AN ORDINANCE relating to and apportioning and levying special assessments on certain lots and
pieces of ground in the City of Salina, Kansas, to pay the cost of paving and grading Duvall
Street with concrete (twenty-eight (28) feet wide from toe of gutter to toe of gutter) from
the north line of Crawford Avenue to the north line of Haven Avenue; of paving and grading
Ellsworth Avenue with concrete (twenty-eight (28) feet wide from toe of gutter to toe of
gutter) from t e east line of Sunrise Drive to the east line of Roach Street; of paving and
grading Gebhart Street with concrete (twenty-eight (28) feet wide from toe of gutter to toe
of gutter) from the south line of Cloud Street to the north line of Charlotte Street; iV
of paving and grading Gebhart Street with concrete (twenty-eight (28) feet wide from toe of
gutter to toe of gutter from the north line of Charlotte Avenue to the south line of Leslie
Avenue; of paving and grading McAdams Road with concrete (twenty-eight (28) feet wide toe of
gutter to toe of gutter) from the west line of Pearl Avenue to the east line of Lewis Avenue;
of curbing, guttering, paving and grading of Armory Road with concrete (forty-one (41) feet
wide back of curb to back of curb) from the edge of present pavement on Broadway Boulevard to
a line 100 feet west of the west line of the Missouri Pacific Railroad right-of-way; of curb-
ing, guttering, paving and grading of West Walnut Street with concrete (thirty-three (33) feet
back of curb to back of curb) from the west line of Clark Street to the center line of Broad-
way Boulevard; of paving and grading Alley first east of Twelfth Street with concrete (twenty
(20) feet wide) from the north line of Elm Street to the south line of Bishop Street; and
relating to and providing for the collection and payment of such assessments.
BE IT ORDAINED BY THE BQARD OF COMMISSIONERS OF THE CITY OF SALINA, KANSAS;
Section 1, For the purpose of paying for that part of the cost of improvements in
certain portions of certain streets and alleys as hereinafter set forth in the following sec-
tion of this ordinance which is chargeable to the private property in the assessment districts
for each of such improvements, respectively, as set forth in the following sections of this
ordinance with respect to each of such improvements, there are hereby levied and assessed on
the property liable therefore, being all the lots and pieces of ground lying on either side
of said street so improved, respectively, to the middle of the block for the distance improved
with respect to the improvements mentioned in Sections 2 to 8 of this ordinance, and Section
9 of this ordinance being the lots and pieces of ground abutting on either side of said alley
so improved, according to the appraised value of such lots and pieces of ground with respect
to each such improvement, without regard to the buildings or improvements thereon, special
assessments covering the cost of such work and improvements, said special assessments being
based on the special valuation and appraisement of said lots and pieces of ground heretofore
made by three disinterested appraisers appointed by the Board of Commissioners of the City of
Salina, Kansas, with respect to each such improvement, which said appraisements are hereby
referred to and made a part of this ordinance, and the several amounts so levied, apportioned
and assessed against the lots and pieces of ground for each such improvements, respectively,
for the purpose aforesaid, are hereby found and determined to be the amounts set forth in the

Section 10. Said amounts so levied, apportioned and assessed as aforesaid will be due and
collectible in ten equal installments, the first becoming due with the taxes levied for the year
1956, and one of said installments falling due each and every year thereafter until all are
paid and all to be collected with interest as in this ordinance provided, PROVIDE, HOWEVER,
that the owner of any piece of property liable for any such assessment may redeem his property
from such liability by paying to the City Treasury the entire amount chargeable against the
same, as in this ordinance provided, at any time within thirty days after the publication of

this ordinance and before the issuance of bonds of said city in payment of the balance of the
cost of said improvements, the property so paid on shall not hereafter be liable for any
further assessments for the cost of said improvements nor for any part of said bonds.
Section 11. There is hereby levied further and assessed against such lots and pieces of
ground described in this ordinance, interest at such rate per annum as shall be borne by the
bonds hereafter to be issued for the payment of the remaining unpaid cost of such improvements,',
to be hereafter determined and fixed by ordinance when such bonds are issued, on all of said
installments mentioned and provided for in this ordinance, from the date of the bonds which
may be issued at the end of thirty days as specified in the preceding sections hereof, as by
law provided, to the time of the collection of the installment as provided by law, which said
interest shall be collected annually at the same time and in the same manner as said install-
ments are collected and after the taking effect of this ordinance and the fixing of the said
interest rate then such bonds are authorized and issued, it shall be the duty of the City
Clerk of said City to annually at the same time other taxes are certified and until all of
said assessments so apportioned and levied have been certified to the County Clerk of Saline
County, Kansas, a full list of all property liable to assessment and taxation for such work
and improvement, except such property on which the special assessments aforesaid have been
paid in full as hereinbefore provided, together with the respective amounts due on each of
said lots and pieces of ground with amounts shall include the annual installments of such
special assessments together with the interest for one year at the rate to be fixed as pro-
vided for in this ordinance, on all unpaid balances of such assessments, and such amounts so
certified as herein provided shall be placed upon the tax roll by the County Clerk of Saline
County, Kansas and collected as other taxes are collected.
Section 12. This ordinance shall take effect and be in force from and after its
publication once in the official city paper.
