ORDINANCE NUMBER 6167 /

AN ORDINANCE ratif Ing and confirming a contract with Brown and Brown, Inc. for the
construction of certain paving and grading improvements on certain streets in the City of
Salina, Kansas, and providing for the issuance of temporary notes to pay the cost thereof
pending the issuance and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. T41 the acceptance by the City of Salina, Kansas, of the proposal of the
Brown and Brown Construction Company, Inc. hereinafter referred togas the "Contractor" as
submitted to the Bo Ird of Commissioners on July 16, 1957, which is hereby found to be the
lowest and best bid for such work, and the contract awarded by the Board of Commissioners of
said City to said contractor and signed on behalf of the City by its Mayor on July 30, 1957,
for the construction of certain public improvements in the City of Salina, Kansas, to -wit:
Curbing, guttering, paving and grading. of Cloud Street
(thirty-seven (37) feet wide from back of curb to of
curb) with two (2) inch hot asphalt mix over a six (6)
inch crushed rock base, from the west line of Broadway
ulevard to the east right-of-way line of the Missouri
Pacific Railroad, as provided for by Resolution Number 1811
and Ordinance Number 6159•
Curbing, guttering, paving and grading of Cloud Street
(thirty-seven (37) feet wide from back of curb to back of
curb) with two (2) inch hot asphalt mix over a six (6)
inch crushed rock base, from the east line of the Missouri
Pacific Railroad right-of-way to the west line of Westwood
Road, as provided for by Resolution Number 1824 and Ordinance
Number 6159
Curbing, guttering, paving and grading of Dover Drive
(hirty-three (33) feet wide from back of curb to back of
curb) with two (2) inch hot asphalt mix over a six (6)
inch crushed rock base, from the south end of Dover Drive
to the south side of Cloud Street, as provided for by Resolution
N�nber 1820 and Ordinance Number 6159•

at and for the unit price for said work contained in said proposal, which proposal and contract
are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and
confirmed, said proposal being within the estimated cost of said improvements as shown by the
sworn estimates of the City Engineer on file in the office of the City Clerk, which estimates i
are heaeby referred to and made a part of this ordinance.
Section 2. Said improvements shall be built and constructed in accordance with the plans
and specifications therefore prepared by the City Engineer on file in the office of the City
Clerk and in accordance with the propeal of said contractor and under the terms of said contrast,
all of which are hereby referred to and made a part of this ordinance.
Section 3. That temporary notes signed by the Mayor and attested by the City Clerk be
issued from time to time as the work progresses in the manner and form as required by law, the'
total amount thereof not to exceed the amount of $129,778.00, for such work, such notes to bear
interest not to exceed 5 per cent per annum and to mature not later than December 1, 1958, and!
to be issued in such amounts and at such times as money for the payment of the cost of such
notes being iedued to said contractor and to be redeemed and cancelled at the time that permanent
bonds are issued in lieu thereof.
Section 4. This ordinance shall take effect and be in force from and after its
publication once in the official city paper.
