AN ORDINANCE creating and defining a certain lateril sanitary Sewer district in the City of
jSelina, Kansas, designated as Lateral Sanitary Sewer District Number 353 and providing for
the construction of a lateral sanitary sewer in said Lateral Sanitary Sewer District Number 353,
so created and providing for the payment of the cost thereof and for the -levying of special
assessments against the property in said district for the payment for the cost of such construction
and for the issuing of bonds to pay the cost thereof.
IBE IT ORDAINED BY the Board of Commissioners of the City of Salina, Kansas:

Section 1 Lateral Sanitary Sewer District Number 353. That there be and there is

;hereby created lateral sanitary sewer district in the City of Salina, Kansas, which shall be
;and it is hereby designated as Lateral Sanitary Sewer District Number 353 and which district
(shall include all the following described property in the City of Salina, Kansas, to -wit:
Benefit District: Oakdale Park, City of Salina, Kansas.
Section 2. It is necessary and it is hereby ordered that an eight -inch V.C.P. Lateral
Sanitary Sewer with all necessary connections, manholes, flushing tanks and other appurtenances)

The constructed and built in and to serve said Lateral Sanitary Sewer District Number 353 as
created by Section 1 of this ordinance along the following courst, to -wit:
An eight inch clay pipe sewer beginning at a pumping
station to be installed at the intersection of Oakdale
Drive and Oakdale Park Entrance; thence south west following
Oakdale Park Road 1468 feet where a manhole will be
constructed which terminates lateral Sanitary Sewer
Number 353•
i Section 3. That the City Engineer shall on or before the 13th Day of November 1956, prepare
and file in the office of the City Clerk, plans and specifications for the construction of the
I lateral sanitary sewer provided for in the preceeding sections of this ordinance which shall bei
of the proper character to serve the property lying within the district for which such sewer
is to be constructed and shall on or before the same date prepare and submit to the Board of
Commissioners a detailed estimate under oath of the cost thereof. That thereafter the City Clerk
shall advertise for three consecutive days in the official city paper for sealed proposals for
the building and conttruction of such a sewer according to such plans and specifications, which'
proposals shall be filed with City Clerk on or before the time fixed in such notice, at which
time the Board of Commissioners may let a contract for the building and construction of such
sewer to the lowest and best responsible bidder or bidders therefore, if there be any whose bids
do not exceed the estimated cost thereof, but said Board shall reserve the right to reflect
any or all such proposals, and if no bids shall be received with -in such estimate, the Board
1 of Commissioners shall have the power to do such work and make auch improvements within the
Iestimated cost thereof as provided by law.
�!f Section 4. That for the cost of building and construction of such sewer, special assessments

shall be made for the full cost thereof on all lots and pieces of land within and for which such
sewer shall be built, according to the appraised value thereof, without regard to the buildingsl.

Section 5. After the passage and publication of this ordinance, the Board of Commissioners
shall appd)ttt three disinterested appraisers, who after having taken oath to make a true and
impartial appraisement of all lots and pieces of land. liable to taxation for the cost of such
improvements shall within five days after: having been notified of thdair appointments
proceed to appraise all of the lots and pieces of land within the district liable to assessment
and taxation as aforesaid, without regard to the buildings or improvements thereon, and after
making such appraisements, shall return to the Board of Commissioners of said city and said
Board shall designate a time for a special meeting of said Board for the purpose of hearing any
ftmplaints that may be made as to the value of any lot or piece of land appraised as aforesaid,j
of which special session due notice shall be given in the official city paper, at which special,
session said Board may alter any valuation of any lot or piece of land, if, in their opinion,
the sante nas been appraised too high or too low.
Section b, The Special assessxpent herein provided for may be paid by the person liable'
therefore in ten approximately equal installments but the ewner of any property liable to such'
assessment may within thirty days from the date of determinsng the amount assessed against the
property, pay the same in full and his property so paid on shall not be liable for any assessments
for the cost of such improvements, and bonds as hereinafter provided for shall be issued in an
amouht of the cost of such improvements remaining unpaid at the end of thirty days from the time
such assessment is fixed.
Section 7. For the purpose of paying for the work and improvmments in this ordinance
provided for, the Board of Commissioners may and are hereby authorized and directed to issue
improvement bonds of the City of Salina, Kansas, on an amount phot to exceed the total cost
of such improvement, and to run for a period of ten years and be payable in ten approximately
equal annual installments, together with interest not to exceed five per cent per annum, which
bonds shall be issued and payable according to law; and for the purpose of paying the principal
and interest on said bonds as they severally become due and payable the Board of Commissioners
shall apportion and assess against the lands and pieces of land within the taxing district of
such improvements, special assessments covering the cost of such improvement and apportionment
therein contained shall hold good for all of the installments that are to be collected from the
specific property chargeable therefore, with such improvements; such assessment and apportionment
ordinance shall contain the total amount of tax apportioned to such tract, piece or parcel of
land within the taxing district and shall state the number of annual installments in which such
tax is to be collected; and thereafter the City Clerk shall annually, at the same time that other
taxes are certified, certify to the County Clerk of Saline County, Kansas, a full list of all
liable for such work and tnprovEmett , together with the respective numbered amounts
Idue on each of said tracts, pieces or parcels of land, which amounts shall include the annual
linstallments and interest on all unpaid balances for one year at the rate of not to exceed five
Iper cent per annym nn such amounts so certified, which amounts shall be collected as
