AN ORDINANCE ratifying and confirming a contract with the 0. D. Wilmoth Construction Company
for the construction of certain curbing, guttering, paving and grading improvements on cer-
tain streets in the City of Salina, Kansas, and providing for the issuance of temporary notes
to pay the cost thereof pending the issuance and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the acceptance by the City of Salina, Kansas, of the proposal of the
0. D. Wilmoth Construction Company, hereinafter referred to as the "Contractor"as submitted
to the Board of Commissioners on August 7, 1956, which is hereby found to be the lowest and
best bid for such work, and the contract awarded by the Board of Commissioners of said city
to said contractor and signed on behalf of the City by its Mayor on August 14, 1956, for the
construction of certain public improvements in the City of Salina, Kansas, to -wit:
Paving and grading of Court Place, (twenty-eight (28)
feet wide toe of gutter to toe of gutter) with concrete
from the south line of Ellsworth Avenue to the south
line of Jewell Avenue, as provided for by Resolution
Number 1675 and Ordinance Number 6078.
Paving and grading of Cloud Street (twenty-eight (28)
feet wide from toe of gutter to toe of gutter) with
concrete from the east line of Ninth Street to the east
line of Highland Avenue, as provided by Resolution Num-
ber 1680 and Ordinance number 6078.
Paving and grading of Delaware Avenue, (twenty-eight (28)
feet wide toe of gutter to toe of gutter) with concrete
from the south line of Stack Avenue to the north line of
Greeley Avenue, as provided for by Resolution Number 1668
and Ordinance Number 6078.
Paving and grading of Ellsworth Avenue (twenty-eight (28)
feet wide from toe of gutter to toe of gutter) with con-
crete from the east line of Pershing Street to the east
line of Funston Street, as provided by Resolution Number
1676 and Ordinance Number 6078.
Paving and grading of Eighth Street (twenty-eight (28)
feet wide from toe of gutter to toe of gutter) with con-
crete from the north line of Decatur Street to the south
line of Grand Avenue, as provided for by Resolution Num-
ber 1708 and Ordinance Number 6078.
Paving and grading of Fourth Street (twenty-eight (28)
feet wide to e of gutter to toe of gutter) with concrete
from the south line of Cloud Avenue to the South line of
Leslie Street, as provided for by Resolution Number 1669

at and for the unit price for said work contained in said proposal, which proposal and con-
tractors hereby referred to and made parts of this ordinance, be and the same is hereby rati-
fied and confirmed, said proposal being within the estimated cost of said improvements as
shown estimates are hereby referred to and made a part of this ordinance.
Section 2. Said improvements shall be built and constructed in accordance with the plans
and specifications therefore prepared by the City Engineer on file in the office of the City
Clerk and in accordance with the proposal of said contractor and undee the terms of said con-
tract, all of which are hereby referred to and made parts of this ordinance.
Section 3. That temporary notes signed by the Mayor and attested by the City Clerk be
issued from time to time as the work progresses in the manner and form as required by law,
the total amount thereof not to exceed the amount of $172,390.00 for such work, such notes
to bear inteeest not to exceed 42 per cent per annum, and to mature not later than December
1, 1957, and to be issued in such amounts and at such time as money for the payment of the
cost of such notes being issued to said contractor and to be redeemed and cancelled at the
time that permanent bonds are issued in lieu thereof.
Section 4. This ordinance shall take effect and be in force from and after its adoption
and publication once in the official city paper.
