AN ORDINANCE relating to and apportioning and levying special assessments on certain lots and
pieces of ground in the City of Salina, Kansas, to pay the cost of paving and grading
Delaware Avenue with concrete (twenty-eight (28) feet wide toe of gutter to toe of gutter)
from the south line of Iron Avenue to the south line of Stapler Avenue; of paving and grading
Eleventh Street with concrete (twenty-eight (28) feet wide toe of gutter to toe of gutter)
from the north line of Lincoln Avenue to the south line of Grand Avenue; of curbing, guttering
and grading of the South Side of Haven Avenue from the center line of Duvall Avenue to the
center line of Steahlin Avenue; of paving and grading of Haven Avenue with concrete (twenty-
eight (28) feet wide toe of gutter to toe of gutter) from the east line of Duvall Avenue to
the west line of Steahlin Avenue; of paving and grading Johnstown Avenue with concrete (twenty'
eight (28) feet wide from toe of gutter to toe of gutter) from the east line of Columbia
Avenue to the east line of Kansas Avenue; of paving and grading Lincoln Avenue with concrete
(twenty-eight (28) feet wide from toe of gutter to toe of gutter) from the west line of
Twelfth Street to the east line of Thirteenth Street; of paving and grading McAdams Road with
concrete (twenty-eight(28) feet wide from toe of gutter to toe of gutter) from the east line
of Roach Street to the west line of Pearl Street; of paving and grading Roach Street with
concrete (twenty-eight (28) feet wide from toe of gutter to toe of gutter) from the north line
of Martin Avenue to the south line of Republic Avenue; of curbing, guttering, paving and
grading of Second Street with concrete (thirty-three (33) feet back of curb to back of curb)
from the north line of Crawford Avenue to the south line of Prescott Avenue; of curbing,
guttering, paving and grading of Eighth Street with concrete (thirty-three (33) feet back of
curb to back of curb) from the north line of Lincoln Avenue to the south line of Decatur
Avenue; of paving and grading Viemont Avenue (twenty-eight (28) feet wide from toe of gutter
to toe of gutter) with concrete, from the south line of Haven Avenue to the south line of
Beverly Drive; and relating to and providing for the collection and payment of such assess-
ments.
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF SALINA, KANSAS.
Section 1. For the purpose of paying for that part of the cost of improvements in
certain portions of certain streets as hereinafter set forth in the following section of this
ordinance which is chargeable to the private property in the assessment districts for each
of such improvements, respectively, as set forth in the following section of this ordinance
with respect to each of such improvements, there are hereby levied and assessed on the property
liable therefore, being all the lots and pieces of ground lying on either side of said street
so improved, respectively, to the middle of the block for the distance improved with respect
to the improvements mentioned in Sections 2, 3, 4p 51 6, 7, 81 9. 10, and 11 of this ordinance,
according to the appraised value of such lots and pieces of ground with respect to each such
improvement, without regard to the buildings or improvements thereon, special assessments
covering the cost of such work and improvements, said special assessments being based on the
special valuation and appraisement of said lots and pieces of ground heretofore made by three
disinterested appraisers appointed by the Board of Commissioners of the City of Salina, Kansasi
with respect to each such improvement, which said appraisements are hereby referred to and
made a part of this ordinance, and the several amounts so levied, apportioned and assessed
against the lots and pieces of ground for each such improvements, respectively, for the pur-
pose aforesaid, are hereby found and determined to be the amounts set forth in the following
sections of this ordinance with respect to each of said improvements.

Section 12. Said amounts so levied, apportioned and assessed as aforesaid will be due
and collectible in ten equal installments, the first becoming due with the taxes levied
for the year 1957, and one of said installments falling due each and every year thereafter
until all are paid and all to be collected with interest as in this ordinance provided,
PROVIDED, I3OWEVER, that the owner of any piece of property liable for any such assessmett
may redeem his property from such liability by paying to the City Treasury the entire amount
Icdargeable against the same, as in this ordinance provided, at any time within thirty days
!!) after the publication of this ordinance and before the issuance of bonds of said city in
payment of the balance of the cost of said improvements, the property so paid on shall not
hereafter be liable for any further assessments for the cost of said improvements nor for
any part of said bonds.
Section 13. There is hereby levied further and assessed against such lots and pieces of

Iground described in this ordinance, interest at such rate per annum as shall be borne by the

!bonds hereafter to be issued for the payment of the remaining unpaid cost of such improvements,

!to be hereafter determined and fixed by ordinance when such bonds are issued, on all of said

I!installments mentioned and provided for in this ordinance, from the date of the bonds which
may be issued at the end of thirty days as specified In the preceding sections
thereof, as by
lar provided, to the time of the collection of the installment as provided by law, which said
interest shall be collected annually at the same time and in the same manner as said install-
ments are collected and after the taking effect of this ordinance and the fixing of the said
interest rate when such bonds are authorized and issued, it shall be the duty of the City Clerk
of said City to annually at the same time other taxes are certified and until all of said
assessments so apportioned and levied have been certified to the County Clerk of Saline County,
Kansas, a full list of all property liable to assessment and taxation for such work and improve-

=meat, except such property on which the special assessments aforesaid have been paid in full as,

hereinbefore provided, together with the respective amounts due on each of said lots and

feces of ground which amounts shall include the annual installments of such special assess -
vents together with the interest for one year at the rate to be fixed as provided for in
his ordinance, on all unpaid balances of such assessments, and such amounts so certified as
herein provided shall be placed upon the tax roll by the County Clerk of Salina County, Kansas,
�nd collected as other taxes are collected.
Section 14. This ordinance shall take effect and be in force from and after its publi- �
cation once in the official city paper.
