RESOLUTION NUMBER 90-4187
A RESOLUTION AUTHORIZING THE MAYOR OF THE CITY OF SALINA,
KANSAS, TO EXECUTE A REPLACEMENT SPECIAL WARRANTY DEED
CONVEYING TO Q. A. APPLEQUIST CERTAIN REAL ESTATE PURSUANT TO A
LEASE DATED OCTOBER 1, 1972.
WHEREAS, on October 1, 1972, the City of Salina, Kansas, as the
Landlord, entered into a Lease with Javelin Corporation, as the Tenant, covering
the following described real estate, to -wit:
Lot Three (3), Brown and Brown Addition to the City of Salina, Saline
County, Kansas;
and
WHEREAS, Javelin Corporation, with the consent of the City of Salina,
Kansas, assigned all of its right, title and interest in and to the Lease to
Banner Industries, Inc., and subsequently Banner Industries, Inc., with the
consent of the City of Salina, Kansas, assigned the Lease to Q. A. Applequist;
and
WHEREAS, pursuant to the terms of the Lease
the
Board of
Commissioners adopted Resolution Number 84-3690 on
January
23, 1984,
authorizing the Mayor to execute a Special Warranty
Deed
conveying the
property from the City to Q. A. Applequist, which original
deed
has
never been
recorded with the office of the Saline County Register of
Deeds
and
cannot be
located; and
WHEREAS, the City's trustee under the industrial revenue bond issue,
First National Bank and Trust Company, verified on January 31, 1984, that all
amounts due have been paid such that Q. A. Applequist is entitled to receive a
deed to the property, SO NOW, THEREFORE
Kansas:
BE IT RESOLVED by the Governing Body of the City of Salina,
Section 1. That the Mayor is hereby authorized to execute and the
City Clerk to attest a replacement Special Warranty Deed to the above described
real estate in favor of Q. A. Applequist.
Section 2. That upon execution of the replacement deed the City
Attorney is instructed to deliver the deed to Q. A. Applequist.
Section 3. That this resolution shall be in full force and effect from
and after its adoption.
Adopted by the Board of Commissioners and signed by the Mayor this
7th day of May, 1990.
