AN ORDINANCE relating to and apportioning and levying special assessments on certain lots
and pieces of ground in the City of Salina, Kansas, to pay the cost of paving and grading
with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, (twenty-eight (28)
feet wide from toe of gutter to toe of gutter) Ellsworth Avenue from the east side of Roach
Street to the west side of Lewis Avenue; paving and grading with two (2) inch hot asphalt
mijA over a six (6) inch crushed rock base, Illinois Street from the east line of Merrill
Street to the west line of Sheridan Street; paving and grading with two (2) inch hot asphalt
mix over a six (6) inch crushed rock base Lewis Street from the south line of Jewell Avenue
to the north line of Kirwin Avenue; paving and grading with two (2) inch hot mix asphalt
over a six f6) inch crushed rock base (twenty-eight (28) feet wide toe of gutter to toe of
gutter) Phillips Street from the north line of Crawford Avenue to the south line of Charles
Street; and relating to and providing for the collection and payment of such assessments.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. For the purpose of paying for that part of the cost of improvements in
certain portions of certain streets as hereinafter set forth in the following section of this
ordinance which is chargeable to the private property in the assessment district for such
improvements as set forth in the following sections of this ordinance with respect to such
improvements there are hereby levied, and assessed on the property liable therefor, being all
the lots and pieces of ground lying on either side of said street so improved, to the middle
of the block for the distance improved, with respect to the improvements mebtioned in Section
2, 3, 4J. and 5 of this ordinance, according to the appraised value of such lots and pieces of
ground with respect to such improvements, without regard to the buildings or improvements
thereon, special assessments covering the cost of such work and improvements, said special
assessments being based on the special valuation and appraisement of said lots and pieces of
ground heretofore made by three disinterested appraisers appointed by the Board of Commissioners
of the City of Salina, Kansas, with respect to such improvements, which said appraisement is
hereby referred to and made a part of this ordinance, and the several amounts so levied,
apportioned and assessed against the lots and pieces of ground for such improvement, for the
purpose aforesaid, are hereby found and determined to be the amounts set forth in the follow-
ing sections of this ordinance with respect to each of said improvements.
Section 2. For that part of the cost of paving and grading with two-inch hot mixed
asphaltic concrete over a six-inch rock stabilized base, (twenty-eight (28) feet wide from
toe of gutter to toe of gutter) Ellsworth Avenue from the east side of Roach Street to the
west side of Lewis Avenue, which is chargeable against the private property within the dis-
trict chargeable therefor, and which cost is hereby determined to be $5,275.83, there is
hereby levied, apportioned and assessed against the following described lots and pieces of
land as provided for in Section 1 of this ordinance, the following amounts:

Section 6. Said amounts so levied, apportioned and assessed as aforesaid shall be due
and collectible in ten equal installments, the first becoming due with the taxes levied for
the year 1956, and one of said installments falling due each and every year thereafter until
all are paid, and all to be collected with interest as in this ordinance provided however,
that the owner of any piece or pieces of property liable for any such assessment may redeem
his property from such liability by paying into the City Treasury the entire amount charge-
able against the same, as in this ordinance designated, at any time within thirty days after
the publication of this ordinance and before the issuance of bonds of said city in payment of
the balance of the cost of said improvements, the property so paid on shall not thereafter
be liable for any further assessments for the cost of said improvements nor for any part of
said bonds.

Section 7. There is hereby levied further and assessed against such lots and pieces of
ground described in this ordinance, interest at such rate per annum as shall be borne by the
bonds hereafter to be issued for the payment of the remaining unpaid cost of such improve-
ments, to be hereafter determined and fixed by ordinance when such bonds are issued, on all
of said installments mentioned and provided for in this ordinance, from the date of the bonds
which may be issued at the end of thirty days as specified in the preceding sections hereof,
as by law provided, to the time of the collection of the installment as provided by law,
which said interest shall be collected annually at the same time and in the same manner as
said installments are collected and after the taking effect of this ordinance and the fixing
of the said interest rate when such bonds are authorized and issued, it shall be the duty of
the City Clerk of said City to annually at the same time other taxes are certified and until
all of said assessments so apportioned and levied have been certified to the County Clerk of
Salina County, Kansas, a full list of all property liable to assessment and taxation for such
work and improvement except such property on which the special assessments aforesaid have been
paid in full as hereinbefore provided, together with the respective amounts due on each of
such lots and pieces of ground which amounts shall include the annual installments of such
special assessments together with the interest for one year at the rate to be fixed as pro-
vided for in this ordinance, on all unpaid balances of such assessments, and such amounts so
certified as herein provided shall be placed upon the tax roll by the County Clerk of Saline
County, Kansas, and collected as other taxes are collected.
Section B. This ordinance shall take effect and be in force from and after its adoption
and publication once in the officcial city paper.,
