,AN ORDINANCE relating to and apportioning and levying special assessments on certain lots and
;pieces of ground in the City of Salina, Kansas, to pay the cost of curbing, guttering and
(grading of Franklin Street, from the center line of Shawnee Avenue to the center line of Han -
,cock Street; Lewis Street, from the center line of McAdams Road to the center line of
Mellinger Streetj FFIHnger Street from the east line of Roach Street to the west line of Ohio
Street; Roach Street from the center line of McAdams Road to the center line of Mellinger Drive',;
�West Side of Broadway Boulevard, beginning on the north directly east of the southeast corner
of Banker's Addition thence south 318.2 feet more or less to a point directly east of the
northeast corner of Block 8, Sunset Manor Addition; and relating to and providing for the
collection and payment of such assessments.

Section 1. For that purpose of paying for that part of the cost of improving certain

,portions of certain streets as hereinafter set forth in the following sections of this ordi-
nance which is chargeable to the private property in the assessment district for each of such
'improvements, respectively, as set forth in the following sections of this ordinance with
respect to each of such improvements, there are hereby levied and assessed on the property
jliable therefore, being all the lots and pieces of ground lying on either side of said streets
so improved, respectively, to the middle of the block for the distance improved, with respect

Ito the improvements mentioned in Sections 2, 3, 42 5, and 6 of this ordinance, according to
;the appraised value of each lot and piece of ground with respect to each of such improvements,
Iiwithout regard to the buildings or improvements thereon, special assessments covering the cost
lof such work and improvements, and special assessments being based on the special valuation
and appraisement of said lots and pieces of ground heretofore made by three disinterested
lappraisers appointed by the Board of Commissioners of the City of Salina, Kansas, with respect

Section 7- Said amounts levied, apportioned and assessed aforesaid will be due and
collectible in four equal annual installments, the first becoming due with the taxes for the
year 1956 and one of said installments falling due each and every year thereafter until all
are paid, and all to be collected with interest as in this ordinance PROVIDED, HOWEVER, that
the owner of any piece of property liable for any such assessment may redeem his property from
such liability by paying into the City Treasury the entire amount chargeable against the same
as in this ordinance designated at any time within thirty days from the publication of this
ordinance and before the issuance of bonds of said city in payment of the balance of the cost
of said improvements, and the property so paid on shall not thereafter be liable for any fur-
ther aseessments for the cost of said improvements, and the property so paid on shall not
thereafter be liable for any further assessments for the cost of said improvements nor for any
part of said bonds.
Section 8 There is hereby further levied and assessed against each lot and piece of
ground described in this ordinance, interest at such rate per annum as shall be borne by the
bonds hereafter to be issued for the payment of the remaining cost of such improvements, to be
hereafter determined and fixed by ordinance when such bonds are issued, on all of said install-
ments mentioned and provided for in this ordinance, from the date of the bonds which may be
issued at the end of thirty days as specified in the preceeding sections hereof, as by law
provided, to the time of the collection of the last installment, as provided by law, which
said interest shall be collected annually at the same time and in the same manner as said
installments are collected, and after the taking effect of this ordinance, the fixing of said
interest rate when such bonds are authorized and issued, it shall be the duty of the City Clerk
of said City to annually at the same time other taxes are certified and until all of said
assessments so apportioned and levied therein have been certified, to certify to the County
Clerk of Saline County, Kansas, a full list of all property on which the special assessment
and taxation for such work and improvement is chargeable, except such property on which the
special assessments aforesaid have been paid in full as hereinafter before provided, together
Frith the respective amounts due on each of such lots and pieces of ground, which amounts shall
include the annual installments of such special assessments together with the interest for one
Tear at the rate to be fixed as provided for in this ordinance on all unpaid balances of such
3.ssessments, and such amounts so certified as herein provided for shall be placed upon the tax
?oll by the County Clerk of Saline County, Kansas, and collected as other taxes are collected.
