REGULAR MEETING OF THE BOARD OF COMMISSIONERS
October 17, 2005

z The City Commission convened at 2:30 p.m. in a Study Session for a report on the Master Plan for
w Diamond Drive and West Grand Avenue. The Regular Meeting of the Board of Commissioners was
called to order at 4:00 p.m. in Room 107, City -County Building. A roll call was taken followed by the
Pledge of Allegiance and a moment of silence.

CITIZEN FORUM
AWARDS - PROCLAMATIONS
(4.1) The day of October 19, 2005 as "Disability Mentoring Day" in the City of Salina. Sharon
Luka, Human Service Consultant for the Kansas Services for the Blind and Visually
Impaired/Rehabilitation Services, will read the proclamation.
PUBLIC HEARINGS AND ITEMS SCHEDULED FOR A CERTAIN TIME
(5.1) Public hearing on Petition No. 4267, filed by Schwan's Food Manufacturing, Inc, to
consider the vacation of a portion of two existing public utility easements in Block 12, Schilling
Subdivision 45.
Vice -Mayor Marrs opened the public hearing.
Brad Johnson, City Engineer, explained the request.
There being no further comments, the public hearing was closed.

No. 05-10310 on first reading. Aye: (3). Nay: (0). Motion carried.
CONSENT AGENDA
(6.1) Approve the minutes of October 3, 2005.
(6.2) Award of bid for the construction of the Police Department interior office remodel to
Medina Construction Company in the amount of $14,600.
(6.3) Acknowledge receipt of the 2006 Budget and Activities Plan for Community Access
Television of Salina, Inc.

(8.1) Second reading Ordinance No. 05-10308 establishing a capital cost recovery charge for the
purpose of paying a portion of a water distribution system for Euclid Avenue.
Vice -Mayor Marrs noted that Ordinance No. 05-10308 was passed on first reading on
October 3, 2005 and since that time no comments have been received.
05-6978 Moved by Commissioner Vanier, seconded by Commissioner Perney, to adopt Ordinance
No. 05-10308 on second reading. A roll call vote was taken. Aye: (3) Perney, Vanier, Marrs. Nay:
(0). Motion carried.
(8.2) Second reading Ordinance No. 05-10309 providing a change in zoning district
classification from R (Single -Family Residential) to A-1 (Agricultural) on property located in the 1500
block of East Woodland Avenue and described as Lots 1 — 4 and the East 25 feet of Lot 5, Block 2,
Cloverdale Addition.
Vice -Mayor Marrs noted that Ordinance No. 05-10309 was passed on first reading and
since that time no comments have been received.
05-6979 Moved by Commissioner Vanier, seconded by Commissioner Perney, to adopt Ordinance
No. 05-10309 on second reading. A roll call vote was taken. Aye: (3) Perney, Vanier, Marrs. Nay:
(0). Motion carried.
(8.3) Resolution No. 05-6219 urging the United States Congress to reject legislation that would
restrict the role of local governments in managing public rights-of-way, or awarding franchises to
video providers.
Greg Bengtson, City Attorney, explained the legislations.
David Hawksworth, Executive Director of Community Access Television, commented on
the legislations and the resolution.
A discussion followed between Commission Perney, Vice -Mayor Marrs, and Mr. Hawksworth
the legislations and the delivery of the resolution.

No. 05-6219. Aye: (3). Nay: (0). Motion carried.
