6074 Authorize Contract1 1 ORDINANCE NUMBER 6074 (Published in the Salina Journal1956) AN ORDINANCE ratifying and confirming a contract with 0. D. Wilmoth, Contractor for the construction of a certain lateral sanitary sewer in the City of Salina, Kansas, heretofore designated as Lateral Sanitary Sewer District 346, and providing for the issuance of tempo- rary notes to pay the cost thereof, pending issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance of the City of Salina, Kansas, of the proposal of the 0. D. Wilmoth Construction Company, hereinafter referred to as the "Contractor" as submitted to the Board of Commissioners on July 3, 1956, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said City to said contractor and signed on behalf of the City by its Mayor on July 10, 1956 for the construction of certain public improvements in the City of Salina, Kansas, to -wit: An 8 inch clay pipe sewer beginning at an existing manhole at the intersection of Chester Avenue and the Missouri Pacific Right-of-way thence north along the center line of Chester Avenue 744 feet where a manhole will be constructed which will be terminus of Lateral 346. at and for the unit price for said work contained in said proposal, which proposal and con- tract are hereby referred to and made a part of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvement as shown by the sworn estimate of the City Engineer on file in the office of the City Clerk which estimate is hereby referred to and made a part of this ordinance. Section 2. Said improvements shall be built and constructed in accordance with the ans and specifications therefore prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract, all of which are hereby referred to and made a part of this ordinance. Section 3. That temporary notes signed by the Mayor and attest by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the contract price of $2,170.00 for such work, such notes to bear interest at not to exceed 4' per cent per annum and to mature not later than December 1, 1957, and to be issued in such amounts and at such times as may the money for the payment of the cost of such work be required, such notes to be issued to said contractor and to be redeemed and cancelled at the time that Internal Improvement bonds are issued in lieu thereof. Section 4. That this ordinance shall take effect and be in full force from and after its publication once in the official city paper.
