ORDINANCE NUMBER

AN ORDINANCE relating to and apportioning and levying special assessments on certain lots and
pieces of ground in the City of Salina, Kansas, to pay the cost of paving and grading Charlotte
Street with concrete (twenty-eight (28) feet wide from toe of gutter to toe of gutter) from
the east line of Simmons Street to the.east line of Ninth Street; of paving and grading Cloud
Street, with concrete (thirty-two (32) feet wide from toe of gutter to toe of gutter) with
concrete from the west line of Ninth Street to the east side of Highway slab on 81 by-pass;
of paving and grading Custer Street with concrete (Twenty-eight (28) feet from toe of gutter
to toe of gutter) from the south line of Crawford Avenue to the south line of Republic Avenue;
of paving and grading Funston Street with concrete (twenty-eight (28) feet from toe of gutter
to toe of gutter) from the south line of Sunset Drive to the south line of Ellsworth; of
paving and grading Gypsu# Avenue with concrete from the east line of Wisconsin Avenue to the
East line of Missouri Avenue; of paving and grading Highland Avenue with concrete (twenty-
eight (28) feet wide from toe of gutter to toe of gutter) from the south line of Cloud Street
to the north line of Charlotte Street; of paving and grading Highland Avenue with concrete

the north line of Charlotte Street to the south line of Leslie Street; of paving and grading
Morningside Drive with concrete (twenty-eight (28) feet wide from toe of gutter to toe of
gutter) from the east line of Sunrise Drive to the west line of Roach Street; of paving and
grading Tenth Street with concrete (twenty-eight (28) feet wide from toe of gutter to toe of
gutter) from the north line of Frost Street to the south line of Franklin Street; of paving and
grading Third Street with concrete (twenty-eight (28) feet wide from toe of gutter to toe of
gutter) from the north line of Republic Avenue to the south line of Lamar Street; of paving
and grading Third Street with concrete (twenty-eight (28) feet wide from toe of gutter to toe
of gutter) from the south line of Lamar Street to the north line of Lamar Street; of paving
and grading Simmons Street with concrete (twenty-eight (28) feet wide from toe of gutter to
toe of gutter) from the south line of Cloud Street to the north line of Charlotte Street; of
paving and grading Simmons Street with concrete (twenty-eight (28) feet wide from toe of
gutter to toe of gutter) from the south line of Charlotte Street to the south line of Leslie
Street; of paving and grading Wisconsin Avenue with concrete (thirty-three (33) feet back of
curb to back of curb) from the south line of Iron Avenue to the north side of Gypsum Avenue;
of curbing, guttering, paving and grading of Chicago Street with concrete (thirty-three (33)
feet wide back of curb to back of curb, from the center line of Broadway Boulevard to the
north right-of-way of the Union Pacific Railroad; of curbing, guttering paving and grading
Connecticut Avenue with concrete (twenty-eight (28) feet wide toe of gutter to toe of gutter)
from the north line of Stack Avenue to the north line of Greeley Avenue; of curbing, guttering,
paving and grading Decatur Street with concrete from the east line of Santa Fe Avenue to the
west line of Fifth Street; of curbing, guttering, paving and grading of Pershing Street with
concrete (thirty-three (33) feet back of curb to back of curb) with concrete from the north
line of Claflin to the North line of Cloud Street; curbing, guttering, paving and grading East
side of West Place with concrete (twenty (20) feetwide from toe of gutter to edge of slab,
from the nosesN of'-Univerzity Street to -the sbuth:'.line-'of State Street; and relating to
and providing for the collection and payment of such assessments,
BE IT ORDAINED BY the Board of Commissioners of the City of Salina, Kansas;
Seetien to For the purpose of paying for that part of the cost of improvements in certain
portions of certain streets as hereinafter set forth in the following section of this ordinance
which is chargeable to the private property in the assessment districts for each of such
improvements, respectively, as set forth in the following sections of this ordinance with
respect to each of such improvements, there are hereby levied and assessed on the property
liable therefore, being all the lots and pieces of ground lying on either side of said street
so improved, respectively, to the middle of the block for the distance improved with respect
to the improvements mentioned in Sections 2, 3, 4, 5, 6, 71 81 91 10, 11) 12, 13, 14, 15, 16
17, 18, 19, 20, and 21 of this ordinance, according to the appraised value of such lots and

pieces of ground with respect to each such improvement, without regard to the buildings or
improvements thereon, special assessments covering the cost of such work and improvements,
said special assessments being based on the special valuation and appraisement of said lots
!and pieces of ground heretofore made by three disinterested appraisers appointed by the Board
�of Commissioners of the City of Salina, Kansas, with respect to each such improvement, which
said A.ppraisements are hereby referred to and made a part of this ordinance, and the several
amounts so levied, apportioned and assessed against the lots and pieces of ground for each
such improvements, respectively, for the purpose aforesaid, are hereby found and determined
to be the amounts set forth in the following sections of this ordinance with respect to each
lof said improvements.
Section 2. For that part of the cost of paving and grading Charlotte Street with
,concrete twenty-eight (28) feet wide from toe of gutter to toe of gutter from the east line
lof &immons Street to the east line of Ninth Street, which is chargeable against the private
1property within the district chargeable therefore, and which cost is hereby determined to be

Section 22. Said amounts so levied, apportioned and assessed as aforesaid will be
f due and collectible in ten equal installments, the first becoming due with the taxes levied
for the year 1956, and one of said installments falling due each and every year thereafter
i
until all are paid and all to be collected with interest as in this ordinance provided,
PROVIDED, HOWEVER, that the owner of any piece of property liable for any such assessment
f ,
may redeem his property from such liability by paying to the City Treasury the entire amount
i
chaxgeable against the same, as in this ordinance provided, at any time within thirty days
i
after the publication of this ordinance and before the issuance of bonds of said city in
payment of the balance of the cost of said improvements, the property so paid on shall not
hereafter be liable for any further assessments for the cost of said improvements nor for
any part of said bonds.

Section 23. There is hereby levied further and assessed against such lots and pieces
i
of ground described in this ordinance, interest at such rate per annum as shall be borne by
jthe bonds hereafter to be issued for the payment of the remaining unpaid cost of such
improvements, to be hereafter determined and fixed by ordinance when such bonds are issued,
on all of said installments mentioned and provided for in this ordinance, from the date of
the bonds which may be issued at the end of thirty days as specified in the preceding

sections hereof, as by law provided, to the time of the collection of the installment an

the same manner as said installments
are collected and after the taking effect of this
ordinance and the fixing of the said interest rate when such bonds are authorized and
issued, it shall be the duty of the City Clerk of said City to annually at the same time
other taxes are certified and until all of said assessments so apportioned and levied have
been certified to the County Clerk of Saline County, Kansas, a full list of all property
liable to assessment and taxation for such work and improvement, except such property on

which the special assessments aforesaid have been paid in full as hereinbefore provided, I
together with the respective amounts due on each of said lots and pieces of ground with
amounts shall include the annual installments of such special assessments together with
the interest for one year at the rate to be fixed as provided for in this ordinance, on
all unpaid balances of such assessments, and such amounts so certified as herein provided
shall be placed upon the tax roll by the County Clerk of Saline County, Kansas, and collected
as other taxes are collected.
Section 24. This ordinance shall take effect and be in force from and after its
publication once in the official city paper.
