6083 Authorize Contract• f CONSOLIDATED-SALINA 1 I ORDINANCE NUMBER 6083 (Published in The Salina Journal���,�,,f� 1956) i AN ORDINANCE ratifying and confirming a contract with Brown and Brown, Inc. for the construc- tion of certain paving and grading improvements on certain streets in the City of Salina, Kansas, and providing for the issuance of temporary notes to pay the cost thereof pending the issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina, Kansas, of the proposal of the Brown & Brown Construction Co. Inc. hereinafter referred to as the "Contractor" as submitted to the Board of Commissioners on August 7, 1956, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said City to said contractor and signed on behalf of the City by its Mayor on August 14, 1956, for the construction of certain public improvements in the City of Salina, Kansas, to -wit: Curbing, guttering, paving and grading of Albert Avenue (thirty-three (33) feet wide back of curb to back of curb) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the east line of Quincy Street to the west line of Roach Street, as provided for by Resolution Number 1698 and Ordinance 6077- Paving and grading of Beatrice Avenue, (twenty-eight (28) feet wide from curb of gutter to curb of gutter) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the north line of Martin Avenue to the south line of McAdams Road, as provided for by Resolution Number 1674 and Ordinance Number 6077. Paving and grading of Beloit Avenue (twenty-eight (28) feet wide from toe of gutter to toe of gutter) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the west line of Quincy Street west 306 feet, as provided for by Resolution Number 1672 and Ordinance Number 6077. Curbing, guttering, paving and grading of Carl Avenue (thirty-three (33) feet wide back of curb to back of curb) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the east line of Quincy Street to the west line of Roach Street, as provided for by Resolu- tion Number 1697 and Ordinance Number 6077. Paving and grading of Charles Street (twenty-eight (28) feet wide from toe of gutter to toe of gutter) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the west line of Phillips Street to the east line of Twelfth Street, as provided for by Resolution Number 1714 and Ordinance Number 6077. Paving and grading of North Columbia Avenue (twenty-eight (28) feet wide from toe of gutter to toe of gutter) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the north line of Elm Street to the south line of Riverside Drive, as provided for by Resolution Number 1704 and Ordinance Number 6077. Paving and grading of South Third Street (twenty-eight (28) feet wide from toe of gutter to toe of gutter) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the north side of Crawford Avenue to the south line of Prescott Avenue, as provided for by Reso- lution Number 1706 and Ordinance Number 6077. Curbing, guttering and grading of McAdams Road, from the east line of Lewis Avenue to the west line of Ohio Street, as provided for by Resolution Number 1653 and Ordinance Number 6077. Curbing, guttering and grading of Guernsey Drive from the east line of Front Street to the east line of Prescott Road, as provided for by Resolution Number 1691 and Ordinance Number 6077. Curbing, guttering and grading of East Prescott Road, from the east line of Front Street to the north line of Guernsey Drive, as provided for by Resolution Number 1690 and Ordinance Number 6077. at and for the unit price for said work contained in said proposal, which proposal and con- tract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer on file in the Office of the City Clerk, which estimates are hereby referred to and made a part of this ordinance. Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefore prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said con- tract, all of which are hereby referred to and made parts of this ordinance. Section 3. That temporary notes signed by the �4ayor and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the amount of $190,705.00, for such work, such notes to bear interest not to exceed 41 per cent per annum and to mature not later than December 1, 1957, and to be issued in such amounts and at such time as money for the payment of the cost of such notes being issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof. Section 4.
