 1733 and Ordinance 6096 Curbing, guttering, paving and grading of Morrison Avenue (thirty-three (33) feet wide back of curb to back of curb) with two (2) inch hot mix otter a six (6) inch crushed rock base, from the east line of Montrose to the west line of College Avenue,as provided for by Resolution Number 1726 and Ordinance 6096. Curbing, guttering, paving and grading of Twelfth Street (thirty-three (33) feet wide back of curb to back of curb) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the north line of Broadway Boulevard to the south line of Woodland Avenue, as provided for by Resolution Number 1724 and Ordinance 6096. Curbing, guttering, paving and grading of Twelfth Street (thirty-three (33) feet wide back of curb to back of curb) with two (2) inch hot asphalt mix over a six (6) inch rolled rock base, from the south line of Woodland Avenue to the north line of Pacific Avenue, as provided for by Resolution Number 1730 and Ordinance 6096. Curbing, guttering and paving of Woodland Avenue (thirty- three (33) feet wide back of curb to back of curb) with two (2) inch hot asphalt mix over a six (6) inch crushed rock Vase, from the west line of Broadway Boulevard to the west line of Twelfth Street, as provided for by Resolution Number 1723 and Ordinance 6096. Paving and grading of Antrim Avenue (twenty-eight (28) feet wide toe of gutter to toe of gutter) with two (2) inch hot asphalt mix over a six (6) inch rolled rock base,from the east line of Ninth Street to the west line of Eighth Street, as provided for by Resolution Number 1731 and Ordinance 6096. at and for the unit price for said work contained in said proposal, which proposal and cpntract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer on file in the Office of the City Clerk, which estimates are hereby referred to and made a part of this ordinance. CONSOLIDATED-SALINA 'I 1 Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefore prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract, all of which are hereby referred to and rade a part of this ordinance. Section 3• That temporary notes signed by the Mayor and attested by the City Clerk be ' issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the amount of $29,650.50, for such work, such notes to bear interest not to exceed 42 per cent per annum and to mature not later than December 1, 1 and to be issued in such amounts and at such time as moneyfor the 957 payment of the cost of such notes being issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof. Section 4.
