AN ORDINANCE creatiagland defining a certain lateral sanitary sewer district in the City of
(Salina, Kansas, designated as Lateral Sanitary Sewer District Number 363 and providing for
ithe construction of alateral sanitary sewer in said Lateral Sanitary Sewer District Number
!363, so created and providing for the payment of the cost thereof and for the levying of
special assessments against the property in said district for the payment of the cost of
Isuch construction andllfor the issuing of bonds to pay the cost thereof.
IBE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:

Section 1.Lateral,Sanitary Sewer District Number 363. That there be and there is hereby

created lateral sanitary sewer district in the City of Salina, Kansas, which shall be and it
i
lis hereby designated as Lateral Sanitary Sewer District Number 363, and which district shall
�clude all the following described property in the City of Salina, Kansas, to -wit:
Benefit District: Blocks 3 and 4, Riker Addition,
City of Salina, Saline County, Kansas.
Section 2. It isnecessary and it is hereby ordered that an eight -inch V. C. P. Lateral
Sanitary Sewer with ail, necessary connections, manholes, flushing tanks and other appurtenances
e constructed and built in and to serve said Lateral Sanitary Sewer District Number 363 as
created by Section 1 6f this ordinance along the following course, to -wit:
An!eight-inch clay pipe sewer beginning at an existing
man -ole in Ohio Street which is 7.0 feet west of the center
lie of Ohio Street and on line with center of Blocks 3 and 4
innRiker Addition; thence west along center line of said Blocks to
a point 50 feet east of the east line of Roach Street at which
point a manhole will be constructed which will be terminus of
Lateral 363.
Section 3. That the City Engineer shall on or before the 30th day of July, 1957, prepare
file in the office of the City Clerk, plans and specifications for the construction of the
neral Sanitary Sewer provided for in the preceding sections of this ordinance which shall be
the proper character to serve the property lying within the district for which such sewer
to be constructed and shall on or before the same date prepare and submit to the Board of
and ssioners a detailed estimate under oath of the cost thereof. That thereafter the City
rk shall advertiselfor three consecutive days in the official city paper for sealed proposals!
the building and construction of such a sewer according to such plans and specifications,
,ch proposals shall',be filed with the City Clerk on or before the time fixed in such notice,
which time the Board of Commissioners my let a contract for the building and construction
such sewer to the ]lowest and best responsible bidder or bidders therefore, if, there be any
,se bids do not exceed the estimated cost thereof, but said Board shall reserve the right to
ct any or all such proposals, and if no bids shall be received within ebch estimate the

estimated cost thejreof as provided by law.

Section 4. That for the cost of building and constructing such sewer, special assessments
shall be made for the full cost thereof on all lots and pieces of land within and for which j
such sewer shall be built, according to the appraised value thereof, without regard to the
buildings or improvements thereon.
Section 5. After the passage and publication of this ordinance, the Board of Commissioners'
shall appoint three disinterested appraisers, who after having taken oath to make a true and
impartial appraisement of all lots and pieces of land liable to taxation for the cost of such
improvements shall within five days after having been notified of their appointments proceed
',to appraise all of the lots and pieces of land within the district liable to assessment and
taxation as aforesaid, without regard to the buildings or improvements thereon, and after
such appr8 bements, shall return to the Board of Commissioners of said City and said
shall designate a time for a special meeting of said Board for the purpose of hearing
complaints that may be made as to the value of any lot or piece of land appraised is
resaid, of which special cession due notice shall be given in the official city paper, at
ch special session said Board may alter any valuation of any lot or piece of land, if, in their
pion, the same has been appraised too high or too low.
Section 6. The Special assessment herein provided for may be paid by the person liable

Section 7. For the purpose of paying for the work and improvements in thie ordinance

of all property liable for such work and improvement, together with the respective numbered
amounts due on each of said tracts, pieces and parcels of land, which amounts shall include
the annual installments and interest on all unpaid balances for one year at the rate of not
to exceed five per cent per annum on such amounts so certified, which amounts shall be
collected as other taxes are collected.
Section 8. This ordinance shall take effect and be in force from and after its
publication once in the official city paper.
