AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF A
PUBLIC UTILITY EASEMENT IN BLOCK 8, TWIN OAKS II SUBDIVISION TO THE CITY

BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:

Section 1. That on June 20, 2005, the governing body conducted a public hearing on the
petition filed by St. Elizabeth Ann Seaton Catholic Church ("Petitioner") requesting vacation of a
portion of the public utility easement located in Block 8, Twin Oaks II Subdivision to in the City of
Salina, Saline County, Kansas as shown on Exhibit "A" and more particularly described as follows:
that:
Beginning at a point that is 246.33 feet west and 10.00 feet north of the
Southeast corner of Block 8, Twin Oaks II Subdivision, City of Salina,
Saline County, Kansas; thence west a distance of 20.00 feet, thence north
and parallel to Redbud Lane (vacated) extended south to a point 160.00
feet south of the north line of said Block 8; thence east 20.00 feet; thence
south to the point of beginning.
Section 2. That the governing body finds from the evidence presented at the public hearing
(a) Due and legal notice has been given by publication as required by law.
(b) No private rights will be injured or endangered by the vacation of the
utility easement.
(c) Injustice to the Petitioner this utility easement vacation request should
be granted.
Section 3. That a portion of the utility easement located in Block 8, Twin Oaks II
Subdivision is hereby vacated and shall revert to the owners of Block 8, Twin Oaks II Subdivision in the
City of Salina, Saline County, Kansas.
Section 4. That this ordinance shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.
