6064 Utility Imp-Southern ViewCON �;O)1A VA "ED-SALINA 1 1 ORDINANCE NUMBER 6064 (Published in the Salina Journal'�l_) (� , 1956) AN ORDINANCE providing for the construction of a certain storm sewer and drainage in the City of Salina, Kansas, to be designated as Southern View Addition Storm Sewer, and pro- viding for the letting of contract for such construction and for the payment of the cost thereof. WHEREAS, at all times heretofore, the entire City of Salina, Kansas has constituted a storm sewer and drainage district and bonds issued to pay the cost thereof are payable by a general tax as provided by law; and BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the preamble of this ordinance is hereby incorporated herein. That the entire City of Salina is hereby determined to be the benefit district for the purpose of the installation of a system of storm sewers and drainage in the said city. That the entire limits of said city has always constituted ore district for said purposes. Section 2. That it is necessary and it is hereby ordered that a storm sewer, which is hereby designated as Southern View Addition Storm Sewer, together with all necessary inlets, inlet connections, manholes, connecting lines, sluice gates and other appurtenances, be constructed in the City of Salina along the following course, to -wit: A 60 inch pipe sewer beginning with a concrete storm sewer outfall located at a point on the Smoky Hill Raver 1200 feet north by 400 04t east of the SW corner of the NW V4 of Section 30, Township 14 south Range 2 east of the 6th P.M. in Saline County, Kansas, thence south west to the SW corner of the NW 1/4 of the above described Section, where Manhole No. 1 will be constructed, thence west along the center line of Wayne Avenue extended east 2000 feet where Manhole No. 2 will be constructed, thence a 24"sewer will run north in the R%W from Norton Street 1020 feet to the intersection of Norton Street and Leslie Avenue where Manhole N0.3 will be constructed, thence a 24" sewer will extend north 300 feet to the intersection of Norton Street and Albert Avenue where Manhole No. 4 will be constructed, thence a 24" sewer will extend north 296 feet to the intersection of Norton Street. and Carl Avenue, where Manhole No. 5 will be constructed, thence a 21" sewer will extend north 268 feet to the intersection of Norton Street and Ralph Avenue where Manhole No. 6 will be constructed, thence a 21" sewer will extend north 260 feet to the intersection of Norton Street and Max Avenue, where Manhole No. 7 will be constructed thence a 18" sewer will be extended north 300 feet where Manhole No. 8 will be constructed Branches will be constructed both east and west from manholes 3,4,5,6, and 7 more particularily described as follows: Branch 1: A 15 inch pipe beginning at Manhole No. 3 extending east 300 feet where a manhole will be constructed and a 15 inch pipe ex- tending 300 feet west from Manhole No. 3 where a manhole will be con- structed Branch 2: A 15 inch pipe beginning at Manhole No. 4 extending east 300 feet where a manhole will be constructed and a 18f pipe extending 300 feet west from Manhole No. 4 where a manhole will be constructed. Branch 3: A 15 inch pipe beginning at Manhole No. 5 extending east 300 feet where a manhole will be constructed and a 15 inch pipe ex- tending 300 feet west from Manhole No. 5 where a manhole will be con- structed. Branch 4: A 15 inch pipe beginning at Manhole No. 6 extending east 220 feet where a manhole will be constructed and a 15 inch pipe exten- ding 300 feet west from Manhole No. 6 where a manhole will be constructed. CON SJ TA DA TTD-SAL INA 1 7 Branch 5: A 15 inch pipe beginning at Manhole No. 7 extending east 220 feet where a manhole will be constructed and a 18 inch pipe extending 300 feet west from Manhole No. 6 where a manhole will be constructed: Section 3. That on or before the 12th day of June, 1956, the City Engineer shall prepare and file in the office of the City Clerk, detailed plans and specifications for the ©nstruction of the storm sewer provided for in Section 2 of this ordinance with vitrified and/or corrugated metal pipe, bituminous coated, and/or concrete sewer pipe or any combi- nation of such type of sewer pipe and on or before the same date shall prepare and file in the office of the City Clerk, under oath, a detailed estimate of the cost thereof. After such plans and specifications and estimate of cost shall have been filed, the City Clerk shall advertise by advertisements published in the official city paper for at least three donsecutive days for sealed proposals for the building and construction of such storm sewer and at the time and place mentioned, the Board of Commissioners may let a contract with the lowest and best responsible bidder for the building and construction of such storm and drainage sewers, but the right to reject any and all bids shall be and it is hereby reserved, and provided further that if no responsible person shall purpose to enter a contract at a price not exceeding the estimated cost, then the Board of Commissioners may proceed to con- struct said improvements within the estimated cost thereof and shall purchase the necessary tools, apparaatus, and materials and employ the necessary labor for the purpose of construct- ing the sewer. Section 4. That for the payment of the cost of said work, the Board of Commissioners shall issue General Clbligation and Improvement Bonds of the City of Salina, Kansas, in an amount not to exceed the total cost of such work and improvements, to be payable in ten approximately equal annual installments and to bear interest at not to exceed five per cent per annum and from the date of such bonds, and for the purpose of paying such bonds and interest as they severally become due, the Board of Commissioners shall annually levy a tax upon all real and personal property in the City of Salina, in an amount sufficient to pay the annual installments of such principal and interest, and that pending the issuance of such bonds, temporary notes shall be issued according to law, to pay the cost of such work.
